Carlos Ghosn's detention extended over fresh allegations

TOKYO — A Japanese court on Friday approved the detention of former Nissan Chairman Carlos Ghosn through April 14 after his latest arrest over financial misconduct allegations, a move that has raised questions among legal experts. The former star executive was taken into custody Thursday over fresh allegations that $5 million sent by a Nissan Motor Co. subsidiary and meant for an Oman dealership was diverted to a company effectively controlled by Ghosn. Ghosn spent nearly four months in detention and was just released last month after meeting stringent bail conditions while he awaits trial over earlier allegations that he under-stated his compensation in financial documents, had Nissan shoulder his personal investment losses and made dubious payments to a Saudi businessman. The Tokyo District Court on Friday approved the initial 10-day detention request from prosecutors, who can seek another 10-day extension before needing to file charges against Ghosn, release him or accuse him of fresh misconduct that needs investigating. Stringing out a suspect's arrest for the full 20 days and then raising fresh accusations is common in Japan, where it is known as a "rearrest." Critics say it allows suspects to be grilled by the authorities, resulting in some signing confessions to crimes they never committed. But it is rare for a suspect to receive bail and then be taken back into custody. Ghosn, 65, was first arrested Nov. 19 and released March 6 on 1 billion yen ($8.9 million) bail, after two previous rearrests. He says he is innocent of all allegations. Prosecutors argue the latest allegations are different from the previous ones, but his legal team says they are part of the same scenario of alleged wrongdoing. In demanding the latest detention, prosecutors argued Ghosn may tamper with evidence related to the fresh allegations. Prosecutors had earlier fought against bail for Ghosn, a citizen of France, Brazil and Lebanon, arguing he was a flight risk. Ghosn's lawyer Junichiro Hironaka pointed out prosecutors have already raided Ghosn's property and taken everything, leaving little to tamper with.

Even if all of that is true, drive cycles don't take a whole weekend - a thorough emissions-test drive cycle can be done in a couple of hours. And then there's this: the owner needed to pass the emissions test to get new license plates; the ones on the vehicle that Tommy drove over the weekend were expired. We've written about some egregious instances of customer abuse at the hands of dealership and repair shops, but this isn't one of them. To purchase a new vehicle and enjoy everything buying "new" implies (warranty, reasonably new tech, a long life and affordable financing), you have to spend $20,000, probably more like $25,000. A generation ago, Mitsubishi's American arm had a financial meltdown, precipitated by a consumer financing plan offering zero interest and zero payments for way-too-many-months. When it was time to make payments customers simply returned the cars, leaving Mitsubishi holding a very expensive inventory worth substantially less than what was owed. Later, of course, the economy had its own meltdown, from which most of America's automotive industry rebounded. But Mitsubishi, with a sparse lineup and little marketing, is still working on that. A recent infusion of Nissan capital will help, as should Nissan's managerial oversight. Despite Mitsubishi's aging lineup, the Outlander Sport stands out - Mitsubishi continued to build it while other manufacturers were belatedly awakening to the subcompact crossover segment. And while its platform is old and its menu of standard and optional equipment dated, if you're on a tight budget you might find it attractive. The CX-3 boasts the shortest wheelbase (101.2 inches), while the Honda sits at 102.8 inches and the compact Outlander Sport stretches to 105.1. In overall length the Mitsu is close to both the CX-3 (168 inches for the Mazda, 171.5 for the Outlander Sport and 169.1 inches for the HR-V). Finally, the Outlander Sport's 3,000-pound weight is within a belt notch of the Mazda's 2,900 and the Honda's 2,900 (front-wheel drive/manual). The Mitsubishi sheetmetal and stance is reminiscent of Audi's Q5, and while the similarity is coincidental, it's fun to have an upmarket look in a $20,000 car. Of course, once the Outlander Sport is turned on, that upmarket vibe is gone. For your $20K you'll get a 2.0-liter engine offering 148 horsepower, just north of Mazda's 146 and Honda' s 141.
