Auditor had questioned Nissan on payments in Ghosn scandal, source says
Wed, Nov 28 2018TOKYO — Nissan's auditor had repeatedly questioned transactions at the heart of allegations of financial misconduct by former chief Carlos Ghosn, but Nissan said they were proper, a person with direct knowledge of the matter said on Wednesday. Ernst & Young ShinNihon LLC questioned Nissan's management several times, chiefly around 2013, about purchases of overseas luxury homes for Ghosn's personal use and of stock-appreciation rights that were conferred on him. But the Japanese automaker said the transactions and financial reporting were appropriate, the source told Reuters on condition of anonymity. The revelation shows Nissan and its auditor were discussing the transactions, in apparent contrast with Nissan's contention that the alleged misreporting of benefits for Ghosn was masterminded by Ghosn and a key lieutenant. A spokesman for EY ShinNihon, the Japanese affiliate of global accounting firm Ernst & Young, said he could not comment on specific cases. A Nissan spokesman declined to comment. Ghosn was arrested on Nov. 19 as he arrived in Japan. Prosecutors accuse him of falsifying Nissan's annual reports to understate by about half his total compensation of some 10 billion yen ($90 million) over several years. The high-profile former executive has denied the allegations, according to Japanese media. Ghosn remains in custody and is unable to speak publicly. He is represented by former prosecutor Motonari Otsuru, according to Japanese media. Otsuru's law firm declined to comment on Wednesday, and Otsuru has not responded to requests for comment. Nissan has largely pinned the blame on Ghosn and Greg Kelly, a former representative director who was arrested along with Ghosn on the same allegations. "As a result of the investigation, we are certain these two are the masterminds," CEO Hiroto Saikawa told a news conference on Nov. 19, referring to Ghosn and Kelly. He declined to say whether others at Nissan were involved in the alleged wrongdoing. An internal investigation is ongoing, and Nissan says it is cooperating with prosecutors. Nissan and Mitsubishi Motors have removed Ghosn as chairman in the wake of his arrest. The French member of the three-firm alliance, Renault, retains him as chairman and CEO.
Mitsubishi North America distances itself from mileage scandal
Thu, Apr 28 2016Mitsubishi's US operations are keen to distance themselves from the falsified fuel mileage scandal that has brought the whole of Mitsubishi Motors under scrutiny. In a statement released Thursday, MMNA announced that the internal audit of US market vehicles dating back to 2013 has uncovered no wrongdoings. Mitsubishi Motors R&D North America has verified the data previously submitted to EPA, and no vehicles sold in the US from 2013 to 2017 are affected with the fuel data irregularities. According to Mitsubishi, the testing data for the US market vehicles complies with EPA procedures and a different method is used in the United States than Japan to gather fuel mileage figures – something the EPA calls "Road Load Coefficient," and the data is independently verified before submitting. So far, the scandal seems to center on Japanese market cars, even if the findings date back to 1991. To confirm that U.S. market vehicles are not affected by this issue, Mitsubishi Motors R&D America, Inc., working together with Mitsubishi Motors Corporation, proactively conducted an internal audit of U.S. market vehicles going back several model years to check previously submitted data to the EPA. After a thorough review of all 2013MY – 2017MY vehicles sold in the United States, we have determined that none of these vehicles are affected. Our findings confirm that fuel economy testing data for these U.S. market vehicles is accurate and complies with established EPA procedures. An entirely different system is used for the United States market to determine what the EPA calls Road Load Coefficient, strictly adhering to EPA procedures. The data generated is then independently verified for its accuracy before being submitted to the EPA for their fuel economy testing. MMNA has shared this information with EPA, California Air Resources Board and DOT. Mitsubishi Motors Corporation has acted quickly to address this issue and is putting in place a committee of external experts to thoroughly and objectively continue this investigation. An Oregon woman took her 2001 Mitsubishi Montero to Steve's Imports in Portland to have the emissions system fixed; the business, however, is a repair and body shop that doesn't appear to specialize in emissions. After paying $2,299.05 for the fix she got a call from the shop informing her that a repairman had been caught on camera running a red light, so she should expect a ticket. When the ticket came, the image with it was the one above, taken at 2:59 AM. The shop's owner, Steve Spinnett, said the man in the car is his son, Tommy Spinnett, who is the shop foreman. The woman is a "family friend" that Tommy was picking up from a concert. Steve told KVAL news that his son had the car all weekend to put it through a drive cycle, and that the shop doesn't charge for drive cycles done after hours. Even if all of that is true, drive cycles don't take a whole weekend - a thorough emissions-test drive cycle can be done in a couple of hours. And then there's this: the owner needed to pass the emissions test to get new license plates; the ones on the vehicle that Tommy drove over the weekend were expired. We've written about some egregious instances of customer abuse at the hands of dealership and repair shops, but this isn't one of them.
