Carlos Ghosn's new lawyer, 'the Razor,' starts slashing

TOKYO — Carlos Ghosn's new lawyer took aim at Nissan, prosecutors and courts on Wednesday, dismissing the charges against the ousted chairman as an internal company matter and saying Japan was out of step with international norms by keeping his client in jail. "This should have been dealt with as an internal matter," Junichiro Hironaka, nicknamed the Razor, said at his first press briefing. Ghosn, who was arrested in November over alleged financial misconduct and remains in detention in a Tokyo jail, picked a new team last week with long-time defense attorney Hironaka as a key member to replace Motonari Otsuru, a lawyer who once ran the prosecutor's office investigating him. Hironaka's combative style contrasts with the low-key approach adopted by media-shy Otsuru. Ghosn's switch to an aggressive legal strategy came after his attempts to win bail failed and just before lawyers were due to sit down with prosecutors and judges for the first time to hash out a schedule for pre-trial discovery meetings, where prosecutors will reveal evidence and submit a list of witnesses. Hironaka said he didn't know why Ghosn picked him, but added that Ghosn probably wanted an experienced criminal lawyer as the case moved toward trial. The 73-year-old defense attorney is reputed for winning high profile cases, including the acquittal of a senior lawmaker, Ichiro Ozawa, on financial misconduct charges. He also helped free a senior bureaucrat Atsuko Muraki who was jailed for four months on corruption charges fabricated by prosecutors. Yet, even with greater legal firepower the former Nissan Motor Co boss faces a criminal justice system where only three out of every 100 defendants pleading not guilty are acquitted. Neither does Japan have a plea-deal mechanism that would allow Ghosn to agree to lesser charges for a lighter sentence. "The change in lawyers means a change in style, but the legal strategy will still be the same. I don't think it increases Ghosn's chance of an acquittal," said Masashi Akita, a defense lawyer at Shin-Yu Law Office in Osaka, ahead of Wednesday's comments by Hironaka. Ghosn has lost his perch atop an automotive alliance trio of French carmaker Renault SA and Japanese automakers Nissan and Mitsubishi Motors Corp. Attempts to win bail, including an offer to wear a GPS ankle bracelet and hire security guards to stop him trying to tamper with evidence, failed.

Mitsubishi expects to sell only 4,000 Outlander PHEVs in first year in US

First, it was late 2013 or early 2014. Then it was the fall of 2014. And then it was "roughly" April 2016. Now we can strike "roughly" from the record: the Outlander Plug-In Hybrid will finally arrive in the US in April 2016. Alex Fedorak, public relations manager, Mitsubishi Motors North America, told AutoblogGreen that the company is now "confident in that date." The various delays that held up the SUV this far – including battery shortages, deciding to make the PHEV in the US the refreshed version and better-than-expected sales in Europe and Japan – have worked their way through the system, he said. "The issue was battery capacity, and the vehicle sold far better in Europe than anyone anticipated. It just takes time to build the battery. You got to buy raw materials and rethink the whole process. We're confident that it's going to be next spring." As for where the Outlander will go on sale in the US Fedorak said he did not know the initial markets for, but said it was likely the plug-in SUV would mimic the roll-out of the i-MiEV, which is now available in most states. Even with the Outlander PHEV's success overseas, the company does not expect it to be a big seller here. "It's not going to be big percentage of Outlander sales [in the US]," Fedorak said. "Our expectations are in the single-digit percentage of the total Outlander sales. It's just going to be a technology showcase for us, and we'll see what happens. If it takes off for us like it did in Europe, it'll be good news for the brand." Last year, Mistubishi sold 31,054 Outlander Sports and 13,068 Outlanders in the US. That means Mitsubishi expects to sell a maximum of 3,970 Outlander PHEVs (nine percent of 44,122 total Outlander sales) in the plug-in's first year on sale in the US. Fedorak said he doesn't think there are any specific regulatory issues that need to be solved to bring the Outlander PHEV here. Things like EPA certification and crash testing still need to be done, he said, but that's just part of the normal process now. Fedorak said he thinks there is no difference in the plug-in powertrain from the current version sold in Europe and Japan and the version that will come to the US. But the rest of the 2016 Outlander will be "much more than a facelift," he said (something we've heard before). "It's a total rethink of the chassis and the tuning of the vehicle. Carlos Ghosn to make first public appearance in seven weeks on Tuesday

Ousted Nissan chairman Carlos Ghosn is set to make his first public appearance in seven weeks at a Tokyo court on Tuesday after he requested an open hearing to hear the reason for his continued detention. Ghosn has been held in a detention center since his Nov. 19 arrest on allegations of financial misconduct, which was followed by re-arrests over further allegations. The hearing will take place at 10:30 local time (0130 GMT) on Jan. 8, the Tokyo District Court said on Friday. The reason behind the timing of Ghosn's request was not clear. Earlier this week, the court approved an extension to Ghosn's detention until Jan. 11, after re-arrest by prosecutors who accuse him of aggravated breach of trust in transferring personal investment losses to Nissan. Those allegations center on the use of company funds to pay a Saudi businessman who is believed to have helped him out of financial difficulties, sources said last week. According to an article from The New York Times, Ghosn and his family assert that he is innocent. In remarks Ghosn made while under detention in Japan, he is reported to have said through his lawyer, "I want to have my position heard and restore my honor in court." Former Nissan executive Greg Kelly, who has been charged with conspiring to under-report Ghosn's income, has been released on bail after the court ruled against extending his detention while he awaits trial. Ghosn's arrest was followed by his removal from roles at Nissan and Mitsubishi. The case has rocked the auto industry and strained Nissan's ties with French partner Renault where Ghosn still remains chairman and chief executive. Renault has launched a search for an interim chief to fill Ghosn's roll at the French company as he deals with these legal cases in Japan. The arrest has also put some of the practices of Japan's criminal justice system under international scrutiny, including keeping suspects in detention for long periods and prohibiting defense lawyers from being present during interrogations.
