Legal approach in $1.2 billion Toyota settlement could impact handling of GM recall cases

In the past, if an automaker did something wrong, they were usually prosecuted by the US government through something called the TREAD Act. Short for Transportation Recall Enhancement, Accountability and Documentation Act, it basically requires automakers to report recalls in other countries, along with any and all serious injuries or deaths, to the National Highway Traffic Safety Administration.
Failing to report or attempting to conceal anything when there's been a death or serious injury constitutes a criminal liability. The idea is that this setup puts the onus on manufacturers to keep NHTSA apprised of safety related issues before they become a problem in the US, thereby allowing the regulator to better protect consumers.
In theory, it sounds like a relatively airtight set of rules for dealing with misbehaving automakers. That didn't stop the US Department of Justice from ignoring TREAD in its prosecution of Toyota's handling of the unintended acceleration recall, though. The result of this new approach, which charged Toyota with wire fraud, was a $1.2 billion settlement. Now, the wire-fraud approach could be used for the expected case between the US government and General Motors, based on the statements of Attorney General Eric Holder, who specifically mentioned "similarly situated companies" when discussing Toyota.

Scion iA and iM rolled into Yaris and Corolla lineups for 2017

The Scion brand may be going away, but most of its cars (sorry, tC) are living on. We'll see the 2017 Toyota 86 (nee Scion FR-S) at the New York Auto Show next week, and the automaker already confirmed that the Scion iA and iM will be rebadged as Toyotas. But instead of standing on their own, the former Scions will be rolled into existing model lines. "Yaris iA" and "Corolla iM" will be the official names of the cars, effective for 2017. It's a smart move, paring the relatively new Scion nameplates with well-known, existing Toyota monikers. Scion spokeswoman Nancy Hubbell tells Autoblog that the iA already exists as the Yaris in the Canadian and Mexican markets, so "that connection was already there." Plus, it's better for marketing. The combination of the two vehicles all under the Yaris nameplate means Toyota can focus its advertising dollars on one vehicle line, simply saying that you can now have the Yaris as a four-door sedan or a five-door hatchback. "The same goes with Corolla," Hubbell explains. She says the existing Toyota sedan and the Scion iM "paired really well," and again, it means Toyota can advertise the Corolla as having two body styles moving forward. There are benefits from a sales perspective, too. Never mind that Scion division sales were already included in Toyota's overall numbers – calling the new cars Yaris iA and Corolla iM means the company won't have to report these cars individual sales separately. It's like when Toyota made the Matrix – its technical name was Corolla Matrix, so its individual sales didn't have to be broken out. That means an extra boost in overall numbers for the Yaris and Corolla, even if the cars would have been reported under Toyota's numbers had they kept their Scion badges. Advertising firms have done an admirable job convincing consumers that the easiest way to find a best-in-segment car or truck is by looking at a few key metrics. In the most elementary terms, the vehicle with the highest horsepower, most gears in its transmission housing, lowest acceleration times and best fuel economy most certainly must be the class benchmark.
Yet as the commercials and billboards continue to drive that deceitful message, Toyota is betting shoppers in the subcompact segment are a bit more discerning. The Japanese automaker has just launched its updated 2015 Yaris, a three- and five-door offering that bucks the innovation and performance trends by offering what Toyota feels that entry-level buyers actually desire - reliability, practicality and a low sticker price.
It's sweltering in the tropical Hawaiian sun as I check out the deeply refreshed 2015 Yaris SE. This five-door hatchback, a range-topping version of the company's subcompact "sporty hatch" (Toyota's words, not mine), builds on the new-in-2012 generation by wearing new front and rear fascias, redesigned headlights and some attractive new wheels for the upcoming model year.
