GM isn't liable for punitive damages in ignition switch cases

NEW YORK — A federal appeals court said General Motors is not liable for punitive damages over accidents that occurred after its 2009 bankruptcy and involved vehicles it produced earlier, including vehicles with faulty ignition switches. The 2nd U.S. Circuit Court of Appeals in Manhattan said on Tuesday that the automaker did not agree to contractually assume liability for punitive damages as part of its federally-backed Chapter 11 reorganization. GM filed for bankruptcy in June 2009, and its best assets were transferred to a new Detroit-based company with the same name. The other assets and many liabilities stayed with "Old GM," which is also known as Motors Liquidation Co. Tuesday's 3-0 decision may help GM reduce its ultimate exposure in nationwide litigation over defective ignition switches in several Chevrolet, Pontiac and Saturn models. It is also a defeat for drivers involved in post-bankruptcy accidents, including those who collided with older GM vehicles driven by others, as well as their law firms. The ignition switch defect could cause engine stalls and keep airbags from deploying, and has been linked to 124 deaths. A lawyer for the drivers and their law firms did not immediately respond to requests for comment. GM had no comment. Circuit Judge Dennis Jacobs said GM's agreement to acquire assets "free and clear" of most liabilities excused it from punitive damages claims for Old GM's conduct. He also noted that the judge who oversaw the bankruptcy concluded that the new company could not be liable for claims that the "deeply insolvent" Old GM would never have paid. The decision upheld a May 2018 ruling by U.S. District Judge Jesse Furman in Manhattan, who oversees the ignition switch litigation. Drivers have sought a variety of damages in that litigation, including for declining resale values. GM has recalled more than 2.6 million vehicles since 2014 over ignition switch problems. It has also paid more than $2.6 billion in related penalties and settlements, including $900 million to settle a U.S. Department of Justice criminal case. Celebrate the summer solstice by building the Pontiac Solstice shooting brake GM never did

Happy summer solstice, everyone! To celebrate, we have a particularly unusual eBay find connected to the Pontiac Solstice sports car. A seller has leftover inventory of fiberglass hardtops designed to turn the Pontiac Solstice roadster into a shooting brake. The seller says they came from a since-closed Indiana company, and they're clearly inspired by another aftermarket part and even a GM concept that never saw the light of day. We'll start from the beginning: the stillborn Chevy Nomad concept. It was a concept that came out about the same time as the original Solstice concept, and it was clearly based on the same platform, featuring a small two-door body and a long nose. It also had unashamedly retro Nomad wagon design cues and cues from the original Corvette. The car never saw production, but clearly people were interested in having a wagon-like sports car. That brings us to the next bit of history with an aftermarket hardtop developed by German company EDAG. We saw a prototype in person, and the overall shape seemed to fit the car — and the wraparound window design certainly seemed Nomadic. Besides the unique look, the hardtop and its functional hatch made the Solstice roadster's miniscule cargo space far more usable. It doesn't appear many of the tops were sold, though. These tops on eBay look very similar to the EDAG tops, though it's not clear if they're a direct replica or something similar. Being that the parts are leftover inventory, the seller notes that some of the tops may be missing pieces for installation, so only those who are handy with bodywork and fasteners, or who are able to lean on someone who is, need apply. Even with some extra work, if you really want a Solstice shooting brake, this is likely easier and cheaper than commissioning a shop to custom-build a roof for your. Destiny: General Motors should bring back Pontiac

Despite having officially left the market in 2010, the Pontiac badge is still a common sight on roadways throughout the United States. Towards the end of its life, Pontiac models were largely rebadged versions of other General Motors vehicles, like the Pontiac G5 and Chevrolet Cobalt. It's sad, but there's no other way to put it; Pontiac was a mere shadow of its former self at the time of its death. Now it's time to revive the legendary brand. General Motors announced it would be reviving the Redline series, a package that originated with Saturn, another dead brand, earlier this year. Some models, like the Chevrolet Camaro will receive unique cosmetic touches designed to make it look even sportier, something Pontiac excelled at in most cases. Gas prices have fallen dramatically in the past few years and consumers have taken notice. Sales of fuel efficient cars, like hybrids and compact sedans, aren't increasing at the same rate as larger, less efficient vehicles, like trucks and SUVs. Muscle cars, like the Ford Mustang, are seeing increasing sales as well. Perhaps it's time to revive Pontiac and restore the marque to its former glory: a brand that brought performance and style at an affordable price. There are currently few manufacturers that offer a true challenge to high-performance automakers like BMW. The German brand continues to see high sales year after year and performance has a lot to do with it. Brand recognition, namely through the BMW badge, plays a major role as well. Pontiac, arguably one of the most well-known brands to ever grace the industry, can match both factors with ease. Pontiac was once revered as a brand that revolutionized the muscle car segment in the 1970s and 1980s. It still has a lively following throughout enthusiast spheres and amongst drivers of all ages to this day. Reviving the brand with a small line of high-performance vehicles would certainly offer a challenge to dominating German brands. A small lineup of affordable vehicles bearing the Pontiac badge and designed for performance and style would certainly make waves in the current market. Reviving a few older nameplates, such as the GTO and Trans Am, would offer nostalgic appeal. Packing both models with a powerful entry-level engine, say the Camaro's turbocharged four-cylinder or V6 engine, would open up the market considerably.
