Kayaba, Sumitomo to pay millions for price-fixing in US

Kayaba Industry Co, which does business in the US as suspension parts maker KYB, and Sumitomo Electric Industries are facing payments in the millions to settle price-fixing cases about the components that they make. As part of the Department of Justice's ongoing crackdown of price fixing in the auto industry, KYB agreed to pay $62 million and pleaded guilty to conspiracy to set the cost of shock absorbers from the mid '90s through 2012. The company allegedly worked with co-conspirators to keep the cost of the parts high, and those components then made it into vehicles from Honda, Kawasaki, Nissan, Subaru, Suzuki, and Toyota. "Any collusive agreement among competitors to restrict price competition undercuts our free enterprise system and violates the law," said Carter M. Stewart, US Attorney of the Southern District of Ohio, in the DoJ's announcement. Over the past few years, the DoJ has brought cases against 37 parts suppliers and 55 executives, leading to over $2.6 billion in fines. The investigations haven't always been so successful – some of the Japanese execs fled from the US to avoid prosecution. Critics allege that price fixing is simply how business is done. According to Automotive News, Sumitomo Electric Industries is also facing a $50 million settlement in a civil lawsuit that's related to price fixing of parts like wiring harnesses and heater control panels. The plaintiffs include owners and dealers that purchased vehicles with these parts. The company asserts that the violations are from before 2010, and it now has different process in place to avoid further violations. (manufacturer of Subaru vehicles), Honda Motor Co. Ltd., Kawasaki Heavy Industries Ltd., Nissan Motor Company Ltd., Suzuki Motor Corporation and Toyota Motor Company, including their subsidiaries in the United States.

FCA compromises with France, moving Renault merger bid forward

FRANKFURT/PARIS – Renault directors were preparing to review Fiat Chrysler's $35 billion merger offer on Tuesday, after the Italian-American carmaker resolved differences with the French government overnight, three sources said. The compromise on French government influence over a combined FCA-Renault may clear the way for Renault's board to approve a framework agreement beginning the long process of a full merger, unless new issues surface at the meeting. France, Renault's biggest shareholder with a 15% stake, had been pressing for its own guaranteed seat on the new board and an effective veto on CEO appointments. But after late-night talks with FCA Chairman John Elkann, the French government has accepted a compromise that would see it occupy one of four board seats allocated to Renault, balanced by four FCA appointees, the sources said. Renault would also cede one of its two seats on a four-member CEO nominations committee to the French state, they said. Renault, FCA and the French government all declined to comment on the discussions. The same evening that the compromise was was negotiated, activist hedge fund CIAM wrote to the board of Renault to say it "strongly opposed" a planned $35 billion merger with Fiat Chrysler. Calling the deal "opportunistic," the fund said the current deal terms strongly favored Fiat Chrysler and offered no control premium. Cars with the most reckless drivers are full of surprises

Insurify is a site for comparing auto insurance quotes. Because insurance shoppers need to submit information like the vehicles they're driving and the infractions they've compiled while driving those vehicles, Insurify has quite the database of correlations tying certain models to a habit of breaking certain laws. When the site's data analysts decided to compile a list of the top ten models for reckless driving citations in the decade from 2010 to 2019, the ranking contained a few wild entries. The Dodge Challenger making the countdown will surprise precisely zero people. But the Saturn L200? First, a definition: USLegal.com defines reckless driving as "driving with a willful or wanton disregard for safety. It is the operation of an automobile under such circumstances and in such a manner as to show a willful or reckless disregard of consequences." So this list is a caution about particular drivers more than the cars. For a baseline, according to Insurify data, for any random model, 15 out of 10,000 people who drive that model have picked up one citation for reckless driving. Back to that Challenger, then. No shocker for being here, but it's actually number 10, with 44 out of 10,000 Challenger drivers nabbed for a willful disregard of consequences on the road. That's better than the first surprise entry, the Saturn L200, a sedan only on sale for six years, with the least horsepower on the list, and out of production since 2005. The data set put drivers of GM's extraterrestrial sedan at 45 reckless pilots per 10,000 drivers. There are two pickups on the list, the only modern one being the Ram 1500 at eighth, with a rate of 46 in 10,000. Somehow, drivers of the third-best-selling pickup in the U.S. outrun the overwhelming numerical superiority of the best-selling vehicle in the States, the Ford F-150. The other pickup is the Chevrolet K1500 at number five, with a rate of 56 in 10,000. This is not only the oldest vehicle on the list, it went out of production in 2002, before any other vehicle on the list. Between the trucks, the Volkswagen CC slotted in at seven with 47 in 10,000 reckless driving chits, the Cadillac ATS slipped into sixth with 48 in 10,000.  The top four is a bag of unexpected. The Nissan 370Z is the first hardcore sports car on the list at number four, with 61 in 10,000 Z drivers flaunting their Fairladys in the face of Johnny Law.
