US prepares to sue Fiat Chrysler over diesel emissions testing

NEW YORK - The Justice Department plans to file a civil lawsuit against Fiat Chrysler Automobiles NV over excess diesel emissions as early as this week if no agreement is reached with the Italian-American automaker, two sources briefed on the matter said on Wednesday. The Environmental Protection Agency in January accused FCA of illegally using undisclosed software to allow excess diesel emissions in about 104,000 cars and SUVs, the result of a probe that stemmed from regulators' investigation of rival Volkswagen AG. The EPA and California Air Resources Board have been in talks with FCA about the excess emissions and whether the agencies would approve the sale of 2017 FCA diesel models. A federal judge in California has set a May 24 hearing on a series of lawsuits filed by owners of vehicles against Fiat Chrysler and the Justice Department is expected to file its action by then if no agreement is reached. FCA said on Wednesday it believed that any litigation would be "counterproductive" to ongoing discussions with the EPA and California Air Resources Board. The company added that "in the case of any litigation, FCA US will defend itself vigorously, particularly against any claims that the company deliberately installed defeat devices to cheat U.S. emissions tests." The Justice Department took the same procedural step in early 2016 against Volkswagen, nearly four months after the German company admitted using software to emit excess diesel emissions in nearly 500,000 vehicles. The Justice Department has had an ongoing criminal investigation into FCA's conduct since last year, Reuters reported in January. The probe has turned up internal emails written in Italian and other documents about engine development and emissions issues, sources briefed on the probe said. U.S. regulators said FCA failed to disclose engine management software in 104,000 U.S. 2014-2016 Jeep Grand Cherokees and Dodge Ram 1500 trucks with 3.0-liter diesel engines. The European Commission has launched legal action against Italy for failing to respond to allegations of emission-test cheating by Fiat Chrysler in a procedure that could lead to the country being taken to court. The EPA has said the maximum possible fine against FCA could be $4.6 billion. In February, FCA said it had received requests for information and subpoenas from U.S. federal and state authorities, including the Securities and Exchange Commission, for diesel issues.

The automaker hired a law firm that defended BP after the Deepwater Horizon oil spill. The EPA is already extending its testing procedures to look for "defeat devices" like the ones used by Volkswagen. On Friday the company announced a major restructuring. Matthias Muller, Porsche's chief for the last five years, took over as CEO of Volkswagen and is charged with picking up the pieces of a shattered company facing regulatory action and lawsuits. With GM, Toyota, and Takata scandals still fresh, Volkswagen will likely experience unprecedented levels of scrutiny. Additionally, VW's markets in the United States, Canada, and Mexico will be combined into a North American region under the leadership of former Skoda boss Winfried Vahland, though US chief executive Michael Horn will stay on. The company is also realigning its brands by specialty and streamlining its board. Firings, government action, restructurings, and international outrage – things that usually build up over months or years – all occurred in about a week. With dizzying speed, Volkswagen's future has changed dramatically. It all happened, it's still happening, so fast. VW previews huge screens, gesture control with Golf R Touch Concept at CES

Volkswagen is showing off the future of infotainment and connected driving at CES 2015 with a fleet of concepts that highlight its latest technology. According to its displays, the coming years might mean gesture-based vehicle controls and electric cars that drive themselves to find their own charging locations. VW's biggest debut at CES is its next-gen infotainment system, dubbed MIB II. The setup supports a wide array of smartphone integration standards, including MirrorLink, Apple CarPlay and Google Android Auto, to make sure that practically every smartphone user can pair the device's interface with the vehicle. Beyond just keeping occupants entertained, MIB II offers a system called Regular Routes that detects traffic along the driver's regular commute to work and suggests alternatives. The Parking Guide also helps find parking spots that are likely open. If MIB II represents the near future of VW infotainment, then the technology on the Golf R Touch Concept is the next step from there. It takes the brand's hot hatch and adds support for gesture controls inside, plus a trio of massive infotainment screens. This R features a 12.8-inch central infotainment screen, an 8-inch screen below it for things like the climate control and switching media and a customizable 12.3-inch display that digitizes the instrument panel. A camera in front of the central display waits for the driver's hands to make specific movements that activate various vehicle functions. Despite all of the potentially distracting screens, VW says the system offers control without requiring a look away from the road. VW hopes the technology reduces driver distraction and creates a closer relationship with the car. Another of the German automaker's big tech showcases is an e-Golf that demonstrates the potential future of both electric and semi-autonomous driving. This version can be charged inductively, rather than through a traditional power cord, and the exterior lights show when the vehicle is fully recharged. It's also equipped with the e-Station Guide that helps drivers find a charging location and tells them about the payment options there. This e-Golf's other major innovation is VW's Trained Parking system. A camera at the front scans the route to a parking space, and if the driver returns later, then the process can be done semi-automatically.
