Carlos Ghosn: What misconduct is he accused of?

TOKYO — Japan was shocked by news that Nissan Motor Co. Chairman Carlos Ghosn, who was widely respected for rescuing the carmaker from near bankruptcy, was arrested on Monday for alleged financial misconduct. Nissan said that Ghosn, who is also chairman and CEO of Renault and chairman of Mitsubishi Motors, would be fired from his post as Nissan chairman on Thursday. What is Carlos Ghosn accused of? Nissan CEO Hiroto Saikawa told a packed press conference on Monday night that the company had found that Ghosn had been using corporate money for personal purposes and under-reporting his income for years in official company filings to the Tokyo Stock Exchange. Another board member, Greg Kelly, was also deeply involved in the misconduct, Nissan said. Saikawa said he couldn't elaborate as the cases are being investigated by prosecutors, who have declined to comment. Prosecutors said that Ghosn and Kelly conspired to understate Ghosn's compensation over five years starting in fiscal 2010 as being about half of the actual 9.998 billion yen ($88.9 million). Public broadcaster NHK said Nissan paid billions of yen to buy and renovate homes for Ghosn in Rio, Beirut, Paris and Amsterdam, citing unnamed sources. The properties had no business purpose and were not listed as benefits in TSE filings, NHK said. Ghosn, 64, has not been formally charged. The Asahi newspaper reported that he and Kelly had submitted to prosecutors' questions after getting off a plane on Monday afternoon at Tokyo's Haneda Airport. Saikawa confirmed they had been arrested. Ghosn and Kelly have not been seen since, and their exact whereabouts are not known. Suspects are typically taken to the Tokyo Detention Center, which is linked to the Tokyo District Public Prosecutors Office. How did this come to light? Nissan's Saikawa said Ghosn's alleged improprieties came to light through a whistleblower, after which the company began an internal investigation and informed prosecutors. Japanese media reports say the informant is a member of Nissan's legal department. The Asahi reported, without citing sources, that the informant gave the prosecutors information in a plea bargain, implying the person may have provided evidence in exchange for a lighter sentence. He also faces a breach of trust allegation, for which his detention had been approved previously through Jan. 1. The Tokyo District Court said in a statement that it had approved prosecutors' request for a 10-day extension. Ghosn has been charged in the first set of allegations, about under-reporting Ghosn's pay by about 5 billion yen ($44 million) in 2011-2015. It is unclear when Ghosn may be released on bail. Tokyo prosecutors consider Ghosn, a Brazilian-born Frenchman of Lebanese ancestry, a flight risk. In Japan, formal charges can mean a suspect will get detained for months, sometimes until the trial starts, because of fears of tampered evidence. Some experts are puzzled that the allegations against Kelly and Ghosn are about underreporting income from Nissan. Nissan is in charge of filing such financial reports, not individual executives. Over the weekend, The New York Times published an article, "The Rise and Fall of Carlos Ghosn," describing his arrest as well as his almost legendary ascendance as the outsider who saved Nissan: "He was a person who was above the clouds," said one Nissan employee. But it's clear from the article that his autocratic style has long rankled the Japanese. In a sidebar, the NYT also covered accusations from Ghosn's daughters that Nissan had set him up for a fall, part of a mutiny against his explorations of a merger between Nissan and Renault. They point out that Hiroto Saikawa, the chief executive of Nissan, complained about the nature of the alliance in the first news conference following Ghosn's arrest. Mitsubishi wants to bring a plug-in hybrid Montero to the US

As Mitsubishi's turnaround takes hold, we can talk less about the company's survival in the US market and more about what kinds of products we might see in the future: there's a hybrid Evo on the way and its joint venture with Renault-Nissan will deliver a C-segment sedan. Furthermore, it might even deliver a dividend to its shareholders next year.
In addition to Mitsubishi announcing its intent to focus on SUVs, pickup trucks and crossovers, company president Osamu Masuko gave an interview to Automotive News saying that the plan is for model lines to have two or three power train options: gas, plug-in hybrid, diesel. Believing that fuel economy standards will force the expansion of the plug-in hybrid market, Masuko wants to bring a PHEV Pajero to the US (the Montero in our market) because it will restore the brand's place in the full-size SUV segment with a well known nameplate, and help the company reach its goal of making PHEVs 20 percent of its product offering.
We love the idea of a new Montero - and we hope there's a traditional gas model that would come with the PHEV - the question is what would it look like? The Concept GC-PHEV we saw at the 2013 Tokyo Motor Show could offer clues, but with Masuko listing the SUV as the company's second most popular model behind pickups, how daring could designers get with it? On the other hand, if you compare the Concept PX-MiEV shown at Tokyo in 2011, the similarity to the production Outlander is more than one might expect for a crossover that's become a major seller for the brand. With an introduction due in 2015 or 2016, we shouldn't have to wait long to find out. Regrettably, there's still no word on the return of a Mitsubishi pickup truck.
