Legal approach in $1.2 billion Toyota settlement could impact handling of GM recall cases

In the past, if an automaker did something wrong, they were usually prosecuted by the US government through something called the TREAD Act. Short for Transportation Recall Enhancement, Accountability and Documentation Act, it basically requires automakers to report recalls in other countries, along with any and all serious injuries or deaths, to the National Highway Traffic Safety Administration.
Failing to report or attempting to conceal anything when there's been a death or serious injury constitutes a criminal liability. The idea is that this setup puts the onus on manufacturers to keep NHTSA apprised of safety related issues before they become a problem in the US, thereby allowing the regulator to better protect consumers.
In theory, it sounds like a relatively airtight set of rules for dealing with misbehaving automakers. That didn't stop the US Department of Justice from ignoring TREAD in its prosecution of Toyota's handling of the unintended acceleration recall, though. The result of this new approach, which charged Toyota with wire fraud, was a $1.2 billion settlement. Now, the wire-fraud approach could be used for the expected case between the US government and General Motors, based on the statements of Attorney General Eric Holder, who specifically mentioned "similarly situated companies" when discussing Toyota.

Many gearheads will remember that the 1970s-era Dodge Dart's claim to fame was that its motor was so durable (though not necessarily powerful) that one could shoot bullets into the engine block. Decades later, Toyota has taken a page out of that testing process. "Personally, I don't care what Elon [Musk] says about fuel cells." With some industry members and analysts questioning both the viability and durability of hydrogen fuel-cell electric vehicles, Toyota executive Bob Carter, speaking at the Automotive News World Congress this week, says the Japanese automaker went all Clint Eastwood on the fuel tanks of a fuel-cell prototype. Carter says that bullets from a small-caliber gun bounced off the carbon-fiber tanks, and that .50-caliber bullets barely made dents. The shoot-out motif kept going when Carter name-checked executives from Tesla, Nissan and Volkswagen in saying that he didn't care if other automakers question the future of fuel-cell vehicles. As you can see in the prepared text of Carter's speech below, he said, "Personally, I don't care what Elon [Musk], Carlos [Ghosn] or Jonathan [Browning] say about fuel cells. If they want to 'plug in and tune out' other technologies, that's fine." After debuting it in Tokyo late last year, Toyota showed off its FCV fuel-cell concept vehicle at the Detroit Auto Show this week as it get ready to start sales "around 2015." The car has a 300-mile range and should be priced somewhere between $50,000 and $100,000. Here it is, folks - the highly anticipated Toyota FT-86 Open concept, a precursor to what could become a road-going Scion FR-S convertible. A full smattering of images and video have leaked onto the internet, and thanks to the folks at FT86Club.com, we can now see the new hotness that Toyota will be unveiling at the Geneva Motor Show next week.
These images confirm details that were first seen in spy shots captured a couple of weeks ago - namely, the larger wheel/tire package and the inclusion of the Toyobaru coupe's decidedly useless rear seats. These new photos, however, show a two-tone leather interior with goodies such as an iPod/iPhone mount on the dashboard. The concept car is also fitted with the coupe's six-speed automatic transmission (boo!) and FT86Club.com reports that the folding soft top is operated electronically.
