Did BMW drag its feet on Mini recall?

The National Highway Traffic Safety Administration is opening an investigation into BMW's reporting of a recall for 30,456 examples of the 2014-2015 Mini Cooper Hardtop, Cooper S, and the 2015 John Cooper Works. According to the government, "it appears from a review of NHTSA's databases that BMW may have failed to submit recall communications to NHTSA in a timely manner." The automaker issued the recall in July because crash tests showed the models didn't meet side impact requirements for passengers in the back seat. While there were no reported injuries at the time, the company decided to install energy-absorbing material in the space between the rear interior panels and the exterior. However, NHTSA has decided to investigate whether this campaign should have started much earlier, given the evidence the company had. According to the government's report, the Cooper Hardtop failed side-impact tests in 2014, although one of these tests was five-miles-per-hour faster than the Federal Motor Vehicle Safety Standard. The agency claims: "In January 2015 BMW verbally committed that it would conduct a service campaign to add padding to the rear side panels of MY 2015 Mini 2 Door Hardtop Cooper models. However, BMW did not initiate the service campaign and failed to inform NHTSA of its failure to do so." A subsequent crash test of an example with this fix showed it to make the vehicle compliant with the rules. Mini spokesperson Mariella Kapsaskis told Autoblog: "Regarding the NHTSA audit query, BMW Group is evaluating the request and will respond to NHTSA as appropriate." The Mini Convertible John Cooper Works has stripped off almost all of the camo it was wearing when we last saw it a few months back. There's not much left to the imagination anymore, and all that remains are some swirls to hide a little of the hood and rear. As expected, the entire front end, rear bumper, central exhausts and subtly flared wheel arches come directly from the JCW take on the two-door Hardtop. Except for the Convertible's repositioned antenna and lowering top, the two models are essentially the same on the outside. With the standard, third-gen Mini droptop not actually unveiled yet, all of the camouflage at the back is likely there to hide the way the roof folds down. Under the hood, expect the latest JCW 2.0-liter turbocharged four-cylinder producing 228 horsepower and 236 pound-feet of torque with a choice of six-speed manual or automatic gearboxes. Of course, the Convertible also adds the thrill of tipping the throttle with the top down. Mini hasn't hinted at a reveal date for the latest Convertible yet. However, these shots suggest development is at a fairly advanced state, so an official debut is likely not too far off. Related Video:

2014 Mini John Cooper Works Countryman All4

The standard Mini Countryman is a bit of an odd duck against the backdrop of 'normal' small crossovers like the Mazda CX-5 and the Ford Escape, but I sort of get it. Apply the same winning Mini formula to a CUV, and you get a smaller-than-average entry in the segment, one that is far more entertaining to drive than the norm, more stylish inside and out and pretty expensive when cross-shopped. That list of qualities doesn't appeal to all crossover shoppers, sure, but it intrigues a big enough list that the Countryman has reason for being.
Now, add the expensive John Cooper Works package to the Countryman's already niche goodies list, and Mini starts to lose me. So, I'm getting the softer suspended, taller, generally less dynamically joyful version of the brand's core values, but now you're charging me at least $35,000 ($13k more expensive than the basic, front-drive Cooper Countryman and $7k more than the MSRP of the Cooper S All4 version)? What's that? You're going to make it look like a garish, tippy-toed tuner car in the process? Take my money.
Or, actually, let me keep it. I can swing with a lot of the weirdness that Mini has to offer, but this car pushed me past my limit.
