Temporary Tags.

Buyers will be supplied with a 30 day temporary tag, title and registration from us. Your will be provided with all document in which to take to your local DMV. Proof of insurance and a valid drivers are required for all purchases in New Mexico. Buyers will be required to pay for sales/excise taxes, registration, title and docment fees at their local department of motor vehicles office. You will not be charged these fees at the dealership.

Deposit

We require a non-refundable $500 deposit within 24hrs of winning the auction. Deposit accepted via  PayPal.

Buyer Pickup

Vehicle pick up by auction winner or shipping company is to be arranged at least 24hrs in advance for scheduling purposes. We are available normal business hours Monday - Friday and 10:00 AM-6: PM. Note that seller will deliver car to the Albuquerque NM airport for an additional charge of $150 to be delivered on a day of the week that is acceptable to the seller (usually Tuesdays).

below, you represent that you have reviewed the following and agree unconditionally.

 

1. Entire Agreement  - The terms and conditions memorialized in this Sales Agreement comprise the complete, entire and final agreement between Buyer and Seller. No other terms, negotiations, proposals, representations, commitments, understandings or agreements between Buyer and Seller, either written or oral, shall be valid or enforceable, unless expressly contained in the Sales Agreement. The Sales Agreement may be modified or amended only upon express written consent of both parties.

 

2.  IMPLIED WARRANTIES ONLY. Buyer acknowledges that the automobile contemplated by this transaction is a used automobile and is offered for purchase in its current state.   Seller makes no guarantee as to condition, mileage, year, model or any other circumstance regarding the automobile. Buyer acknowledges that the actual condition of the automobile may vary from any photographs, statements or representations made by Seller. Buyer represents that he/she had an opportunity to inspect the automobile prior to purchase and acknowledges that Seller has no responsibility for any defects or repairs, regardless of any representations (oral or otherwise) made by Seller.  Furthermore, Buyer acknowledges that Seller will not provide a warranty of any type with regard to the automobile and, therefore, depending on the status of the manufacturers warranty, there may be no warranty of any type covering this automobile. Please see Federal Buyers Guide regarding New Mexico Implied Warranties. New Mexico Implied Warranty means that the dealer does not make any specific promises to fix things that need repair when you buy the vehicle of after the time of sale. But, state law “implied warranties” may give you some rights to have the dealer take care of serious problems that were not apparent when you bought the vehicle.

3. Purchase -  Buyer is deemed to have purchased the automobile upon satisfaction of each of the following events: (1) Buyer and Seller have executed this Sales Agreement; (2) Seller has issued the registration (either Pennsylvania or in transit registration); (3) Buyer has executed the "Buyers Guide"; (4) Buyer has paid, in full, for the automobile; and, (5) Buyer has taken possession of the automobile. Buyer shall be deemed to have taken possession of the automobile, and therefore, any and all risks associated with possession, at the time the automobile is removed from Sellers premises, either by Buyer, Buyers agent or shipper (regardless or whether Seller arranged shipping on Buyers behalf).

 

4. Limited Warranty - THERE ARE NO WARRANTIES, EXPRESS OR IMPLIED, WRITTEN OR ORAL, INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF MERCHANTABILITY OR FITNESS FOR ANY PARTICULAR PURPOSE. SELLER HEREBY DISCLAIMS ANY AND ALL REPRESENTATIONS AND WARRANTIES OF ANY KIND (WHETHER ARISING BY IMPLICATION OR BY OPERATION OF LAW).

THIS SECTION SURVIVES THE TERMINATION OR CANCELLATION OF THIS SALES AGREEMENT.

 

5. Limitation of Liability - SELLERS LIABILITY FOR ANY LOSS OR DAMAGE ARISING OUT OF OR RESULTING FROM OR IN ANY WAY CONNECTED TO THIS TRANSACTION OR THE AUTOMOBILE CONTEMPLATED BY THIS TRANSACTION SHALL NOT EXCEED BUYERS PURCHASE PRICE, REGARDLESS OF WHETHER SUCH LIABILITY ARISES IN CONTRACT (INCLUDING, BUT NOT LIMITED TO, FAILURE OR DELAY IN PERFORMANCE OR DELIVERY DUE TO ANY CAUSE WHATSOEVER), TORT (INCLUDING, BUT NOT LIMITED TO, NEGLIGENCE OR STRICT LIABILITY) OR OTHERWISE. IN NO EVENT IS SELLER RESPONSIBLE TO BUYER FOR ANY INCIDENTAL, SPECIAL, EXEMPLARY OR CONSEQUENTIAL DAMAGES, INCLUDING, BUT NOT LIMITED TO, ALL DIRECT OR INDIRECT COSTS, REGARDLESS OF WHETHER THOSE DAMAGES WERE FORSEEABLE. ANY CLAIM BY BUYER SHALL BE DEEMED WAIVED UNLESS PRESENTED IN WRITING TO SELLER WITHIN THIRTY (30) DAYS FROM THE DATE BUYER TOOK POSSESSION.

 

6. Force Majeure - Seller shall not be liable for failure or delay in performance hereunder due in whole or in part to (i) acts of God, (ii) strikes, lockouts, or other labor disputes, (iii) civil commotion, sabotage, fire, flood, or explosion, (iv) acts of any governmental agency or authority, (v) unforeseen circumstances (vi) inability to obtain or delay in obtaining any necessary governmental approvals, permits or licenses, (vii) mechanical failure, (viii) or any other cause which is not within the reasonable control of Seller, whether or not of the kind specifically enumerated above.

 

7. Choice of Law, Jurisdiction & Venue - The transaction to which this document relates shall be governed by the substantive laws of the state of New Mexico. In the event of any dispute between the parties arising out of this transaction, the parties agree and consent that the exclusive jurisdiction and venue for the resolution of such dispute shall be New Mexico, Quay County, or the United States District Court for the relevant District of New Mexico.

 

8. Notices No notice or other communication is sufficient to affect any rights, remedies or obligations of either party unless the notice or communication is in writing and (as elected by the party giving the notice or communication) is (i) personally delivered, (ii) transmitted by facsimile (with a receipt acknowledgment), (iii) transmitted by electronic computer mail, (iv) transmitted by a recognized courier service or (v) mailed in registered or certified form, to the party to which notice or communication is being given. Notice shall be delivered to the address specified below.

 

9. General - In the event that any provision contained herein is held to be invalid or unlawful, such provision shall be severed from the remaining provisions, which shall remain in full force and effect. No waiver of any provision hereof and no single waiver shall be held to constitute a continuing waiver or subsequent waiver.

F1 title fight gets closer | 2016 US Grand Prix recap

We ran into an old friend at the US Grand Prix: an on-form Lewis Hamilton. Reliability and proper clutch actuation helped the Mercedes-AMG Petronas driver resurrect the kind of performance we haven't seen since July at the German Grand Prix. After demolishing the previous qualifying record around the Circuit of the Americas, he put the field in his mirrors as soon as the lights went out, was never bothered by anyone behind, and crossed the finish line 4.5 seconds ahead of teammate Nico Rosberg. The drive was exactly what Hamilton needed to keep his molecule-thin Championship hopes alive. Rosberg, however, did exactly what he needed to do as well by finishing second. The German had a sketchier path to the checkered flag than Hamilton, getting pushed back to the third at the start by Red Bull's Daniel Ricciardo. Worse, Ricciardo appeared to have the pace to keep Hamilton honest ahead and hold Rosberg behind. Red Bull and Mercedes matched one another's pit stops, and it was clear the German would need more help to pass the Aussie. Rosberg didn't have to make his own luck, Ricciardo's teammate Max Verstappen made the luck for him. Ricciardo pitted on Lap 26, ceding second position on track to Rosberg. On Lap 30, Verstappen's gearbox failed while headed down the back straight. The Dutch teenager said the team told him to try to get the car back to the pits, so he dawdled through a few corners before following more team orders to pull over and park. Verstappen's parking spot and bad gearbox meant marshals couldn't push the car off the track, they needed to use a crane. That brought out a Virtual Safety Car, slowing the whole race down and allowing Rosberg to run a longer stint while losing less time on old tires. When the German came in for new tires on Lap 31 he emerged ahead of Ricciardo, and they ran that way to the end of the race, much to Ricciardo's disappointment. Sebastian Vettel claimed fourth for Ferrari, a placing perhaps due only to Verstappen and Kimi Raikkonen retiring from the race. An otherwise anonymous weekend for the scuderia called attention to itself on race day when Raikkonen had to call it a day after a botched pit stop, and Vettel couldn't make any impression on the teams ahead. Fernando Alonso rode home to a brilliant fifth for McLaren. During the first stint while rummaging around outside the top ten, the Spaniard complained about his lack of pace. By Lap 15 Alonso was tenth, on Lap 34 he was eighth.

Weekly Recap: Takeaways from the Frankfurt Motor Show

We obsessively covered the 2015 Frankfurt Motor Show, and naturally, we selected our favorites from this fall's biggest automotive event. Now that the dust has settled, we're looking ahead to what it all means. Here are three takeaways from the floor in Frankfurt. The Germans are serious about electric vehicles: It's a bit cliche to say BMW, Mercedes, and Audi have downplayed electrics in favor of other technologies, like diesels. For a time that may have been true, but those three companies, along with Porsche and Volkswagen, are emerging as leaders in EV development. That was on display in Frankfurt, when all of them revealed either all-electric or plug-in hybrid models. Gas prices are relatively low in the United States, but clearly the Germans are thinking long-term and globally. Everyone is serious about SUVs: You gotta have one, even if you're Bentley or Jaguar. It's 2015 and it's what consumers want. As Jaguar design director Ian Callum put it, "Not to be in the sector would be a little naive for the sake of purity." It's not just the flashy exotic luxury makers. Nissan showed the Gripz concept, which is rakish, radical, and meant to blend traits of SUVs and sports cars into a vehicle that really crosses over. Look for more, especially in the luxury sector, as Rolls-Royce, Lamborghini, and Aston Martin ramp up their own SUV efforts. There's no ceiling to the luxury market: Speaking of high-end cars, companies are continuing to invest in extravagant wares beyond just SUVs. Even during the recession, ultra-luxury makers remained relevant, and now they're back at full stride. In Frankfurt, that was illustrated by yet another S-Class model, the cabriolet, which will come in S550 and S63 AMG variants in the United States. Ferrari also showed off the 488 Spider, and Lamborghini opened up the Huracan LP 610-4 Spyder. Meanwhile, Bugatti's Vision Grand Turismo concept reminded enthusiasts that it's plotting life after the Veyron. European auto shows always draw the glitziest reveals from luxury makers, and this year didn't disappoint. OTHER NEWS & NOTES 2016 Honda Civic redesigned with snazzier style, turbo power The 10th-generation of the Honda Civic debuted this week at events in Los Angeles and Detroit ahead of its launch in the United States this fall as a 2016 model. Honda fortified the Civic with LED lights, an available turbo engine, and a more tech-laden cabin.

Mercedes testing C-Class plug-in hybrid modes in Germany

Testing appears to be underway for what would be the first Mercedes-Benz C-Class with a hybrid powertrain. We can see a pair of the prototypes undergoing testing in Germany, with one, a C-Class Wagon, still heavily clad in camouflage and featuring a more noticeable outlet on the passenger side of its rear bumper.
There's also a more production-looking sedan, which features a not-so-discreet flap over its rear-bumper outlet. It's difficult to speculate on power outputs for this fuel-sipping C-Class, although our spies seem to think that this car will feature some combination of a four-cylinder gas engine with an electric motor, although just which four is unclear (note, we wouldn't mind if MB fit its 2.0-liter turbo with some batteries and motors). Regardless, the four-pot/electric motor seems like a pretty reasonable combo, although it probably means that Mercedes won't be challenging the six-cylinder-powered system of the BMW ActiveHybrid3 any time soon.
When the plug-in C-Class arrives later this year as a 2015 model, it will likely offer a full range of driving modes, including both gas or electric, only, as well as a more traditional hybrid mode.
