U.S. opens probe into whether VW vehicles infringe Jaguar Land Rover patents

WASHINGTON — The U.S. International Trade Commission (ITC) said on Monday it is opening in investigation into whether Volkswagen AG infringed on patents held by Jaguar Land Rover for a system used for off-road driving. In November, Jaguar Land Rover, a unit of Tata Motors, filed a complaint with the ITC seeking to prevent the import of some VW Porsche, Lamborghini and Audi models with "certain vehicle control systems" that allegedly infringe on it patents held for its Terrain Response system. The models include the Lamborghini Urus, Porsche Cayenne and AudiÂ’s Q8, Q7, Q5, A6 Allroad, and E-Tron vehicles and the VW Tiguan. The ITC said it has made no decision on the merits. VW said in a statement it was examining the action and determining its next steps. "We will of course cooperate with investigating authorities. While we cannot comment on any details of the proceedings, we strongly believe that the claims have no merit and will robustly defend our position," VW said. Many automakers offer a suite of off-road powertrain controls, but JLR claims Volkswagen's tech is more than just similar.  Jaguar Land Rover (JLR) said the vehicles "have used JLRÂ’s patented inventions without payment or permission" notably a patent for an "improved system for driving a vehicle on different driving surfaces, in particular off-road." JLR says its Terrain Response technology uses the patented technology to maximize performance on off-road driving surfaces, including grass, snow, mud, sand and rocks.

You wouldn’t know it was about Jags and Lambos, to judge by its rather dry name: In the Matter of Certain Vehicle Control Systems. But thatÂ’s the complaint Jaguar Land Rover Automotive Plc filed on Thursday to block U.S. imports of Porsche, Lamborghini, Audi and Volkswagen sport utility vehicles it says are using its patented Terrain Response technology without permission. Jaguar Land Rover, a British carmaker owned by IndiaÂ’s Tata Motors Ltd., said in its filing with the U.S. International Trade Commission that the technology helps negotiate a “broad range of surfaces” and is a key feature in JaguarÂ’s F-Pace and Land Rover Discovery vehicles. “JLR seeks to protect itself and its United States operations from companies that have injected infringing products into the U.S. market that incorporate, without any license from JLR, technology developed by JLR and protected by its patent,” JaguarÂ’s lawyer, Matthew Moore, said in the filing. Representatives of Volkswagen didnÂ’t immediately respond to emails seeking comment on the complaint. Jaguar wants to block imports of PorscheÂ’s Cayenne; LamborghiniÂ’s Urus; AudiÂ’s Q8, Q7, Q5, A6 Allroad and e-tron vehicles; and VWÂ’s Tiguan vehicles. It said there are plenty of other luxury midsize SUV and compact crossover vehicles to meet consumer demand if the SUVs are banned from the U.S. Still, the premium Porsche and Audi lines provide much of the profit VW is using to fund its investments in technology for electric vehicles, autonomous vehicles and further innovations. In addition to the four brands, Volkswagen Group owns other upscale nameplates, including Bentley and Bugatti. The International Trade Commission is an independent, quasi-judicial agency that investigates complaints of unfair trade practices, like patent infringement. It canÂ’t award damages but does have the power to block products from entering the U.S. Owners of patents and trade secrets like it because it can work faster than the federal district courts -- the typical investigation is completed in 15 to 18 months. But Jaguar also filed patent lawsuits against the companies in federal courts in Delaware and New Jersey, seeking cash compensation for the use of the technology. Those cases are likely to be put on hold once the trade commission launches its investigation. With the unveiling of the GMC Hummer EV, the list of planned electric pickups is expanding. Legacy automakers like Ford and Chevy have theirs coming, as do startups like Tesla, Rivian and Bollinger, as well as some lesser known brands. Here are all the electric pickup trucks we know to be in the works, along with a few that are being discussed or mulled over. GMC Hummer EV The 2022 GMC HUMMER EV is a first-of-its kind supertruck develop View 40 Photos We’ve seen it now, and itÂ’s the business. The GMC Hummer EV comes out swinging with 1,000 horsepower from GMÂ’s new Ultium electric powertrain program, a wealth of off-road features, a removable roof, Super Cruise and the revival of the Hummer name. WeÂ’ll see the first ones on the road next fall. Tesla Cybertruck Tesla Cybertruck at the Petersen Museum View 14 Photos Tesla revealed the Cybertruck last year with, ahem, unique styling, a number of powertrain options and a claimed range of up to 500 miles. It has a compressed paper dash, a ramp for the bed, and “shatterproof” windows. It has already racked up hundreds of thousands of reservations. It will be built in Texas. Rivian R1T 2021 Rivian R1T View 15 Photos EV startup Rivian revealed its R1T electric pickup toward the end of 2018 with a claimed 0-60 time of 3 seconds and a towing capability of 11,000 pounds. Preproduction began in September 2020 at RivianÂ’s factory in Normal, Illinois. It was created with both enthusiasts and workers in mind, with features that can get it to remote places (portal axles, hydro-pneumatic suspension) and to get things done (room for 40 2x4s, equipped with eight 110-volt outlets and one 220-volt outlet). Bollinger also plans to make the B2 Chassis Cab available for fleet customization. Ford F-150 Electric Electric Ford F-150 Towing View 9 Photos WeÂ’ve known this to be in the works since early 2019. Since then, details have trickled out. Back in June, Ford announced its F-150 Electric would be coming within two years. WeÂ’ve seen it pull a million pounds worth of train and trucks, heard it will have more power than any other F-150, and seen its LED-laden front end.

Defying Trump, major automakers finalize California emissions deal

WASHINGTON — The California Air Resources Board (CARB) and major automakers on Monday confirmed they had finalized binding agreements to cut vehicle emissions in the state, defying the Trump administration's push for weaker curbs on tailpipe pollution. The agreements with carmakers Ford Motor Co, Volkswagen AG, Honda Motor Co and BMW AG were first announced in July 2019 as voluntary measures prompting anger from U.S. President Donald Trump. A month later, the Justice Department opened an antitrust probe into the agreements. The government ended the investigation without action. The Trump administration in March finalized a rollback of U.S. vehicle emissions standards to require 1.5% annual increases in efficiency through 2026. That is far weaker than the 5% annual increases in the discarded rules adopted under President Barack Obama. The 50-page California agreements, which extend through 2026, are less onerous than the standards finalized by the Obama administration but tougher than the Trump administration standards. The automakers have also agreed to electric vehicle commitments. Volvo Cars, owned by China's Geely Holdings, said in March it planned to join the automakers agreeing to the California requirements. It has also finalized its agreement. The settlement agreements say California and automakers agreed to resolve "potential legal disputes concerning the authority of CARB" and other states that have adopted California's standards. In May, a group of 23 U.S. states led by California and some major cities, challenged the Trump vehicle emissions rule. Other major automakers like General Motors Co, Fiat Chrysler Automobiles NV and Toyota Motor Corp did not join the California agreement. Those companies also sided with the Trump administration in a separate lawsuit over whether the federal government can strip California of the right to set zero emission vehicle requirements. Ford said the "final agreement will reduce emissions in our vehicles at a more stringent rate, support and incentivize the production of electrified products, and create regulatory certainty." BMW said "by setting these long-term, predictable, and achievable standards, we have the regulatory certainty that is necessary for long-term planning that will not only reduce greenhouse gas emissions but ultimately benefit consumers as well."

It goes without saying, but I'll say it anyway. The world is full of cars, and just about as many of them are bad as are good. It's pretty easy to pick which fall into each category after giving them a thorough walkaround and, more important, driving them. But every once in a while, an automobile straddles the line somehow between good and bad — it may be hideously overpriced and therefore a marketplace failure, it may be stupid quick in a straight line but handles like a drunken noodle, or it may have an interior that looks like it was made of a mess of injection-molded Legos. Heck, maybe all three. Yet there's something special about some bad cars that actually makes them likable. The idea for this list came to me while I was browsing classified ads for cars within a few hundred miles of my house. I ran across a few oddballs and shared them with the rest of the team in our online chat room. It turns out several of us have a few automotive guilty pleasures that we're willing to admit to. We'll call a few of 'em out here. Feel free to share some of your own in the comments below. Dodge Neon SRT4 and Caliber SRT4: The Neon was a passably good and plucky little city car when it debuted for the 1995 model year. The Caliber, which replaced the aging Neon and sought to replace its friendly marketing campaign with something more sinister, was panned from the very outset for its cheap interior furnishings, but at least offered some decent utility with its hatchback shape. What the two little front-wheel-drive Dodge models have in common are their rip-roarin' SRT variants, each powered by turbocharged 2.4-liter four-cylinder engines. Known for their propensity to light up their front tires under hard acceleration, the duo were legitimately quick and fun to drive with a fantastic turbo whoosh that called to mind the early days of turbo technology. — Consumer Editor Jeremy Korzeniewski  Chevrolet HHR SS: Chevy's HHR SS came out early in my automotive journalism career, and I have fond memories of the press launch (and having dinner with Bob Lutz) that included plenty of tire-smoking hard launches and demonstrations of the manual transmission's no-lift shift feature. The 260-horsepower turbocharged four-cylinder was and still is a spunky little engine that makes the retro-inspired HHR a fun little hot rod that works quite well as a fun little daily driver.

Porsche CEO Oliver Blume will be installed as head of the VW brand

Volkswagen Chief Executive Herbert Diess is planning to promote Porsche CEO Oliver Blume to take over as the head of the VW brand, according to a report from Auto Motor und Sport. Citing company sources, the German site said Bernhard Maier, who currently sits at the head of VW's Skoda brand, will lead Porsche in Blume's place. A shuffle at VW isn't surprising. The last thing Volkswagen needs as it transitions away from its long-running "clean diesel" TDI fiasco and into a clean electric ID future is negative press surrounding its burgeoning electrified lineup. Unfortunately, the ID.3 launch has been marred by software issues, with Manager magazine citing company engineers saying "the basic architecture was developed too hastily." Because of that underlying issue, various modules "often do not understand each other" and suffer dropouts. The brand-new eighth-generation Golf launch was also troubled and pushed back due to software problems. And more recently, Volkswagen was forced to pull an advertisement after admitting it was racist and insulting. That marketing misstep, according to the report, will lead to the firing of Chief Marketing Officer Jochen Sengpiehl. Related Video:

Coronavirus prompts VW to stop production throughout Europe

FRANKFURT — Volkswagen Group, the world's biggest carmaker, is suspending production at factories across Europe as the coronavirus pandemic hits sales and disrupts supply chains, the company said on Tuesday. The German carmaker, which owns the Audi, Bentley, Bugatti, Ducati, Lamborghini, Porsche, Seat and Skoda brands, also said that uncertainty about the fallout from coronavirus meant it was impossible to give forecasts for its performance this year. "Given the present significant deterioration in the sales situation and the heightened uncertainty regarding parts supplies to our plants, production is to be suspended in the near future at factories operated by group brands," Chief Executive Herbert Diess said on Tuesday. Volkswagen's powerful works council concluded it was not possible for workers to maintain a safe distance from each other to prevent contagion and recommended a suspension of production at its factories from Friday. Production will be halted at VW's Spanish plants, in Setubal in Portugal, Bratislava in Slovakia and at the Lamborghini and Ducati plants in Italy before the end of this week, Diess said. Most of its other German and European factories will prepare to suspend production, probably for two to three weeks, while Audi said separately it would halt output at its plants in Belgium, Germany, Hungary and Mexico. Volkswagen's vast factories in Chattanooga, Tennessee, in Puebla, Mexico, and plants in Brazil were not affected, but that would depend on how the coronavirus spreads, VW said. Volkswagen has 124 production sites worldwide of which 72 are in Europe, with 28 in Germany alone. "2020 will be a very difficult year. The coronavirus pandemic presents us with unknown operational and financial challenges. At the same time, there are concerns about sustained economic impacts," Diess said.   Production in China resumes Volkswagen Group sold 10.96 million vehicles last year, putting it ahead of Toyota based on the latest figures from the Japanese carmaker. Globally, VW employs 671,000 people and it delivered 4.86 million vehicles to European customers in 2019. Only last month the car and truck maker based in Wolfsburg, Germany, predicted that vehicle deliveries this year would match 2019 sales and forecast an operating return on sales in the range of 6.5% to 7.5%. "The spread of coronavirus is currently impacting the global economy. It is uncertain how severely or for how long this will also affect the Volkswagen Group.

2020 Virtual Geneva Motor Show Editors' Picks

There may not have been an actual Geneva Motor Show this year, but there were still loads of car reveals that happened the week that the show would have happened. So we still wanted to highlight what our favorites of the would-be show. Our list of cars seemed to match the theme of the reveals, too, highlighting over-the-top supercars and forward thinking electric vehicles. Scroll down to see our favorites. Fifth Place: Aston Martin V12 Speedster - 21 points Managing Editor, Greg Rasa: Astons are works of art, and this one's ready for the Louvre. The design nods to Aston history are nifty. It looks like a jet fighter, except those have canopies. Not sure what 186 mph would be like in this, but don't try it in summer when there are bugs. Contributing Editor, Joe Lorio: Admittedly, this one is a little silly. A $950,000 sports car with no roof? A 700-hp two-seater with no windshield? But the offerings at the Geneva auto show have always tilted toward absurdity, and Aston’s V12 Speedster is endearingly outrageous as a fighter plane for the street. Third Place (Tie): Volkswagen ID.4 - 26 points Senior Producer, Chris McGraw: I don't have much to say about this other than I am a huge fan of more EVs coming to the market, which is why two-thirds of my picks are electric, including the ID.4. Producer, Alex Malberg: Any new fully-electric crossover is a vote for me. The fact it doesn't look terrible and VW will be including AWD later are bonuses.  Third Place (Tie): Alfa Romeo Giulia Quadrifoglio GTA - 26 points Road Test Editor, Zac Palmer: Hard to argue with the logic of this one. The Giulia Quadrifoglio is already the best driver in this class of hot sedans, so why not extend the lead with a special model. That wing is Type R levels of high, and I completely approve. Associate Editor, Byron Hurd: Love this car. Love it, love it, love it. It's beautiful, aggressive and fast. I'd take it over an M3 or C63 any day. As cool as the GTAm is, though, I'd rather stick to the four-seat GTA. Something about a four-door car with two seats just doesn't really work for me. I haven't alienated ALL of my friends quite yet. Second Place: Hyundai Prophecy - 35 points Senior Editor, Green, John Snyder: I get whiffs of the Genesis Coupe from this sleek concept. I like the focus on form, with interesting details to discover if you look for them. West Coast Editor, James Riswick: Does it look like a Porsche? Sure, but Porsches look neat.

What could better demonstrate our diametric vehicular future than sound clips of the Volkswagen ID 3 and the Koenigsegg Jesko? Battery-electric vehicles don't make enough noise on their own, so VW partnered with composer Leslie Mandoki for the legally-mandated Acoustic Vehicle Alerting System (AVAS) that warns pedestrians and cyclists of the EV's presence. Mandoki — a German-Hungarian who once played drums in a Euro disco band called Dschinghis Khan — was asked to come up with a sound for the ID 3 that VW said "defines its identity," "radiates safety and the promise of effortless mobility," and that "must also impress with its unique character." The definition of the ID 3's single-motor, 201-horsepower character is this: Occupants and people around the hatch can hear the sound as the car accelerates to 18.6 mph, and when reversing. At higher speeds, the sound of wind resistance and tire noise takes over. As our library of AVAS tones grows, it's clear that EVs will provide a soundscape as varied as that of internal combustion engines. Here, for instance, is the industrial thrum used as the Karma Revero GT's pedestrian warning: And here is the sci-fi soaring from the BMW Vision M Next, as composed by Hans Zimmer: At the other end of the aural chamber, we have the Koenigsegg Jesko. In this case, the composer is a 5.0-liter twin-turbo V8 running on a bio-ethanol E85 blend that's almost suitable for IndyCar, powering the engine up to 1,600 horsepower.
