Ram and Jeep diesel emissions allegations spur class action lawsuits

This shouldn't come as a surprise. Last week, the EPA issued a notice of violation to FCA after it determined that Jeep and Ram installed eight undisclosed auxiliary emissions control devices on diesel vehicles. Since then US law firm Heninger Garrison Davis, LLC and Canadian firm Sotos LLP have launched class action suits on behalf of owners. These latest lawsuits are unrelated to a previous class action suit brought against FCA and Cummins over NOx emissions in 2007 to 2012 Ram models. The violation notice – and the subsequent lawsuits – covers 2014 to 2016 Jeep Grand Cherokee and Ram 1500 models equipped with the 3.0-liter turbodiesel V6, a total of about 104,000 vehicles in the US. The EPA says that while the emissions control devices aren't necessarily illegal, installing them without disclosing them to the EPA is, as they produce more emissions in real world use than in testing. Skirting certification in this way might be a violation of the Clean Air Act. FCA could see fines of up to $45,000 per vehicle, depending on the outcome of the EPA investigation. FCA denies that these are cheat devices, and has proposed software updates to bring the vehicles into compliance. As for the lawsuits, Heninger Garrison Davis says that "Fiat Chrysler marketed those vehicles as environmentally friendly with enhanced fuel efficiency, better performance, and lower emissions. Although the diesel vehicles were successfully marketed as 'clean,' their environmentally-friendly representations were deceptive to consumers." The suit seeks an undisclosed amount of compensation for owners of these vehicles. In Canada, Sotos LLP is seeking $250 million in damages on behalf of owners. This suit, filed in the Ontario Superior Court of Justice, also claims deception on the part of FCA, "resulting in losses and damage" to owners. These are similar claims to group actions against Volkswagen with regard to its diesel emissions cheating scandal. While VW is fixing or buying back many of the affected vehicles, the company is defending itself against some suits on behalf of owners, saying it expects " no decline in the residual values of the affected vehicles as a result of this issue." Don't be surprised if FCA mounts a similar defense.

FCA recalls Ram dualie chassis cabs to recalibrate top speed

If you're one of the 1,771 owners of a 2014-15 Ram 4500 or 5500 chassis cab with a 6.4-liter Hemi V8 and a dualie rear axle, you may be hearing soon from Fiat Chrysler Automobiles to bring your truck in to your local dealer. The reason, you ask? To have the speed limiter recalibrated. The problem, according to the statement below, is that while some of these trucks are electronically limited to 106 miles per hour, their tires can't safely maintain that speed. As a result, FCA is having dealers recalibrate the limiter to 87 mph. Of course, that's still well above the speed limit in most places, and "FCA believes it is unlikely that these trucks are operated at such speeds," but that it "is acting out of an abundance of caution." In addition to the 1,771 units in the United States, the company is recalling another 169 in Canada. In an unrelated campaign, FCA is also recalling a handful or two of 2015 Dodge Challengers – 72 in the US, six in Canada and three in Mexico – to secure a side-curtain airbag bolt that may have been improperly installed during assembly over the course of a ten-day period. In both cases, FCA says it is unaware of any complaints, accidents or injuries related to these issues. The Company is unaware of any related injuries, accidents or customer complaints. Dealers will recalibrate vehicle speed accordingly. While FCA believes it is unlikely that these trucks are operated at such speeds, and that doing so would exceed posted speed limits in nearly every applicable jurisdiction, the Company is acting out of an abundance of caution. 2015 Ram ProMaster recalled for ignition switch issue

The Basics: Ram is recalling a total of 18,121 examples of the 2015 ProMaster with production dates between October 1, 2014, and June 17, 2015. These include 16,114 of them in the US, 1,498 in Canada, 503 in Mexico, and 6 outside the NAFTA region. The Problem: The ignition switch can intermittently lose electrical contact, and this can potentially cause the vans to stall. If the problem occurs, the vehicles might also lose functionality of the airbags, anti-lock brakes, electronic stability control, and instruments. Injuries/Deaths: None reported. The Fix: Dealers will replace the ignition-switch contact holder. If You Own One: FCA filed the recall with the National Highway Traffic Safety Administration on November 25, and it has 60 days to notify owners about the campaign under federal rules. Until the repair, the company says that turning the ignition off and then back on can fix this problem if the switch loses contact.
