Facts point to legal violations by Carlos Ghosn, says Nissan external review

YOKOHAMA, Japan — An external committee reviewing governance at Nissan Motor Co said on Wednesday there were enough facts to suspect violations of laws and the private use of company funds by ousted chairman Carlos Ghosn. Following a three-month audit of Nissan's governance after a scandal that shook the global auto industry, the committee put the blame squarely on what it called Ghosn's concentration of power. It also acknowledged Nissan CEO Hiroto Saikawa's role in Ghosn's salary arrangement at the heart of the scandal. Twenty years to the day since French automaker Renault SA agreed to rescue Nissan, the committee described a corporate culture at Nissan "in which no one can make any objections to Mr. Ghosn," who was "in a way deified within Nissan as a savior who had redeemed Nissan from collapse." A representative for Ghosn replied in a statement that the allegations made against the former Nissan chairman "will be revealed for what they are: part of an unsubstantiated smear campaign against Carlos Ghosn to prevent the integration of the Alliance and conceal Nissan's deteriorating performance." The group issued 38 recommendations to bolster Nissan's governance, including that top executive positions at the Japanese car maker should not be held by people serving in executive positions at Renault or junior partner Mitsubishi Motors. It also proposed that the majority of directors, including the chairman of the board, be independent, outside directors and that the role of company chairman be abolished. Responding to the committee's comments, Saikawa told reporters on Thursday that Nissan would seriously consider the committee's recommendations, which he characterized as "tough." Saikawa, who was speaking outside his home, did not specifically address his responsibility in the scandal but has previously said that top management, including himself, were responsible for weak governance which led to the misconduct. The recommendations from the external, seven-member committee came weeks after Nissan and Renault said they would retool their alliance, one of the world's biggest automaking groupings, to break up the all-powerful chairmanship previously held by Ghosn. "There are facts sufficient to suspect violations of laws and regulations, violation of internal rules and private use of company funds and expenses ... by Mr. Ghosn," the committee said in its report.

Even if all of that is true, drive cycles don't take a whole weekend - a thorough emissions-test drive cycle can be done in a couple of hours. And then there's this: the owner needed to pass the emissions test to get new license plates; the ones on the vehicle that Tommy drove over the weekend were expired. We've written about some egregious instances of customer abuse at the hands of dealership and repair shops, but this isn't one of them. In the future, cars will drive us. And probably not surprisingly, they'll often know where to go without us even needing to tell them. That's the theme of a short back-and-forth conversation on Twitter recently between Tesla founder and CEO Elon Musk and a user who tagged him in a comment suggesting that "it would be cool" to be able to tell a car where to go. Responding to user James Harvey, Musk replied, "It won't even need to ask you most of the time." Later, after Harvey asked how the car would know where he wants to go, another user suggested that the car would know what time you go to work. After all, the smartphones we carry around already possess the ability to predict what we want — think Google's cleverness in tailoring search results or providing traffic information just before your commute, Facebook's highly customized News Feed content or even auto-fill technology, which can predict the words you're typing. And plenty of automakers have been touting their own work in developing in-car artificial intelligence systems. Like Audi's Elaine concept, which will be able to learn, think and even empathize with drivers. Or Mitsubishi's e-Evolution concept, which can not only assist your driving, but also assess your skills and teach you how to improve them. Tesla's vehicles, of course, are being outfitted with all the latest autonomous driver-assist technology, with the automaker eager to one day reach full Level 5 self-driving capability. According to Inc., Teslas will be able to listen and respond to directional commands, and they'll even have access to your calendar to comb for information about where you need to go. Tesla has also said it's developing an update to its Autopilot hardware and remains on track to achieve full Level 5 autonomous driving by the end of this year, which strikes a lot of people as wildly unrealistic. At any rate, the promise of cars knowing what time we're sneaking out to get donuts or picking up the kids is interesting, coming from the man who has warned that AI presents "a fundamental risk to the existence of human civilization."Related Video:
