Carlos Ghosn was on verge of release — so prosecutors file new allegation

TOKYO — Japanese prosecutors added a new allegation of breach of trust against Nissan's former chairman Carlos Ghosn on Friday, dashing his hopes for posting bail quickly. Ghosn and another former Nissan executive, Greg Kelly, were arrested Nov. 19 and charged with underreporting Ghosn's income by about 5 billion yen ($44 million) in 2011-2015. They also face the prospect of more charges of underreporting Ghosn's income for other years by nearly 10 billion ($80 million) in total. The breach of trust allegations were filed a day after a court rejected prosecutors' request for a longer detention of both men. The new allegation only applies to Ghosn, and Kelly could still be bailed out. A request for bail by Kelly's lawyer is pending court approval, according to the Tokyo District Court, but his release will have to wait until next week since the request was still in process after office hours Friday. Prosecutors in a statement Friday alleged that Ghosn in 2008 transferred a private investment loss worth more than 1.8 billion yen ($16 million) to Nissan by manipulating an unspecified "swap" contract. Ghosn also profited by having the company transfer a total of $14.7 million to another company to benefit himself and that company's owner, who helped in the contract manipulation, prosecutors said. Shin Kukimoto, deputy chief prosecutor at the Tokyo District Prosecutors Office, refuse to say if the two transactions were related or how Ghosn illegally profited. He also declined to identify the collaborator or whether the transactions were made overseas. Ghosn and Kelly are only charged with underreporting Ghosn's pay over five years, in violation of the Financial Instruments and Exchange Act. They have not been formally charged with an additional allegation of underreporting another 4 billion yen ($36 million) for 2016-2018, for which their first 10-day detention was to expire Thursday. Prosecutors have been criticized for separating the allegations as a tactic to detain Ghosn and Kelly longer. They say Ghosn and Kelly are flight risks. The maximum penalty for violating the financial act is up to 10 years in prison, a 10 million yen ($89,000) fine, or both. Breach of trust also carries a similar maximum penalty. The conviction rate in Japan is more than 99 percent for any crime. Ghosn was sent by Renault in 1999 to turn around Nissan, then on the verge of bankruptcy, and he led its rise to become the world's second-largest automaker.

Nissan breaks annual EV sales record with two months to spare

Nissan has sold more pure EVs in the US this year than any other automaker, ever. And there are still two selling months left. Last year, Nissan sold a record 22,610 Leaf electric vehicles in the US. This year, through the end of September, Nissan sold 21,822 Leafs and has been selling more than 2,000 a month for the last seven months (in some cases, over 3,000). Basic math skills make it clear that 2014 would handily beat 2013, so now we get to play the guessing game to figure out by how much. Nissan isn't yet saying what October sales were (the month isn't over yet, and we're expecting the numbers on Monday) but if we look up the general trend for the last quarter of 2013, sales stayed steady (compared to the previous months) in October and November and then shot up in December. Given the overall increase in 2014 versus 2013 (up 36 percent through the end of September), who wants to bet that Nissan will sell more than 30,000 Leafs this year? Anyone? Compare Leaf sales with the other plug-in vehicle that went on sale alongside the Leaf at the end of 2010: the Chevy Volt sold over 23,000 units in 2012 and 2013 but is way down so far this year (14,540 through the end of September). An updated Volt will go on sale in the second half of 2015. Nissan has not disclosed when a new Leaf will go on sale. Nissan has sold over 142,000 first-gen Leafs around the world and over 64,000 in the US. Nissan recalls 226k vehicles over airbag inflators

Nissan and Infiniti are the latest automakers to issue recalls involving faulty airbag inflators from Takata. The Japanese automakers have announced campaigns covering about 226,326 units from seven models built in the early 2000s because they contain the bad part in the passenger-side, front airbag. The affected vehicles include the 2002-2004 Nissan Sentra, 2002-2003 Pathfinder and 2002-2003 Maxima, and it also covers the 2002-2003 Infiniti QX4, 2002-2003 I35, 2003 FX45 and 2003 FX35.
Like the other vehicles with the faulty inflators, it's possible for the part to rupture during airbag deployment and spray metal shrapnel at occupants. Nissan and Infiniti have even included vehicles with replacement airbags in this campaign because those parts also could have been defective. Both companies were also part of the earlier regional campaign to fix cars in high-humidity climates where the problem has been found to be the worst.
As is the usual response, Nissan and Infiniti will notify owners of the affected vehicles and will make the repair at no charge. According to the filing with the National Highway Traffic Safety Administration, these fixes will commence around August 11.
