Toyota unintended acceleration lawsuit settled for $16M

Slowly, the many loose threads still dangling after the unintended acceleration issue Toyota faced a few years ago are being resolved. The Orange County District Attorney's office was believed to be the first DA's office to take Toyota to court, its suit alleging that Toyota knew its cars had defects and continued to sell them. The suit sought to "permanently enjoin Toyota from continued unlawful, unfair, deceptive, and fraudulent business practices as it pertains to both consumers and competitors" and asked for $2,500 "for every violation of the Unfair Business Practices Act," plus costs.
That suit has now been settled, Toyota - without admitting fault or wrongdoing - agreeing to pay $16 million to the county. Half of the money will go to the Orange County Gang Reduction Intervention Partnership, another four million dollars to the OC DA's office to investigate economic crime, the remaining four million being used to pay for the case.

WASHINGTON (Reuters) - Four automakers agreed to a $553 million settlement to address class-action economic loss claims covering owners of nearly 16 million vehicles with potentially defective Takata airbag inflators, according to court documents filed on Thursday. Toyota's share of the settlement costs is $278.5 million, followed by BMW at $131 million, Mazda at $76 million and Subaru at $68 million. According to a press release from Plaintiffs' Committee for Takata Airbag Product Liability Litigation, the funds for the settlement are aimed at getting more cars with faulty airbags fixed. At the time of writing, Toyota had the greatest recall completion percentage of 31.89 percent followed by Subaru with 31.37 percent. Mazda has completed repairs on 18.16 percent of affected cars, and BMW brings up the rear with 16.48 percent completion. Some settlement funds will go to an outreach campaign to increase awareness, while other funds will be used to reimburse people for any costs accrued to get their cars fixed. These costs can include rental cars, child care, lost wages, or any other reasonable costs associated with bringing in a vehicle for repairs. Furthermore, a customer support program will be funded with settlement money to handle any additional repairs or adjustments that could become necessary in the 75,000 miles following the airbag replacement. Lawsuits against Honda, Ford and Nissan have not been settled, lawyers said. Takata inflators, which can explode with excessive force and unleash metal shrapnel inside cars and trucks, are blamed for at least 16 deaths and more than 180 injuries worldwide. The safety defect has prompted recalls worldwide of about 100 million inflators by more than a dozen major automakers. Toyota is world's top-selling automaker for second year in a row

Toyota is the top-selling automaker in the world. Again. Still. With total reported sales, including those from subsidiaries, of 9.98 million in 2013, Toyota's performance was enough to outpace rival General Motors by around 270,000 vehicles. That's a 2.4-percent gain over 2012, and it makes Toyota the top-seller two years in a row. Still, the gap between the top three is shrinking - Toyota held a 460,000-unit lead in 2012.
GM sold 9.71 million vehicles last year, a four-percent increase, coming in second place ahead of Volkswagen, which sold around 9.5 million. According to Bloomberg, Toyota CEO Akio Toyoda said his company managed to win the sales race while also remaining more profitable than GM or VW.
It's going to be another interesting year in 2014 as the three behemoth automakers vie for the title of World's Largest. Toyota has predicted that it will increase sales in 2014 to 10.32 million - which would make Toyota the first automaker ever to surpass 10 million global sales - though General Motors and VW are expected to again fight for the lead in the massive Chinese market.
