Judge to approve settlement of Mini CVT lawsuits

BMW has agreed to settle a number of class-action lawsuits out of court. The suits stem from drivetrain issues on the 2001 to 2006 R50 Mini Cooper - in particular, its continuously variable transmission. The transmission was known to fail, often without warning on otherwise healthy and well-maintained vehicles. This wasn't the only major issue to afflict the original BMW-era Mini models.
According to legal site Topclassactions.com, the suits alleged that BMW knowingly hid the defects in the CVT from customers while informing dealers of the issue. The first suit was filed in 2011, while four additional suits have followed. Now, BMW has reportedly settled, offering to reimburse 1,200 owners that needed repairs within eight years or 150,000 miles of their purchase. Repair prices for the transmission range from $6,000 to $9,000.
Under the agreement, BMW will also offer up to $4,100 to members of the suit that had fixes performed at a third-party shop, while owners who sold their cars at a loss due to the issues are slated to receive up to $2,000. Finally, owners who are part of the suit will be warrantied for a further eight years and 150,000 miles.

After an $850 destination charge, the models cost $37,100 with a manual gearbox. Mini doesn't offer the John Cooper Works trim on the Hardtop Four-Door, but a handful of US customers can now order the next-best thing. The new Carbon Edition satisfies the needs of enthusiasts wanting extra power to go with the two additional doors, but Mini will only offer 150 of them here. The Carbon Edition starts with the Hardtop Four-Door Cooper S and then layers on the John Cooper Works Pro Tuning Kit to create a 208-horsepower hot hatch. An upgraded exhaust with Sport and Track modes also comes with that package, according to MotoringFile. For extra style, they all wear a JCW body kit in Midnight Black, and there's a heap of carbon-fiber trim to fit the name. Matte black stripes amplify the menacing look and feature a little Carbon emblem cut into the ones on the sides. Additional improvements include LED headlights, a panoramic sunroof, a navigation system, and JCW interior trim. The array of improvements don't quite take the Carbon Edition to the full 228 hp from the JCW Hardtop Two-Door, but Mini spokesperson Mariella Kapsaskis tells Autoblog that the US product team handpicked these parts to get as close as possible. According to Kapsaskis, the first examples are already at dealers, and the Carbon Edition might not last long with just 150 of them on the road. The exhaust flap is operated wirelessly via two clicks of the Bluetooth controller and unleashes devilish backfire pops and crackling sound on the overrun. Genuine carbon fiber mirror caps, air intake trim, and tailpipe finishers are offset against Midnight Black metallic paint and exclusive matte black sport and side stripes accented by a red pinstripe.

Man criticized for filming rather than helping road rage victim

A man from Cheshire in England was criticized on social media after he filmed a road rage brawl and provided color commentary for it instead of helping the victim. According to the Daily Mail, Alec Wall was traveling through Cheshire when he came upon a strange scene. A red Mini was stopped at a light, and standing next to it in traffic was a woman in a white dress. As Wall watched, the woman lunged for the Mini's driver's door, wrenched it open, and began fighting with the woman behind the wheel. While the women fought, Wall pulled out his phone and started recording. "Road Rage!" he shouted as he filmed. Apparently finding the situation extremely funny, Wall continued to film, giggling all the while and providing commentary on the scuffle. "Oh my God, actual road in a rage!" he shouted. Once he returned home, Wall uploaded his video to a Facebook page called Idiot UK Drivers Exposed where it racked up nearly 90,000 likes. Not everyone found it as funny as Wall did, however. Comments began piling up chastising Wall for his flip attitude and his failure to intervene in the fight. "How about instead of laughing and screaming 'road rage' like a moron you do something productive like get out of your car and try to defuse the situation? Use some intelligence..." said one commenter. "I really have failed to see what the camera man is laughing at," said another. "It looks to me like someone being seriously assaulted.
