The vehicle offered for sale in this auction was seized pursuant to California Health and Safety code 11471 whose purpose is to remove property and profits from California’s illicit drug trade and to put those resources to work in support of law enforcement & prosecutorial efforts statewide.  This vehicle was administratively or judicially forfeited and is now offered for sale by the Butte County District Attorney’s office in this public auction.

 

VEHICLE SOLD “AS IS”- “WHERE IS”

 

The Butte County District Attorney’s office is not a merchant of, has no experience with and possesses no special knowledge with respect to the vehicle offered in this auction.   This vehicle is offered for sale “AS IS”, “WHERE IS” with no warranties express or implied as to its history and/or condition.  There will be no adjustments, repairs, refunds or exchanges.  By bidding, buyer expressly agrees to indemnify and hold harmless the Butte County District Attorney’s office, its agents and employees, and all law enforcement agencies and personnel involved in the seizure, forfeiture and sale of this vehicle from any and all damages, injuries, and/or causes of action which may involve items purchased here subsequent to the date of this sale.

 

EXEMPTION TO SMOG REQUIREMENTS:

 

All smog related repairs and certifications are the sole responsibility of the buyer (See: California Vehicle Code Division 12, Section 24007.5).  Depending on the condition of the vehicle, buyer may incur considerable additional expense to make the vehicle emissions compliant.  On the other hand, some vehicles come with a current California Smog Certificate.

 

LIMITATIONS ON SALE:

 

The winning bidder in this auction, if any, receives a certified document showing legal title is vested in the seller, a bill of sale, a DMV document memorializing the sale, and a DMV power of attorney allowing purchaser to sign any DMV documents for the seller, in order to transfer title to the described vehicle and register the same.  It will be buyer’s responsibility to transfer title at the DMV and to pay any fees for transfer and registration of the vehicle. While the Butte County District Attorney’s office makes every effort to ensure that all vehicles auctioned have been thoroughly searched, the office expressly retains title to and the right to repossess any items that may be subsequently found hidden or concealed in the vehicle.  Further, as a condition of sale, Buyer expressly promises and covenants to immediately contact the Butte County District Attorney’s office should any concealed items, weapons or evidence of a crime be located within the vehicle.

 

RESTRICTIONS ON BIDDING:

 

No employee of the Butte County District Attorney’s office, any agency associated with the seizure or forfeiture of this vehicle, or any family member of a person associated therewith may bid or purchase in this auction. 

 

PAYMENT AND REMOVAL:

 

As a condition of sale, buyer agrees to make full payment of the purchase price of the vehicle via cash-in-person or certified check and take possession of the vehicle within seven (7) days of the conclusion of the auction.  Any sale not completed within seven (7) days of the conclusion of bidding may, at the sole option of the Butte County District Attorney’s Office, be considered void and the subject vehicle immediately relisted for sale.

 

All items must be removed from the auction facility at the purchasers sole cost and risk.  At no time will auction staff or equipment be used to assist in loading, starting or moving items from the auction site.  Purchaser will accept any and all liabilities for damages to persons or property while removing items purchased.  Vehicles/items not picked up will be towed and stored at buyer’s expense.

 

PLACE OF INSPECTION AND DELIVERY

 

Unless otherwise noted, the place for payment and delivery of any vehicle to any successful bidder shall be the Butte County District Attorney’s Office, 25 County Center Drive Oroville, California  95965.  Requests for inspection of vehicles offered prior to bid will be handled on an individual case basis, by appointment only and only during regular working hours.

 

IDENTIFICATION AND INSURANCE

 

All winning bidders will be required to show valid identification prior to taking possession of any vehicle, and any driver wishing to drive the subject vehicle from the place of delivery will be required to provide evidence of liability insurance as provided in California Insurance Code section §11580.1b.

Total auto recalls already on record pace in 2014

If you've noticed that there have been more recalls than usual this year, you may be on to something. According to a report from the National Highway Traffic Safety Administration, the US market is on pace to break a record for recalls. In 2013, 22 million cars were recalled. We're only a third of the way through 2014, though, and we've already halved that figure, with 11 million units recalled. That's wild.
Considering the past few months, it shouldn't be a surprise that General Motors is leading the charge, with six million of the 11 million units recalled coming from one of the General's four brands. Between truck recalls, CUV recalls and the ignition switch recall, 2014 hasn't been a great year for GM.
Other recall leaders include Nissan (one million Sentra and Altima sedans), Honda (900,000 Odyssey minivans), Toyota (over one million units in a few recalls), Volkswagen (150,000 Passat sedans), Chrysler (644,000 Dodge Durango and Jeep Grand Cherokee SUVs) and most recently, Ford (434,000 units, the bulk of which were early Ford Escape CUVs). So while it's been a bad year for GM so far, its competitors aren't doing too well, either.

2014 Toyota Camry to get 'significant' attention?

With competition from Ford, Chevrolet, Honda, Hyundai, Kia, Mazda and Nissan mounting, Toyota is getting set to unveil a refreshed version of its Camry sedan a mere two years after it was fully redesigned.
According to a report from Bloomberg, Toyota's move to freshen the still young Camry comes as it seeks to retain its US sales crown in the midsize segment. That desperation has lead to increased incentives and fleet sales in a bid to keep its title, all while trying to keep pace with a slew of very competent competitors.
"It's safe to say we'll be doing something with it," Bill Fay, group vice president of the Toyota brand in the US, told Bloomberg during last week's LA Auto Show. "We'll be paying significant attention to Camry next year."

Legal approach in $1.2 billion Toyota settlement could impact handling of GM recall cases

In the past, if an automaker did something wrong, they were usually prosecuted by the US government through something called the TREAD Act. Short for Transportation Recall Enhancement, Accountability and Documentation Act, it basically requires automakers to report recalls in other countries, along with any and all serious injuries or deaths, to the National Highway Traffic Safety Administration.
Failing to report or attempting to conceal anything when there's been a death or serious injury constitutes a criminal liability. The idea is that this setup puts the onus on manufacturers to keep NHTSA apprised of safety related issues before they become a problem in the US, thereby allowing the regulator to better protect consumers.
In theory, it sounds like a relatively airtight set of rules for dealing with misbehaving automakers. That didn't stop the US Department of Justice from ignoring TREAD in its prosecution of Toyota's handling of the unintended acceleration recall, though. The result of this new approach, which charged Toyota with wire fraud, was a $1.2 billion settlement. Now, the wire-fraud approach could be used for the expected case between the US government and General Motors, based on the statements of Attorney General Eric Holder, who specifically mentioned "similarly situated companies" when discussing Toyota.
