$1.4B hedge fund suit against Porsche dismissed

Investors have canvassed courts in Europe and the US to repeatedly sue Porsche over its failed attempt to take over Volkswagen in 2008 (see here, and here and here), and they have repeatedly failed to win any cases. You can add another big loss to the tally, with Bloomberg reporting that the Stuttgart Regional Court has dismissed a 1.4-billion euro ($1.95B US) lawsuit, the decision explained by the court's assertion that the investors would have lost on their short bets even if Porsche hadn't misled them.
Examining the hedge funds' motives for stock purchases and the bets that VW share prices would fall, judge Carola Wittig said that the funds didn't base their decisions on the key bits of "misinformation," and instead were participating simply in "highly speculative and naked short selling," only to get caught out.
With other cases still pending, the continued streak of victories bodes well for Porsche's courtroom fortunes, since judges will expect new information to consider overturning precedent. If there is any new info, it could come from the potential criminal cases still outstanding against former CEO Wendelin Wiedeking and CFO Holger Härter, who were both indicted on charges of market manipulation.

Volkswagen has presented a list of near-term technologies to improve fuel economy and decrease emissions. The list includes an addition to a coasting function in its stop-start system, a 10-speed DSG transmission and a more power-dense four-cylinder TDI engine. Volkswagen aims to be the world's most sustainable automaker by 2018 through electric mobility, improved design and increased environmental performance from internal combustion vehicles. Commence Pence is a system that allows subway riders in London to donate their unused transit money to charity. People visiting the city often load up enough on their subway card (called Oyster Card) to get them through their trip and end up with unused funds leftover. Zander Whitehurst, a British designer, has created a device that can use the card's RFID to accept leftover funds, which then get diverted to charity rather than reverting back to the agency in charge of running the subway fare system. The statement comes as a bit of a surprise, as it dissents from the majority of auto dealers who support a franchise model, as well as laws that forbid automakers selling directly to the consumer. "If Elon Musk wants to make a mistake and go with an inefficient distribution system, that's his right as an American," says Jackson, showing he feels he has little to fear from the electric automaker. VW recalls 1.1M Jetta, Beetle models in US, China over suspension fears

Volkswagen is recalling about 1.1 million vehicles in China and North America in a newly announced campaign affecting the rear suspensions on some models. For the US, the action covers about 442,265 vehicles, including 400,602 examples of its 2011-2013 Jetta and 41,663 units of the 2012-2013 Beetle and Beetle Convertible. According to Reuters, the recall affects a further 126,000 vehicles in Canada and about 581,090 in China, including related market-specific models like the Sagitar.
The problem can occur if the affected models have a collision to the rear or the side-rear of the vehicle. It's then possible for the trailing arms on the torsion-beam rear suspension to be damaged. If the harm isn't noticed, then the part could fracture while driving. Obviously, a broken rear suspension is going to have an adverse effect on handling.
To fix things, VW dealers will inspect the trailing arms on the models, and they will all receive a sheetmetal part that will make a distinctive sound if broken in the future. If already damaged, the entire torsion beam will be replaced. Obviously, this work will be done at no charge to owners.
