Lawyer for Ghosn slams bail condition as human rights violation

TOKYO (AP) — The lawyer for Nissan's former chairman Carlos Ghosn on Saturday criticized a bail condition that prevents his client from seeing his wife, as Ghosn awaits trial on financial misconduct charges. A judge has forbidden Ghosn from seeing his wife, Carole, including in the presence of lawyers, or talking to her on the phone. Prosecutors say the restriction is needed to prevent evidence tampering. "This is unfair," Takashi Takano, the lawyer, said in a phone interview, calling it a human rights violation. "It's cruel and unusual." His earlier appeal of the ban, rejected by district and appeals courts, went to the Supreme Court, which turned it down last month. The Supreme Court decision cannot be appealed, but Takano vowed to keep filing new petitions, stressing that the Supreme Court has not yet ruled on the constitutionality or the human rights aspects. The next one will be filed within two or three weeks, he said. Ghosn's lawyers recently filed a second petition with the U.N. Working Group on Arbitrary Detention, arguing that the restrictions on seeing his wife amount to a deprivation of fundamental human rights. Takano acknowledged that the situation looks dismal, as Japan's Supreme Court is not easily influenced by other governments' views or by public opinion. "Even the strongest man in the world can be stressed, psychologically damaged. That's very natural as a human being," said Takano, noting that Ghosn was holding up well compared to other clients he has had. Ghosn has been aggressively taking part in meetings with his defense team, according to Takano. The case has entered the stage known as "pre-trial sessions," during which both sides hand in evidence. A trial date has not been set. In Japan, preparations for trials routinely take months. Ghosn, who led Japanese automaker Nissan Motor Co. for two decades, was arrested in November and charged with falsifying financial documents in reporting retirement compensation, and with breach of trust in diverting Nissan money toward personal investment losses and a company effectively run by him. Ghosn, 65, a Brazilian-born Frenchman of Lebanese ancestry, has repeatedly said he is innocent, accusing some at Nissan of plotting against him and opposing a plan to merge Nissan with French alliance partner Renault. Renault is set to vote Tuesday on a possible merger with Fiat Chrysler.

Feds Probe Nissan Cars For Unintended Acceleration

DETROIT (AP) - The U.S. government's road safety agency is investigating complaints that a trim panel can cause unwanted acceleration in Nissan Versa small cars. The probe covers about 360,000 Nissan Versa and Versa Note subcompacts from the 2012 through 2014 model years. The National Highway Traffic Safety Administration says in documents posted Saturday on its website that four drivers have complained that a trim panel near the gas pedal can trap the edge of a driver's shoe. This can stop the driver from releasing the gas pedal quickly and delay braking. There are no reports of crashes or injuries, although one driver complained of a close call at an intersection on June 9. As the driver accelerated to make a left turn, a plastic trim panel that covers the center console trapped the driver's shoe and stopped it from moving off the gas pedal, the complaint said. "I used my right hand to grab my leg and pulled harder, immediately braking hard, then backing my foot off the brake as I squealed and skidded around the corner, almost going over the curb and crashing," the driver wrote. The driver reported that the edge of the trim piece wasn't secured and trapped the sole of a leather work boot. Drivers who file complaints are not identified by NHTSA. Two of the four complaints were from drivers of rental cars, the agency said. A fifth complaint was filed in an unidentified foreign country, according to NHTSA. Investigations can lead to recalls but so far there are none in this case. Messages were left seeking comment Saturday from a Nissan spokesman. Mercedes considering Mexico for CLA production

Would you buy a Mercedes-Benz if it were made in Mexico? That's what the German outfit is wondering, as it considers localizing production of the its new budget model at a factory operated by Nissan, of which the automaker is a joint-venture partner.
According to a report from Automotive News, moving production of American-spec CLAs from Hungary to Mexico would protect Mercedes from currency fluctuations. "Mexico is the best location for the United States," Daimler Chairman Dieter Zetsche told AN. The CLA is also expected to become the brand's volume model in the US market, which makes North American production a logical move.
In the event that Mercedes approves the plan, Nissan would expand the capabilities at its Aguascalientes, Mexico plant, allowing production to begin in 2018.
