Carlos Ghosn's new lawyer, 'the Razor,' starts slashing

TOKYO — Carlos Ghosn's new lawyer took aim at Nissan, prosecutors and courts on Wednesday, dismissing the charges against the ousted chairman as an internal company matter and saying Japan was out of step with international norms by keeping his client in jail. "This should have been dealt with as an internal matter," Junichiro Hironaka, nicknamed the Razor, said at his first press briefing. Ghosn, who was arrested in November over alleged financial misconduct and remains in detention in a Tokyo jail, picked a new team last week with long-time defense attorney Hironaka as a key member to replace Motonari Otsuru, a lawyer who once ran the prosecutor's office investigating him. Hironaka's combative style contrasts with the low-key approach adopted by media-shy Otsuru. Ghosn's switch to an aggressive legal strategy came after his attempts to win bail failed and just before lawyers were due to sit down with prosecutors and judges for the first time to hash out a schedule for pre-trial discovery meetings, where prosecutors will reveal evidence and submit a list of witnesses. Hironaka said he didn't know why Ghosn picked him, but added that Ghosn probably wanted an experienced criminal lawyer as the case moved toward trial. The 73-year-old defense attorney is reputed for winning high profile cases, including the acquittal of a senior lawmaker, Ichiro Ozawa, on financial misconduct charges. He also helped free a senior bureaucrat Atsuko Muraki who was jailed for four months on corruption charges fabricated by prosecutors. Yet, even with greater legal firepower the former Nissan Motor Co boss faces a criminal justice system where only three out of every 100 defendants pleading not guilty are acquitted. Neither does Japan have a plea-deal mechanism that would allow Ghosn to agree to lesser charges for a lighter sentence. "The change in lawyers means a change in style, but the legal strategy will still be the same. I don't think it increases Ghosn's chance of an acquittal," said Masashi Akita, a defense lawyer at Shin-Yu Law Office in Osaka, ahead of Wednesday's comments by Hironaka. Ghosn has lost his perch atop an automotive alliance trio of French carmaker Renault SA and Japanese automakers Nissan and Mitsubishi Motors Corp. Attempts to win bail, including an offer to wear a GPS ankle bracelet and hire security guards to stop him trying to tamper with evidence, failed.

The question going into this year's 24 Hours of Le Mans was whether or not the Porsche 919 Hybrid would be able to combine its qualifying pace with race reliability. After battling neck-and-neck with Audi's R18 for most of the race, the answer is a resounding yes. Not only did Porsche drivers climb the first two spots on the podium, they did so without any major mishaps on track. This win is the first overall trophy for Porsche since 1998. Audi previously won the last five races, and 13 of the last 15. Corvette also returned to the winner's circle, with the No. 64 C7.R taking winning the GTE Pro division. The victory is the first class win for Corvette since 2011. KCMG won the LMP2 class in ninth overall. With 45 minutes to go the No. 98 Aston Martin crashed out of first place in GTE Amateur, giving the class win to SMP Racing's Ferrari and second place to the Patrick Dempsey Racing Porsche 911 RSR. But a three-minute replacement of the front and rear bodywork kept the Audi in contention. As the race wore into the night, Porsche maintained a slightly faster pace than Audi. Nick Tandy took the lead on Lap 253 early Sunday morning, and car No. 19 never gave up the top position. The win is the first for all three drivers of the No. 19 – Nico Hulkenberg, Earl Bamber, and Nick Tandy. A lap behind in second was the No. 17 Porsche. The Audis fought reliability problems late in the race but still finished third with the No. 7 R18. As the Aston Martin cars dropped away, the lone Corvette Racing entry took over, followed by a charging AF Corse team Ferrari 458 Italia. Dacia Duster to spawn inexpensive Nissan Terrano, will we get it?

When going to overseas auto shows, one can't help but spend an inordinate amount of time eyeballing forbidden automotive fruit. It's often of the seriously rare, criminally powerful and six- or seven-digit variety. But more often than one might think, the genuinely affordable overseas hero makes us swoon, too. So it is with the Dacia/Renault Duster, the cheap-as-chips, hard-wearing utility vehicle. We've often thought that its basic, rugged charms would play well in the US if saddled with a low enough price tag, but we've never seen much of a window for that to actually come true.
But now, Autocar India is reporting that Nissan will flex its alliance with Renault to spin off a Duster of its own, one that exhumes the Terrano nameplate, a moniker once used for overseas versions of the first- and second-generation Pathfinder. The new model will feature unique sheetmetal to give it a familial look, but the interior will be the same, and we expect the same goes for the powertrain, meaning there will be a range of gasoline and diesel four-cylinder engines with both manual and automatic gearboxes and front- or all-wheel drive.
So, does that mean we'll get a Nissan version of the Duster-based Terrano to call our own? Sadly, almost certainly not. Company spokesman Dan Bedore tells Autoblog flatly, "There are no plans to bring this model to the US." Bummer. Even if it isn't ultimately as capable as the larger, long-in-the-tooth Xterra (it's more on par with the now departed Canadian-market X-Trail), we think the Duster's archetypal SUV looks and low cost barrier would win it plenty of fans in our market. Our guess is that redesigning the model to meet US regulations (crash, emissions, lighting, etc.) would be prohibitively expensive, and the Dacia/Renault model is built in some pretty distant facilities - Brazil, India, Romania and Russia among them - making the business case harder still.
