Carlos Ghosn was on verge of release — so prosecutors file new allegation

TOKYO — Japanese prosecutors added a new allegation of breach of trust against Nissan's former chairman Carlos Ghosn on Friday, dashing his hopes for posting bail quickly. Ghosn and another former Nissan executive, Greg Kelly, were arrested Nov. 19 and charged with underreporting Ghosn's income by about 5 billion yen ($44 million) in 2011-2015. They also face the prospect of more charges of underreporting Ghosn's income for other years by nearly 10 billion ($80 million) in total. The breach of trust allegations were filed a day after a court rejected prosecutors' request for a longer detention of both men. The new allegation only applies to Ghosn, and Kelly could still be bailed out. A request for bail by Kelly's lawyer is pending court approval, according to the Tokyo District Court, but his release will have to wait until next week since the request was still in process after office hours Friday. Prosecutors in a statement Friday alleged that Ghosn in 2008 transferred a private investment loss worth more than 1.8 billion yen ($16 million) to Nissan by manipulating an unspecified "swap" contract. Ghosn also profited by having the company transfer a total of $14.7 million to another company to benefit himself and that company's owner, who helped in the contract manipulation, prosecutors said. Shin Kukimoto, deputy chief prosecutor at the Tokyo District Prosecutors Office, refuse to say if the two transactions were related or how Ghosn illegally profited. He also declined to identify the collaborator or whether the transactions were made overseas. Ghosn and Kelly are only charged with underreporting Ghosn's pay over five years, in violation of the Financial Instruments and Exchange Act. They have not been formally charged with an additional allegation of underreporting another 4 billion yen ($36 million) for 2016-2018, for which their first 10-day detention was to expire Thursday. Prosecutors have been criticized for separating the allegations as a tactic to detain Ghosn and Kelly longer. They say Ghosn and Kelly are flight risks. The maximum penalty for violating the financial act is up to 10 years in prison, a 10 million yen ($89,000) fine, or both. Breach of trust also carries a similar maximum penalty. The conviction rate in Japan is more than 99 percent for any crime. Ghosn was sent by Renault in 1999 to turn around Nissan, then on the verge of bankruptcy, and he led its rise to become the world's second-largest automaker.

North Carolina now charging $100-per-year EV road-use fee

Tobacco Road just got a little more expensive for drivers of electric vehicles such as the Nissan Leaf and Tesla Model S. This year, North Carolina started instituting an annual $100 road-use fee for electric-vehicle drivers in order to close at least a little of the budgetary shortfall for road maintenance in the Tar Heel State, the News Observer reports. North Carolina legislators failed to green-light a hybrid-vehicle fee of $50 a year, which may have made a little more of a dent in the state's road funding. As it is, about 1,600 EVs are registered in North Carolina, meaning that the state will collect about $160,000 in such fees this year. And while some in the state are concerned that the fee could hurt EV adoption, others say it's fair because of the $7,500 in federal tax credits EV buyers get. Oh, and the fact that EV drivers don't pay gasoline taxes. Either way, the fees are a proverbial drop in the bucket, as North Carolina's transportation shortfall is estimated to average about $2 billion a year during the next three decades or so. Other states are starting to charge EV drivers a road-use fee as well. Last February, Washington State began instituting its own electric-vehicle fee of $100 per annum, and a number of other states are considering similar policies. Carlos Ghosn returns as president of ACEA

The European Automobile Manufacturers' Association (abbreviated ACEA in French) is an industry group representing all the biggest automakers in Europe, representing their common interests on the world stage. And as such it needs a leader, figurehead and mouthpiece to serve as its president, and for the second time the association's board of directors has chosen Carlos Ghosn.
Now if you're recognizing Ghosn as the CEO of Nissan and wondering what that has to do with European cars, it's not because Nissan manufactures much in Europe. In fact, it only operates has a handful of locations in Europe: one in the UK, one in Barcelona and one in St Petersburg. But you'd be wise to recall that Ghosn also serves as CEO of Renault, one of the biggest players in European automobile manufacturing. He also sits on the boards at Russian automaker AvtoVAZ (of which Renault owns 25 percent) and of his native Brazil's Banco Itaú, not to mention the advisory councils of a handful of universities - two of them from his ancestral hometown of Beirut. He previously served as president of ACEA in 2009, and was re-elected to replace outgoing PSA chairman Philippe Varin.
Alongside Renault, ACEA membership includes BMW, Daimler, Fiat, Jaguar Land Rover, PSA Peugeot Citroën, Volkswagen and Volvo, along with the European divisions of Ford, General Motors, Hyundai and Toyota, as well as a handful of truck manufacturers.
