Feds say Americans' bid to avoid extradition in Ghosn escape is 'flawed'

BOSTON — U.S. prosecutors on Tuesday said a former Green Beret and his son, wanted by Japan for helping former Nissan boss Carlos Ghosn flee the country, were advancing a "flawed" interpretation of Japanese law to fight their extradition. Michael Taylor and his son, Peter Taylor, were arrested in Massachusetts last month at Japan's request for allegedly smuggling Ghosn out of the country on Dec. 29, 2019, in a box while he was out on bail awaiting trial on financial charges. Ghosn fled to Lebanon, his childhood home, after being charged with engaging in financial wrongdoing, including by understating his compensation in Nissan's financial statements. He denies wrongdoing. Lawyers for the Taylors in a motion last week asked a federal judge in Boston to quash the provisional warrants issued in May for their arrests, arguing that "bail jumping" is not a crime in Japan. Defense lawyers argued that helping someone jump bail was also not a crime. While Japan issued arrest warrants for the Taylors in January, the lawyers said the crime stated in the warrants is an immigration offense and a non-extraditable misdemeanor. But U.S. prosecutors in a brief filed on Tuesday said it would be "unprecedented" for the extradition case at this junction to be tossed based on a "flawed interpretation of Japanese law and a mischaracterization of the facts." While Japan has not yet formally sought their extradition, the country has confirmed that Taylors' conduct constitutes a felony, U.S. prosecutors said. "The purported loophole through which the Taylors seek to evade justice simply does not exist," U.S. prosecutors wrote. Prosecutors added that neither Taylor, including Michael, a U.S. Army Special Forces veteran and private security specialist, should be released from jail as they are flight risks. Nissan tells Renault it is 'not opposed' to Fiat Chrysler merger plan

TOKYO – Nissan on Wednesday told Renault it wasn't opposed to its partner's potential $35 billion merger with Fiat Chrysler, the Nikkei newspaper said, as the two met to hash out the future of their alliance amid a deal that could upend the auto industry. The leaders of Nissan Motor Co, France's Renault SA and junior partner Mitsubishi Motors Corp gathered at Nissan's headquarters in Yokohama for a scheduled alliance meeting - one overshadowed by Fiat Chrysler's proposal this week for a merger-of-equals with Renault. The plan, which would create the world's third-largest automaker, raises difficult questions about how Nissan would fit into a radically changed alliance. Renault Chairman Jean-Dominique Senard arrived in Japan on Tuesday to discuss the proposed tie-up with Nissan, 43.4% owned by the French automaker. "We are not opposed," the Nikkei quoted an unnamed Nissan source who had attended the meeting as saying. The person also said "many details need to be worked out" before the Japanese automaker solidifies its position on the issue, the Nikkei reported. In a statement, the alliance members confirmed that they had "an open and transparent discussion" on the proposal. The deal looks designed to tackle the costs of far-reaching technological and regulatory changes, including the drive toward electric vehicles. Nissan, which has rebuffed overtures by Renault for a merger of their own despite their 20-year alliance, was blindsided by the discussions, sources have told Reuters, stoking concerns that a deal with Fiat Chrysler could weaken Nissan's relations with Renault. The tie-up also poses an additional challenge for Nissan CEO Hiroto Saikawa, already grappling with poor financial performance and an uneasy relationship with Renault after Nissan led the ousting last year of long-standing alliance chairman Carlos Ghosn. There have long been tensions between Nissan and Renault over the imbalance of power in their alliance. Nissan, the bigger company, holds a 15% non-voting stake in the French automaker, while Renault owns 43.4% of Nissan. Ahead of Wednesday's meeting, Japanese media quoted Saikawa as telling reporters that he would look at the potential opportunities afforded by a Renault-FCA merger. Credit ratings agency Moody's said it was vital for Nissan to stabilize its partnership with Renault to expand operational synergies and improve margins.

Nissan Xterra discontinued after 2015

Another great big subtraction in the choice of proper off-roaders comes with news from Edmunds that the Nissan Xterra will meet its maker after the 2015 model year. Sales of the body-on-frame SUV introduced in 1999 declined seven percent last year compared to 2013, a total of just 16,505 getting off dealer lots. That's about 1,800 more sales than the Toyota FJ Cruiser achieved for the year, another rugged trail runner recently dispatched into the ether. Meanwhile, the king-of-the-hill Jeep Wrangler almost matched those annual sales number each month in 2014; it moved 19,235 in May alone. Nissan hasn't exactly cared about the Xterra for years; Edmunds reported in 2013 that Nissan was "mulling the Xterra's future" and would take a year to decide if it was going to keep going. But it has been clear for years that the company wasn't too interested in its hardcore off-roader in spite of its "enthusiastic fan base inside and outside the company." The last visible refresh came in 2009, when it was 4Wheeler magazine's SUV of the Year, the next minor feature updates not arriving until 2014. And the Nissan-backed off-road triathlon series the Xterra was named for died in 2006. That's why there's no business case for throwing money at re-engineering the Xterra's safety and emissions specs, especially in a world gone crazy for subcompact crossovers. We contacted Nissan for comment on the report and asked if another Nissan vehicle, like the Rogue, would be positioned as a near-replacement, as has been speculated before. Product communications director Dan Bedore told us, "Nissan has made no announcement as to the future status of Xterra. For proprietary reasons, we do not discuss future product plans or comment on media speculation about future plans." Right now we can hear the Jeep Wrangler at the top of the mountain screaming, "Nobody wants a piece of this? Really?!" So come on, General Motors - it's up to you now.
