1. JURISDICTION/VENUE: By placing your bid on this auction you agree and accept the following terms and conditions. These terms and conditions shall be construed, and the rights and obligations of the parties hereunder shall be determined in accordance with Florida law without regard to choice of law doctrines. You agree to submit to the jurisdiction of Florida courts for any action relating to or arising under these terms and conditions of your bid. Venue for any action arising under or relating to this transaction shall be in the court of appropriate jurisdiction for Sarasota County, Florida. If any proceeding is brought to enforce parties' rights under these terms and conditions, the losing party shall pay all costs and attorneys' fees of the prevailing party.

We are wholesalers and these vehicles are offered at WHOLESALE TO THE PUBLIC which frequently results in savings to you of thousands below the Kelley Blue Book or NADA retail appraisal. That is a deal in itself.

4. AUTHENTICATION: We will authenticate, qualify and verify ALL bids that are submitted on this vehicle. Only those bids submitted by ready, able and funded buyers will be accepted. VEHICLE WILL BE HELD UNTIL CHECK CLEARS OUR BANK.

5. DECISION TIME: The time to evaluate, to determine and to decide is during the course of the auction. The conclusion of the auction is the time to pay. Being the high bidder does not mean you have been awarded the opportunity to "think about it" or to "get back with us." It means that you have entered a binding agreement to purchase this vehicle immediately following the conclusion of the auction and that you have the funds to do so.

7. PREOWNED: Preowned vehicles are not the same as new vehicles. You are bidding on a pre-owned vehicle. Preowned vehicles are not perfect. Please do not expect perfection. Every effort has been made to deliver an accurate description, but it is possible to miss deficiencies.

7a. MILEAGE: It is virtually impossible for us to certify that the mileage is correct on the vehicle that we list because the vehicle has not been in our possession since new. The mileage stated in our listing is the mileage shown on the odometer at the time the photo was taken. Federal Odometer law requires us to mark the title EXEMPT if the vehicle is 10-years or older, unless otherwise noted.

8b. EMISSIONS: Florida does not require vehicles to pass emission tests. Some vehicles may have upgraded exhaust systems and/or altered emission systems. If your state requires emission testing please make sure the vehicle you are interested in will comply with your state's requirements. We sell all vehicles AS-IS with no implied warranty whatsoever.

8c. Remember some of these cars are nearly a decade old and they may be new to you, but that doesn't change the fact that they are used and repairs may be needed at any time regardless of how short a time period you have owned the vehicle. While we try to service any known defects it is still possible for used vehicles to need service or repairs the first days or weeks of ownership. NOT likely, but possible. Please note, we cannot and do not guarantee the operation of electronic items such as cruise control, radios, TV, VCR, CD, DVD players nor navigation.

8d. Since these vehicles are used, please remember that books, extra keys, remote entry keys, CD cartridges, etc..., do not always remain with vehicles throughout their life. We will not be responsible for these minor accessories. These items are all replaceable at any local factory dealer or right here on eBay for a few dollars.

9. SALES TAX: FL residents are responsible for applicable FL sales tax/title/tag/registration fees. Buyers outside of FL are responsible for FL sales tax if they accept FL delivery. Most states have sales tax reciprocal agreements with Florida. For your convenience when legally permitted we will provide a 30-day Florida temporary tag if desired. Florida State law permits automobile dealerships up to 30-days to transfer titles. Our title clerks wait a minimum of 10-business days from the date of receiving a check before sending out a title.

Out of state buyers are responsible for all state, county, city taxes and fees, as well as title service fees in the state that the vehicle will be registered. All taxes and fees must be paid in full in order for vehicle to be titled and registered. If the vehicle is shipped to you by carrier then we do not collect any sales tax. However, if the car is picked up and driven on Florida roads, as a licensed dealer, we are required by law to collect the sales tax percentage designated for your State (we do not collect for every State). The only States that do not have a reciprocal agreement with Florida (where you will be double taxed) are Arkansas and Mississippi.

10. BUY IT NOW: In the event that the automobile featured in this auction is purchased prior to this auction's scheduled ending date and time, we reserve the right to cancel your bid and end this auction early. This also applies to No Reserve auctions.

11. $199 DEPOSIT: A minimum nonrefundable deposit of $199 is due and payable on or before 24-hours after the end of the auction. 12. HOURS: Deliveries are to be scheduled from Monday through Friday from 10am to 6pm. No deliveries are permitted on Saturday unless special arrangements are made in advance with our trust department.

GM recalling 686k Lambda-platform models for hatch repair

General Motors is recalling 686,287 units of its Lambda platform crossovers. On models equipped with a power rear hatch the system can potentially fail. This campaign includes the 2008-2012 Buick Enclave, 2009-2012 Chevrolet Traverse, 2007-2012 GMC Acadia, and 2007-2010 Saturn Outlook. According to GM's documents to the National Highway Traffic Safety Administration (as a PDF), dirt can get into a portion of the strut that holds up the hatch and cause the part to prematurely fail. There's a redundancy in place called the Prop Rod Recovery system that's designed to shut the liftgate if there's a malfunction. However, if the breakdown happens too quickly after the hatch is opened the prop rod might not work the way it's supposed to. If someone were in the way of the falling liftgate, they could be hurt. For the repair, dealers will update the software for the power liftgate actuator motor control unit to prevent the hatch from closing so quickly. They'll also check the operation of the system afterward. Despite the tens of millions of recalled vehicles this year, it's somewhat rare that we get a glimpse into what goes into deciding when to conduct one of these safety campaigns. New documents published by General Motors and the National Highway Traffic Safety Administration are giving us an interesting opportunity to see how the sausage is made and show the number of meetings it takes to declare a recall.
In early August, GM added about another 269,000 vehicles to its 2014 recall tally in the US when it announced a slew of new safety campaigns. Among them was a fix for the 2002-2004 Saturn Vue that covered 202,155 of them in the US. The problem was that the key could be removed from the ignition even when it wasn't in the "OFF" position, and that had caused two crashes and one injury, according to the automaker.
Where we start to see behind the veil is in the defect notice freshly released by NHTSA. It shows that GM began investigating more widely for ignition switches in April, shortly after the company expanded its ignition switch recall to a variety of Saturn products, among others, according to Automotive News. The automaker found 152 reports in the 2002-2004 Vue of vehicles rolling away or the key being removed out of a total population of 215,243 units worldwide.

An automotive company must do everything in their power to notify its customers when a recall is issued on a vehicle. Consequence: If the driver's seat unexpectedly drops, the distraction and altered seat position may affect the drivers' control of the vehicle, increasing the risk of a crash. Problem: In the affected vehicles, vibrations from the drive shaft may cause the vehicle's roll over sensor to command the roof rail air bags to deploy. Consequence: If the roof rail air bags deploy unexpectedly, there is an increased risk of crash and injury to the occupants.
