GM isn't liable for punitive damages in ignition switch cases

NEW YORK — A federal appeals court said General Motors is not liable for punitive damages over accidents that occurred after its 2009 bankruptcy and involved vehicles it produced earlier, including vehicles with faulty ignition switches. The 2nd U.S. Circuit Court of Appeals in Manhattan said on Tuesday that the automaker did not agree to contractually assume liability for punitive damages as part of its federally-backed Chapter 11 reorganization. GM filed for bankruptcy in June 2009, and its best assets were transferred to a new Detroit-based company with the same name. The other assets and many liabilities stayed with "Old GM," which is also known as Motors Liquidation Co. Tuesday's 3-0 decision may help GM reduce its ultimate exposure in nationwide litigation over defective ignition switches in several Chevrolet, Pontiac and Saturn models. It is also a defeat for drivers involved in post-bankruptcy accidents, including those who collided with older GM vehicles driven by others, as well as their law firms. The ignition switch defect could cause engine stalls and keep airbags from deploying, and has been linked to 124 deaths. A lawyer for the drivers and their law firms did not immediately respond to requests for comment. GM had no comment. Circuit Judge Dennis Jacobs said GM's agreement to acquire assets "free and clear" of most liabilities excused it from punitive damages claims for Old GM's conduct. He also noted that the judge who oversaw the bankruptcy concluded that the new company could not be liable for claims that the "deeply insolvent" Old GM would never have paid. The decision upheld a May 2018 ruling by U.S. District Judge Jesse Furman in Manhattan, who oversees the ignition switch litigation. Drivers have sought a variety of damages in that litigation, including for declining resale values. GM has recalled more than 2.6 million vehicles since 2014 over ignition switch problems. It has also paid more than $2.6 billion in related penalties and settlements, including $900 million to settle a U.S. Department of Justice criminal case. Bill "Coyote" Johnson has been buying cars since high school and has amassed a collection totaling 113 vehicles, according to NBC 6 News. But time has changed his motivations and priorities, and he's decided to auction 93 of those cars, many of which are classic muscle from Ford, Chevrolet, Dodge, Plymouth and Pontiac. The megasale will take place Sept. 14, 2019, in Red Oak, Iowa, at the Montgomery County Fairgrounds. A 1969 Plymouth Road Runner infected Coyote with a love for Detroit muscle when he was just a teenager, and his desire quickly turned into an obsession. He's spent the past 40 years finding, buying and working on a variety of makes and models. Unlike some collectors, Coyote didn't discriminate against certain brands and has rides from each of the Big 3 automakers. Included in the auction are Camaros, Satellites, Super Bees, Chargers, Challengers, Barracudas, Coronets, GTOs, Mustangs, Cutlasses and others. Possibly the most intriguing aspect of the auction is that all of these cars will be sold as-is with no reserve. GM expands headlight recall to 180k Buicks and Pontiacs

General Motors is issuing an expanded headlight module recall to include 180,504 examples in North America of the 2005 Buick LaCrosse (2008 model year pictured above) and 2007 Pontiac Grand Prix. Specifically, the campaign affects 159,584 of them in the US and 20,920 in Canada. When the part fails, the vehicles' low beams can stop working either intermittently or permanently. "GM is unable to confirm any crashes, injuries or fatalities related to this condition," the company said in a statement, and there's currently no permanent repair for the problem. For now, dealers will replace the headlamp module with a new example of the same part. The automaker first announced this campaign in November 2014 when it affected 316,357 examples globally of the 2006-09 Buick LaCrosse; 2006-2007 Chevy TrailBlazer and TrailBlazer EXT; 2006-2007 GMC Envoy and 2006 GMC Envoy XL; 2006-2007 Buick Rainier; 2006-2008 Saab 9-7X; and 2006-08 Isuzu Ascender.
