First Toyota unintended acceleration case headed for trial

Toyota is going to be back in the spotlight, as the first of its unintended acceleration lawsuits is headed for trial. This case covers a Los Angeles sushi shop owner, Noriko Uno. According to the what the family told The Detroit News, Uno only put about 10,000 miles on her 2006 Toyota Camry in four years. Uno was apparently afraid of high speeds, avoiding the freeway and taking a route home along LA's surface streets to avoid them.
On August 28, 2009, Uno's Camry suddenly accelerated to 100 miles per hour, eventually striking a telephone poll and a tree and killing her. The family contends that Uno attempted to step on the brakes and pull the emergency brake, neither of which brought her speed under control, while Toyota maintains that improperly installed floormats and driver error have been behind the majority of the 80 cases expected to be heard in court.
In Uno's case, The Detroit News is expecting the trial to focus on the lack of an override if the gas and brake pedals were pressed at the same time. Brake overrides were installed on Toyota's European fleet. The Uno family attorney will need to prove to the jury that it wasn't driver error that killed Noriko Uno.

Tokyo wants 6k fuel-cell cars from Toyota and Honda for 2020 Olympics

Japan aims to have greener cars on its roads in time for the 2020 Tokyo Olympics, and the city government there is putting some serious money on the table to make sure that the transformation happens in time. The push could jump start sales of hydrogen fuel cell vehicles (FCEVs) in the metropolis and would portray the Asian country as a leader in the cutting-edge tech. The city is setting aside 45.2 billion yen ($385 million) to offer subsidies for people buying FCEVs and to build 35 hydrogen refueling stations to keep them going, according to Bloomberg. The local government is in talks with Toyota and Honda to have 6,000 fuel cell vehicles on the road in time for the games. These generally expensive factors are often considered some of the biggest hurdles for the alternative fuel to take hold. Beyond the 2020 games, the Tokyo government has even more aggressive plans for the alternative fuel. The city's audacious goal is to have 100,000 FCEVs, 100 hydrogen-fueled buses and 80 refueling stations in the capital by 2025, according to Bloomberg. The city wants to offer FCEV buyers incentives as much as about 3 million yen ($25,325) with a third of that money coming from the Tokyo government and the rest from the national government, according to Bloomberg. Furthermore, subsides on building refueling stations could be as high as 80 percent in Tokyo, which puts costs more in line with building a traditional gas station. It appears that the demand is already building to make Tokyo's goal a reality. Toyota has received around 1,500 orders for the Mirai, according to Bloomberg. Although, the majority have come from the country's government or fleets. To meet the higher-than-expected demand, the automaker expanded its production facilities by adding two more assembly lines. The launch of Honda's latest FCEV was recently pushed back until March 2016, a year later than originally expected. Senator pushes for up to life sentence for auto execs found to delay recalls

Democratic Senator Claire McCaskill (shown above) has had it with automotive execs stalling when it comes to recalls. The Missiourian has proposed a new bill, the Motor Vehicle and Highway Safety Enhancement Act, which aims to improve the automotive safety following the high-profile fiascos involving General Motors and Toyota. Aside from a doubling of the budget for the National Highway Traffic Safety Administration over the next six years and the removal of the $35-million limit for fining automakers, the plan includes a provision that would punish auto executives if it's discovered they knowingly delayed recalls. How will it punish them, you ask? Oh, you know, just life in prison. The bill "gives federal prosecutors greater discretion to bring criminal prosecutions for auto safety violations and increases the possible penalties, including up to life in prison for violations that result in death," McCaskill's office told The Detroit News. If a delayed recall led to serious injuries, meanwhile, execs could still face a 15-year stint behind bars. As for that change in the fine structure for automakers, the removal of the limit is complemented by a hefty increase in the per-vehicle fine, from $5,000 to $25,000. With this change, GM could have been on the hook for $55 billion (with a "b") in fines for its bumbling of the ignition switch recall, rather than just $35 million. The News says, though, that NHTSA has "wide discretion" in handing out the fines. Considering a $55-billion fine is enough to sink any automaker, it is unlikely that such a monumental sum would be handed out. Still, the potential threat of such a death sentence should be enough for any automaker to sit up and take notice. "With millions of Americans behind the wheel every day, and more than 33,000 killed on our roads each year, we've got to do more to keep our cars and the roads we drive them on safe," McCaskill said, according to The News. "Painful recent examples at Toyota and GM have shown us we also must make it easier to hold accountable those who jeopardize consumers' safety. For too long, auto safety resources have remained virtually stagnant while cars and the safety challenges they present have become more complex." What do you think?
