Feds say Americans' bid to avoid extradition in Ghosn escape is 'flawed'

BOSTON — U.S. prosecutors on Tuesday said a former Green Beret and his son, wanted by Japan for helping former Nissan boss Carlos Ghosn flee the country, were advancing a "flawed" interpretation of Japanese law to fight their extradition. Michael Taylor and his son, Peter Taylor, were arrested in Massachusetts last month at Japan's request for allegedly smuggling Ghosn out of the country on Dec. 29, 2019, in a box while he was out on bail awaiting trial on financial charges. Ghosn fled to Lebanon, his childhood home, after being charged with engaging in financial wrongdoing, including by understating his compensation in Nissan's financial statements. He denies wrongdoing. Lawyers for the Taylors in a motion last week asked a federal judge in Boston to quash the provisional warrants issued in May for their arrests, arguing that "bail jumping" is not a crime in Japan. Defense lawyers argued that helping someone jump bail was also not a crime. While Japan issued arrest warrants for the Taylors in January, the lawyers said the crime stated in the warrants is an immigration offense and a non-extraditable misdemeanor. But U.S. prosecutors in a brief filed on Tuesday said it would be "unprecedented" for the extradition case at this junction to be tossed based on a "flawed interpretation of Japanese law and a mischaracterization of the facts." While Japan has not yet formally sought their extradition, the country has confirmed that Taylors' conduct constitutes a felony, U.S. prosecutors said. "The purported loophole through which the Taylors seek to evade justice simply does not exist," U.S. prosecutors wrote. Prosecutors added that neither Taylor, including Michael, a U.S. Army Special Forces veteran and private security specialist, should be released from jail as they are flight risks. Nissan Altima getting major refresh for 2016?

Nissan hasn't let the latest Altima languish since introducing the midsize sedan. In the last two model years, the company has improved the vehicle's infotainment system and slightly bumped the V6's fuel economy, among other tweaks. But the upcoming mid-cycle refresh may bring the most drastic changes yet, according to the company's product planning exec. Nissan styling boss Shiro Nakamura previously suggested that the refreshed Altima might take some design inspiration from the latest Murano and the Sports Sedan Concept. The move would give the midsize sedan a sportier look and presage an even more aggressive shape for the next-gen model. Nissan North America product planning boss Pierre Loing confirmed to Automotive News that some styling changes are on the way for the Altima for the 2016 refresh, and the sedan is getting updated tech, too. He even hinted that the model's already impressive 38-miles-per-gallon highway fuel economy may see a bump, as well. "We're going to do something significant for the Altima for the midcycle," said Loing to Automotive News. Although, the updates might not go as far as the updated 2015 Toyota Camry's roughly 2,000 new parts, he suggested. The decision to put so much work into the updated Altima comes partially from its position in the midsize market. While the sedan segment is losing ground to crossovers, it's still a big part of the industry, and the Altima is gaining steam. The Nissan's sales were up 4.7 percent to 335,644 units in 2014, according to Automotive News, compared to 388,374 for the Honda Accord and 428,606 for the Toyota Camry. Bathurst 12-hour gallery is GT3 heaven [w/video]

The 2015 Liqui-Moly Bathurst 12-Hour race was run this weekend at the Mt. Panorama Circuit in Bathurst, Australia. Race photographer Joel Strickland sent us a huge batch of photos, all of which make us salivate for the switch to GT3 rules in the United SportsCar Championship; the top seven finishers at Bathurst were of seven different makes: Nissan GT-R NISMO GT3, Audi R8-LMS Ultra, Aston Martin Vantage GT3, Bentley Continental GT3, Mercedes SLS AMG GT3, Ferrari F458 Italia and Lamborghini Gallardo. It was a sweet victory for the No. 35 car driven by the NISMO Athlete Global Team after it crashed in Saturday qualifying, and then was only in third place on the penultimate lap. The three-man driving team included two GT Academy winners, one of whom, Florian Strauss, has only been a professional race car driver for 18 months. It's the first time the GT-R has won at Panorama since the original R32 "Godzilla" took back-to-back wins in 1991 and 1992. Second place went to the No. 15 Phoenix Racing Audi R8-LMS Ultra, 2.4 seconds behind the winners, third to the Craft Bamboo Racing Aston Martin Vantage not even half a second behind the Audi. The Bentley Motorsport team, in its first Bathurst 12-Hour with two cars, had its No. 10 Continental GT3 in the lead until the penultimate lap and in second place until the final corner, but crossed the line in fourth after some rubbin'-is-racin' action from chasers.
