NYC Taxi of Tomorrow ruled legal by appeals court

The streets of New York City might be filling up with a lot more Nissans in the next few years. A New York appeals court ruled that the city's mandate to replace old taxis with a fleet entirely made up of the Nissan NV200 Taxi of Tomorrow was legal. The decision overturned a previous ruling that decided The Big Apple couldn't force cabbies to all purchase the same vehicle.
Justice David B. Saxe wrote the court's opinion saying the Taxi of Tomorrow is a "legally appropriate response to the agency's statutory obligation to produce a 21st-century taxicab consistent with the broad interests and perspectives that the agency is charged with protecting," according to Bloomberg. The Greater New York Taxi Association, the plaintiff in the case, could still possibly attempt a second appeal.
Nissan originally won the 10-year contract estimated to be worth about $1 billion in 2011, beating out Ford and a Turkish company. Under the Taxi of Tomorrow plan, all New York cabbies would have to switch to the NV200 within three of five years of the van going into service, and it would replace the 16 vehicles previously authorized as taxis. In 2013, the mandate received multiple challenges though, including an attempted ban by cab drivers because the replacement wasn't a hybrid. In a separate case, state Supreme Court judge Schlomo Hagler decided that there was nothing in the city charter that forced a taxi driver to choose a specific vehicle. This was the case that was just overturned. In the meantime, the automaker has been selling the NV200 to New York cabbies at prices around $29,700.

Indianapolis will deploy 425 battery electric and plug-in hybrid vehicles as part of its municipal fleet by 2016. The fleet will include such cars as the Nissan Leaf, Chevrolet Volt and Ford Fusion Energi. The city will also reduce its overall fleet by 100 vehicles. EVs with longer range would make vehicle-to-home and vehicle-to-grid energy management systems more practical for the US. The idea of using EVs as energy storage for emergencies or times of high grid demand is currently being tested in Japan with Nissan's Leaf-to-Home system. The US is also interested in such capabilities, but the higher average energy use of American households would make larger batteries in EVs ideal for grid storage applications. The factory, when constructed, will have a capacity of producing batteries for 100,000 cars per year according to the Korean company. The plant will supply batteries for Chinese automakers such as SAIC and Qoros. Construction is expected to be finished by the end of 2015 and LG Chem expects revenue of more than $933 million by 2020. Read more in the press release below. Artificial bat caves could help alleviate white-nose fungus that leads to diminished bat populations. Leftover adhesive is used to create stalactites in the artificial caves, allowing them more structure to hang from. Nissan itself will be indicted alongside Ghosn, report says

Prosecutors in Tokyo are expected to file charges against Nissan itself alongside an expected indictment against former Chairman Carlos Ghosn as part of the ongoing financial misconduct case. That's according to a report from Japan's Nikkei business daily, which does not identify its sources. Charges are also likely against Greg Kelly, a member of Nissan's board of directors who was taken into custody with Ghosn Nov. 19 after Japanese authorities questioned the former chairman aboard a corporate jet at the Tokyo Haneda airport. Monday is the deadline when prosecutors must either indict the two executives, release them or arrest them on new allegations. Both men are accused of under-reporting salaries in five annual reports that stretch through the fiscal year that ended in March 2015. The Nikkei says they'll also be arrested on new allegations of misstating financial information for the subsequent three business years. Nissan would be charged for not preventing the alleged crime. Both men have reportedly denied the allegations. In response to the Nikkei report, a spokesman for Nissan told Automotive News the company had "identified serious misconduct related to the reporting of Mr. Ghosn's compensation" and was cooperating with investors. The turmoil over Ghosn prompted the automaker to scrap plans to unveil a long-awaited longer-range Leaf electric car at the L.A. Auto Show last week. Ghosn is accused of conspiring to understate his income by about half the 10 billion yen (about $88 million) over the period. Reports say the issue relates to deferred compensation that Nissan CEO Hiroto Saikawa reportedly signed off on but may not have understood. The company didn't report the deferred compensation in Japanese securities filings as it is required, since the money is considered a future liability against the company. Automotive News cites an unnamed source who says Nissan has identified some $80 million in unreported deferred compensation promised to Ghosn. Nissan's board voted Nov. 22 to oust him as chairman, and Mitsubishi followed suit days later. Ghosn remains the CEO and chairman of Renault, however. Under Ghosn's guidance, Nissan and Renault joined forces in 1999 when Nissan was teetering toward bankruptcy. Mitsubishi joined on in 2016, with all three members able to jointly develop products and control costs. He had reportedly been pushing for deeper ties, including a possible merger between Nissan and Renault at the urging of the French government.
