Toyota again claims Corolla outsold Focus worldwide

Toyota isn't convinced the Ford Focus was the best-selling nameplate globally last year. Bloomberg reports that for the second time in seven months, both Toyota and Ford are laying claim to the title. Ford cites R.L. Polk & Co. data that says the automaker moved some 1.02 million Focus models in 2012 compared to just 872,774 Toyota Corolla units. But Toyota says the actual figure is closer to 1.16 million Corolla models.
Last year, Ford said it took the sales crown through the fist half of 2012 based on information from IHS Automotive, but Toyota pointed out those numbers left out models like the Corolla-based Matrix and Auris, as well as the Corolla Fielder and Scion xB-based Corolla Rumion. Whether or not Toyota's belief that all these cars should be counted in the Corolla bucket is accurate or not is seemingly up for debate... as is the question of why it matters so much to both parties.
This time around, Ford is holding the line that the Focus is the "best-selling nameplate," with Erich Merkle, a US sales analyst with Ford saying the company's figure is, "a pure number that is verified by a third party." Toyota, meanwhile, has requested clarification from Polk.

If you remember the excitement that surrounded the Toyobaru/Subota rear-drive sports coupes' introduction, you'll recall that Scion's Subaru BRZ twin landed in here as the FR-S. That car, along with the new iA and iM, will get a stay of execution next year when the brand bids adieu. We know it will wear a Toyota badge in dealers from then on, and there's a good chance it will get the 86 badge European models wear. Toyota's version of the car goes by several different names depending on the market. It's only a Scion in North America, while it's sold as the Toyota 86 (in Asia, Australia, New Zealand, South America, and South Africa), Toyota GT86 (in Europe and New Zealand again), and Toyota FT86 (in Nicaragua and Jamaica). The 86 part of the name is a nod to the rear-drive AE86 Corollas of the 1980s. That's a history lesson Toyota likely won't have to teach its core demographic. Then again, this car's core demographic probably already bought one. There's also a possibility that this car will get yet another name combination: Toyota FR-S. Buyers who were ordering badge-swap kits from overseas will save some money. Some enthusiast forums might need to change their names. And people visiting from Japan or Europe will feel a little more at home when they see a rear-drive Toyota sports car on the street. Legal approach in $1.2 billion Toyota settlement could impact handling of GM recall cases

In the past, if an automaker did something wrong, they were usually prosecuted by the US government through something called the TREAD Act. Short for Transportation Recall Enhancement, Accountability and Documentation Act, it basically requires automakers to report recalls in other countries, along with any and all serious injuries or deaths, to the National Highway Traffic Safety Administration.
Failing to report or attempting to conceal anything when there's been a death or serious injury constitutes a criminal liability. The idea is that this setup puts the onus on manufacturers to keep NHTSA apprised of safety related issues before they become a problem in the US, thereby allowing the regulator to better protect consumers.
In theory, it sounds like a relatively airtight set of rules for dealing with misbehaving automakers. That didn't stop the US Department of Justice from ignoring TREAD in its prosecution of Toyota's handling of the unintended acceleration recall, though. The result of this new approach, which charged Toyota with wire fraud, was a $1.2 billion settlement. Now, the wire-fraud approach could be used for the expected case between the US government and General Motors, based on the statements of Attorney General Eric Holder, who specifically mentioned "similarly situated companies" when discussing Toyota.
