Carlos Ghosn's detention extended over fresh allegations

TOKYO — A Japanese court on Friday approved the detention of former Nissan Chairman Carlos Ghosn through April 14 after his latest arrest over financial misconduct allegations, a move that has raised questions among legal experts. The former star executive was taken into custody Thursday over fresh allegations that $5 million sent by a Nissan Motor Co. subsidiary and meant for an Oman dealership was diverted to a company effectively controlled by Ghosn. Ghosn spent nearly four months in detention and was just released last month after meeting stringent bail conditions while he awaits trial over earlier allegations that he under-stated his compensation in financial documents, had Nissan shoulder his personal investment losses and made dubious payments to a Saudi businessman. The Tokyo District Court on Friday approved the initial 10-day detention request from prosecutors, who can seek another 10-day extension before needing to file charges against Ghosn, release him or accuse him of fresh misconduct that needs investigating. Stringing out a suspect's arrest for the full 20 days and then raising fresh accusations is common in Japan, where it is known as a "rearrest." Critics say it allows suspects to be grilled by the authorities, resulting in some signing confessions to crimes they never committed. But it is rare for a suspect to receive bail and then be taken back into custody. Ghosn, 65, was first arrested Nov. 19 and released March 6 on 1 billion yen ($8.9 million) bail, after two previous rearrests. He says he is innocent of all allegations. Prosecutors argue the latest allegations are different from the previous ones, but his legal team says they are part of the same scenario of alleged wrongdoing. In demanding the latest detention, prosecutors argued Ghosn may tamper with evidence related to the fresh allegations. Prosecutors had earlier fought against bail for Ghosn, a citizen of France, Brazil and Lebanon, arguing he was a flight risk. Ghosn's lawyer Junichiro Hironaka pointed out prosecutors have already raided Ghosn's property and taken everything, leaving little to tamper with.

Nissan CEO Saikawa admits he was overpaid, in policy violation

TOKYO — Nissan Motor Co was embroiled in another scandal over executive pay on Thursday after Chief Executive Hiroto Saikawa admitted to being overpaid in violation of internal procedures under a scheme designed by ousted Chairman Carlos Ghosn. An internal investigation found that Saikawa and other executives had received improper compensation, a source with knowledge of the matter told Reuters, raising doubts about Saikawa's pledge to improve governance in the wake of Ghosn's arrest last year for alleged financial misconduct. Saikawa apologized and vowed to return any improperly paid money as he admitted to Japanese reporters earlier on Thursday that he had wrongly received stock-related compensation under "a scheme of the Ghosn era." "I am deeply sorry for causing concern," Saikawa said, according to Jiji Press. In other comments reported by Kyodo news, Saikawa denied any direct role in the execution of a stock appreciation rights (SAR) scheme and said he thought "proper procedures" had been taken. The improper payments, including tens of millions of yen Saikawa received through the SAR scheme, were disclosed on Wednesday at a meeting of Nissan's audit committee, said the source who declined to be identified because the information is not public. Disciplinary action regarding the issue would be discussed at an upcoming board meeting, the source added. Nissan said in a statement that the findings from its probe including issues related to the share appreciation rights would be submitted to its board on Sept. 9. The company has been trying to strengthen governance, slash costs and boost flagging profitability amid persistent allegations of financial misconduct stemming from Ghosn's 20-year reign at Japan's second-biggest automaker. Ghosn is awaiting trial in Japan over charges including enriching himself at a cost of $5 million to Nissan. Kyodo reported that proceedings could start as early as March. He denies any wrongdoing and says he is the victim of a boardroom coup. Confidence in Saikawa had already been shaken by accusations he was too close to Ghosn, whose arrest in November rocked the global auto industry and exposed tensions in the automaking partnership between Nissan and Renault SA.

Yet again, I found myself in an unconventional way to get around on four wheels – but this time, I was on my own, and behind the wheel. Meet the Scoot Quad, aka Nissan New Mobility Concept, aka Renault Twizy. The many aliases reflect the path of descent from its development as a quirky French electric vehicle to its proliferation as a model for car sharing. The Quad resides in San Francisco as part of the Scoot fleet of shared electric vehicles and it's most certainly not for sale. As the line blurs between those who share cars for personal reasons and those who use them for business purposes, Scoot and Nissan came to an agreement in which a small number of New Mobility Concepts would join the Scoot fleet – which currently includes over 300 motorbikes. The added value of Scoot is the capacity for one-way rentals around the city, as well as a dedicated network of charging stations. "We think it's just the best way to get around the city for everyone," said Scoot fleet vice president Mike Waltman, explaining how 10 New Mobility Concepts made their way to San Francisco. Charging time is about four hours on a Level Two charger, made possible through Scoot's network of stations around the city. The one-plus-one Twizy has been in production since 2012 and on sale in certain overseas markets, but it's entirely new for the United States, and it wears the Nissan badge here – kind of. No major changes were made to the Twizy when it became the New Mobility Concept, and similarly none were made in its "transformation" to the Quad. It sports the same insectile shape and the rear profile of a top hat, as well as an identical powertrain: a 13-kilowatt motor that produces 17 horsepower, routed to the rear wheels through a single-speed automatic transmission. Charging time is about four hours on a Level Two charger, made possible through Scoot's network of stations around the city. Its top speed is 50 miles per hour, but Nissan installed a governor at 25 mph to conform to US low-speed vehicle requirements. New Scoot members are required to successfully pass an exam before beginning to use the service, so that was my first order of business. After spending about 35 minutes going through a series of informational videos on the Scoot app, as any new member would do, I was ready to ride Scoot motorcycles.
