GM isn't liable for punitive damages in ignition switch cases

NEW YORK — A federal appeals court said General Motors is not liable for punitive damages over accidents that occurred after its 2009 bankruptcy and involved vehicles it produced earlier, including vehicles with faulty ignition switches. The 2nd U.S. Circuit Court of Appeals in Manhattan said on Tuesday that the automaker did not agree to contractually assume liability for punitive damages as part of its federally-backed Chapter 11 reorganization. GM filed for bankruptcy in June 2009, and its best assets were transferred to a new Detroit-based company with the same name. The other assets and many liabilities stayed with "Old GM," which is also known as Motors Liquidation Co. Tuesday's 3-0 decision may help GM reduce its ultimate exposure in nationwide litigation over defective ignition switches in several Chevrolet, Pontiac and Saturn models. It is also a defeat for drivers involved in post-bankruptcy accidents, including those who collided with older GM vehicles driven by others, as well as their law firms. The ignition switch defect could cause engine stalls and keep airbags from deploying, and has been linked to 124 deaths. A lawyer for the drivers and their law firms did not immediately respond to requests for comment. GM had no comment. Circuit Judge Dennis Jacobs said GM's agreement to acquire assets "free and clear" of most liabilities excused it from punitive damages claims for Old GM's conduct. He also noted that the judge who oversaw the bankruptcy concluded that the new company could not be liable for claims that the "deeply insolvent" Old GM would never have paid. The decision upheld a May 2018 ruling by U.S. District Judge Jesse Furman in Manhattan, who oversees the ignition switch litigation. Drivers have sought a variety of damages in that litigation, including for declining resale values. GM has recalled more than 2.6 million vehicles since 2014 over ignition switch problems. It has also paid more than $2.6 billion in related penalties and settlements, including $900 million to settle a U.S. Department of Justice criminal case. Pontiac should come back as a performance division for GM

For decades the Pontiac brand was known as GM's performance brand. From the 1964 Pontiac GTO, to the 1967 Firebird, to the 1984 Fiero, to the 2006 Solstice Turbo, and 2009 G8 GXP, Pontiac had a reputation for building exciting cars, with bold styling and performance to back it up. When the Camaro was killed off in 2002, the Pontiac Firebird died off with it, and the last Pontiacs were built in early 2010. But with names like G3, G4, and G6, Pontiac's performance image had long faded from it's earlier glory days. My idea for Pontiac's revival would be to bring it back as a dedicated performance marque similar to Chevy's Super Sport (SS) line up of years past. First, and most obvious would be to bring back the Pontiac Firebird. Offering the entry-level model with the Camaro's 275HP turbo 4 cylinder engine, then having the Camaro SS's 455HP V8, but also offering a halo model Trans Am that is a revamped Camaro ZL-1 along with it's tire-shredding 650HP, supercharged V8 and race tuned suspension. Secondly, I would bring back the GTO. Which I would base on the current Chevy SS, but I would use the full 455-horsepower LS4 V8 (rather than the 415-hp setup that it has now). Furthermore, I would add the impressive 650-hp supercharged V8 to provide real competition to the Charger Hellcat. Importantly, I would make sure that the new GTO had bold, distinctive styling that really set it apart. I understand that purists would want any Pontiac GTO to be a two-door coupe, but I think that they could forgive that if the new GTO was an outstanding American performance car. Next, I would take the Buick Cascada convertible, add much bolder styling, swap in the Camaro's 275-hp turbo engine, and tune up the suspension to provide more performance than luxury (without being harsh). And finally I would round out the line up by using the new 2018 Traverse , but use the new, bold Pontiac design language to spice up the model's looks, tweak the engines for more power, and again provide a performance suspension that matches the model's new sporty looks. Obviously, having a high performance Pontiac model line up would steal away some sales from Chevy, Buick, and Cadillac models. But I think that it would more than make up for this by also stealing away sales from competing brands. Pontiac Aztek enjoys rebirth thanks to Millennials

Apparently, Millennials – those between 18 and 34 – aren't afraid to look different on the road, and they like performance, too. A new study by Edmunds is discovering some surprising vehicle choices by this group. Among them, the long-derided Pontiac Aztek is getting a new day in the sun with 25.5 percent its buyers coming from this generation in the first half of 2015. For comparison, Millennials represent an average of 16.8 percent of used car purchases. The Aztek is slowly shaking its reputation as a styling abomination, which seems tied to its appearance on Breaking Bad. The show premiered in 2008, and the Pontiac has been on this list for four of the past five years, according to Edmunds. It even led the pack in 2010. A recent Retro Review from MotorWeek also showed that the crossover wasn't always so hated. While it's still a shock to see the Aztek on any popularity list, the awkward-looking crossover only ranks sixth among Millennials. The vehicle with the biggest portion of buyers from the generation is the Dodge Magnum with 27.6 percent. According to Edmunds, the bluntly styled wagon is especially popular in Detroit and Chicago. The Chrysler Pacifica comes in a close second at 27.3 percent. When it comes to used cars, value and utility appear to trump just about anything else for many Millennial buyers," Edmunds analyst Jeremy Acevedo said in the report. Young buyers aren't afraid of sporty rides, either. The Subaru WRX has 26.4 percent Millennial buyers to rank third place on the list, and the Volkswagen R32 takes fifth at 25.7 percent. Just a few points lower in seventh place is the Nissan GT-R at 25.4 percent, and the final performance machine in 10th place is the Lexus IS-F with 24.7 percent. Related Video:
