Carlos Ghosn appears in court: 'I am wrongly accused'

TOKYO — Former Nissan Chairman Carlos Ghosn told a Tokyo court on Tuesday that he was innocent, defending his honor in his first public appearance since he was arrested on Nov. 19 and charged with false financial reporting. "Your honor, I am innocent of the accusations against me," Ghosn told the judge, speaking firmly and calmly as he read from a statement. "I am wrongfully accused." Prosecutors have charged Ghosn, who led a dramatic turnaround at the Japanese automaker over the past two decades, with falsifying financial reports in underreporting his income by about 5 billion yen ($44 million) over five years through 2015. They also say he is suspected of having Nissan temporarily take on his investment losses from the financial crisis. Seen for the first time since his November arrest, Ghosn was wearing a dark suit without a tie, and plastic slippers, and looked thinner and with gray hair. He rebutted the allegations against him point-by-point and said he had the option to leave Nissan but had decided to stay on. "A captain doesn't jump ship during a storm," he told the court in a strong voice. The veteran auto executive, a familiar face at the World Economic Forum and other elite gatherings, was handcuffed and led into the courtroom with a rope around his waist as the hearing began. Officers uncuffed him and seated him on a bench. Presiding judge Yuichi Tada then read out the charges and said Ghosn, a Brazilian-born Frenchman of Lebanese ancestry, was considered a flight risk — he was arrested on his arrival in Tokyo by private jet — and might try to hide evidence. In Japan, suspects are routinely held without bail, often due to fears about evidence tampering. During Tuesday's hearing, Go Kondo, one of Ghosn's lawyers, argued he was not a flight risk. "He's widely known so it's difficult for him to escape. There is no risk that the suspect will destroy evidence," he said. Facing the courtroom, Ghosn spoke proudly of the automaker's — and his own — achievements, such as reviving iconic models like the GT-R and the Z, expanding operations in China, Russia, Brazil and India and pioneering electric cars and autonomous driving. "I have a genuine love and appreciation for Nissan," he said. Ghosn has been held in spartan conditions at a Tokyo detention facility since he was taken into custody. In keeping with Japanese regulations, he has been allowed visits only from his lawyers and consular officials.

Junkyard Gem: 1987 Mitsubishi Mirage L Hatchback

  Chrysler Corporation began selling Mitsubishi Colt Galants with Dodge Colt badging in North America all the way back in the 1971 model year, with many more rebadged Mitsubishis to follow in later decades. Soon after Mitsubishi developed the new front-wheel-drive Mirage for the home market in 1978, this car received Dodge Colt and Plymouth Champ badging on these shores. Sales were brisk, despite internal competition from the Simca-derived Dodge Omni/Plymouth Horizon. Starting in the 1983 model year, Mitsubishi began selling vehicles under its own badging here; at first, Americans could buy the Starion, Tredia, Cordia, and Mighty Max. For the 1985 through 1987 model years, the second-generation Mirage rolled out of North American Mitsubishi showrooms, doing sales battle with its near-identical Colt twins at the Dodge and Plymouth dealers. Here's one of those cars, found in battered condition in a Denver self-service car graveyard. This car didn't get much beyond 150,000 miles during its career, but those miles must have been hard ones. More likely, it spent long periods (maybe decades) sitting outdoors after being parked for the last time. Presumably, the driver's side was facing south and bore the brunt of many years of mile-high solar radiation. While the 1985-1987 Dodge and Plymouth Colts sold in huge numbers here, this generation of Mirage didn't catch on nearly as well with car shoppers. I hadn't seen an early Mirage in a junkyard for many years when I found this one. The "Big Nose Guy" icons on the HVAC controls appeared in all Mitsubishi-built cars sold here during the 1980s. Mitsubishi was (and is) a consumer-electronics behemoth, and so the high-end factory AM/FM/cassette rig in this car bears the same nameplates as the car itself. I couldn't get the hood open, but this car was almost certainly powered by an ordinary 4G Orion engine. The transmission is the five-speed manual, which was easier to use than the dual-range Twin-Stick four-speed but not nearly as cool. Starting in the 1989 model year, the Mitsubishi Mirage had to compete with three different badge-engineered siblings for sales: the Dodge Colt, the Plymouth Colt, and the Eagle Summit. Facts point to legal violations by Carlos Ghosn, says Nissan external review

YOKOHAMA, Japan — An external committee reviewing governance at Nissan Motor Co said on Wednesday there were enough facts to suspect violations of laws and the private use of company funds by ousted chairman Carlos Ghosn. Following a three-month audit of Nissan's governance after a scandal that shook the global auto industry, the committee put the blame squarely on what it called Ghosn's concentration of power. It also acknowledged Nissan CEO Hiroto Saikawa's role in Ghosn's salary arrangement at the heart of the scandal. Twenty years to the day since French automaker Renault SA agreed to rescue Nissan, the committee described a corporate culture at Nissan "in which no one can make any objections to Mr. Ghosn," who was "in a way deified within Nissan as a savior who had redeemed Nissan from collapse." A representative for Ghosn replied in a statement that the allegations made against the former Nissan chairman "will be revealed for what they are: part of an unsubstantiated smear campaign against Carlos Ghosn to prevent the integration of the Alliance and conceal Nissan's deteriorating performance." The group issued 38 recommendations to bolster Nissan's governance, including that top executive positions at the Japanese car maker should not be held by people serving in executive positions at Renault or junior partner Mitsubishi Motors. It also proposed that the majority of directors, including the chairman of the board, be independent, outside directors and that the role of company chairman be abolished. Responding to the committee's comments, Saikawa told reporters on Thursday that Nissan would seriously consider the committee's recommendations, which he characterized as "tough." Saikawa, who was speaking outside his home, did not specifically address his responsibility in the scandal but has previously said that top management, including himself, were responsible for weak governance which led to the misconduct. The recommendations from the external, seven-member committee came weeks after Nissan and Renault said they would retool their alliance, one of the world's biggest automaking groupings, to break up the all-powerful chairmanship previously held by Ghosn. "There are facts sufficient to suspect violations of laws and regulations, violation of internal rules and private use of company funds and expenses ... by Mr. Ghosn," the committee said in its report.
