Subaru suing CA dealership for alleged false customer surveys

Whenever you buy a new car from a dealer these days or sometimes even go in for service, you can expect to fill out a customer satisfaction survey at some point down the road. The responses are actually quite important to showrooms because automakers require the businesses to keep things at a certain level or face penalties. However, a Subaru dealer allegedly found a way to game that system, at least briefly, and now the Subaru of America has filed a lawsuit in US District Court for breach of contract. South Coast Subaru in Costa Mesa, CA, reportedly falsified 224 customer satisfaction questionnaires in 2014, according to Automotive News. The scheme wasn't that hard to figure out, though. All of the faked surveys were allegedly submitted through the IP address of an Acura showroom managed by the same dealer. Under normal circumstances when someone buys a Subaru, the dealer is supposed to collect the customer's email address and submit it to the automaker. However, South Coast allegedly presented false addresses, and then managers had employees fill the forms out during lunch. Subaru claimed in the suit that by doing this the dealer harmed the company's product reputation and its goodwill among customers. "Defendants prevented Subaru from discovering the actual customer satisfaction level of Subaru retail customers at South Coast Subaru by providing sham customer surveys to [Subaru]," the complaint said, according to Automotive News. Toyota, Mazda drop Takata as Mitsubishi, Subaru weigh options

It's not a very good time to be Takata right now. Fresh on the heels of longtime partner Honda ditching them, Toyota and Mazda have both come out and said they will not use the company's airbag inflators if they continue to rely on ammonium nitrate. Bloomberg reports that Subaru and Mitsubishi are also contemplating a divorce. "The inflator using ammonium nitrate produced by Takata will not be adopted by Toyota," President Akio Toyoda said during a briefing today. "What's most important above anything else is the safety and peace of mind of customers." Mazda echoed that position, simply saying it "will not use Takata airbag inflators which contain ammonium nitrate in our new cars." When you lose three huge OEM accounts in as many days, it's certainly going to have a deleterious effect on your fortunes. In Takata's case, that's meant a staggering 39-percent drop in their share price over the last three days. Yesterday alone, the company saw a 6.2-percent fall, Bloomberg reports. As the business publication reports, though, Takata isn't going down without a fight. The company is "considering some plans to survive," including a fundraising plan that will see it potentially offer up additional shares for sale. Still, at least one analyst doesn't see whatever company survives staying involved in the airbag inflator business. "I really don't see how they're going to be able to survive as an inflator manufacturer," Valient Market Research founder Scott Upham told Bloomberg. "When your major clients publicly come out and say that they're not going to use your products anymore, it makes this very difficult to sustain your business." Subaru WRX hatchback mule spotted

Despite on-again, off-again rumors, this latest set of spy shots seems to indicate that yes, a five-door Subaru WRX is indeed in the works. Subtlety is key with this test mule, but there are clear bits of evidence that indicate a hotter hatchback is what's being developed here.
First, notice the WRX-spec front fascia grafted onto this ordinary-looking Impreza hatch. From there, we can clearly see the tiny bit of added width - most obvious on the roof and at the rear, near the fuel door and taillamps. And of course, let's not forget about that bulge in the hood, consisting of a metal panel that covers the hood scoop and can apparently be removed thanks to a series of screws, according to our spies. The WRX's more robust exhaust and larger wheel/tire package have not been added to this mule, though we're told that this is commonplace for Subaru prototypes - those bits should be added on as the car's development progresses.
We fully expect a WRX hatchback to be, well, just that - mechanically, it should be identical to the sedan brethren, though our spies indicate that Subaru could be testing an updated version of the WRX-spec boxer engine. Of course, there's always a chance that this could be something else entirely, given the on-and-off reports of the five-door 'Rex's existence in the first place...
