Toyota settles first wrongful death suit related to unintended acceleration
Mon, 21 Jan 2013Toyota's sales seem to have rebounded from the unintended acceleration issues from 2009 and 2010, but the automaker is far from done dealing with this situation. Following a settlement worth up to $1.4 billion for economic loss to affected vehicle owners, Toyota has settled rather than going to trial in a wrongful death lawsuit stemming from an accident in Utah in 2010 that left two passengers dead. This isn't the first case in which Toyota has settled, but it was the first among a consolidated group of cases being held in Santa Ana, CA.
According to The Detroit News, this case was scheduled to take place next month, and it was for a November 2010 incident in which Paul Van Alfen and Charlene James Lloyd were killed in a Camry when, based on findings by the Utah Highway Patrol, the accelerator got stuck causing the car to speed out of control and hit a wall; the terms of the settlement were not announced.
The article says that while Toyota will settle on some cases, it doesn't plan on settling on all of them as it still wants to be able to "defend [its] product at trial." This will probably be the case in suits claiming that software for the drive-by-wire accelerator was the cause of an accident in a Toyota or Lexus vehicle. The question of whether or not the electronic accelerator played any role in this problem has been a hot-button topic since the beginning. Toyota has issued recalls in the past to attempt to prevent unintended acceleration caused by trapped floor mats and faulty accelerator pedals, but it also says driver error was to blame in some instances.

We collected and collated all of last night's new ads and put them together for you to vote on. And yes, we're limiting this year's contest to last night's new features. That's why you aren't seeing Dodge's epic Wisdom among our collection of commercials, and it's a similar story with Chevrolet's Truck Guy Focus Group series, which highlights the new Colorado. You can still vote for your favorites. We won't be closing the voting on our Super Bowl page, so while the winners and losers are correct as of this writing, it's entirely possible that there could be some changes in the rankings as time goes on. The Japanese brand ran four ads in total – two for Toyota and two for Lexus – and all of them have negative tallies as of this writing. Lexus' Make Some Noise and Lets Play and Toyota's One Bold Choice and My Bold Dad both had very weak showings among the commercials that aired, although they weren't alone. Neither Mazda nor Kia scored particularly well, despite featuring celebrity magic act Penn and Teller and former James Bond, Pierce Brosnan, respectively. Chevrolet was the winner of the losers, as of our writing, recording the fewest downvotes for its audience-punking The Big Game ad. Consumer Reports says infotainment systems 'growing first-year reliability plague'
Mon, 27 Oct 2014The Consumer Reports Annual Auto Reliability Survey (right) is out, and the top two spots look much the same as last year's list with Lexus and Toyota in first and second place, respectively. However, there are some major shakeups for 2014, with Acura plunging eight spots from third in 2013 to 11th this year, and Mazda replaces it on the lowest step of the podium. Honda and Audi round out the top five. This year's list includes six Japanese brands in the top 10, two Europeans, one America and one Korean.
Acura isn't the only one taking a tumble, though. Infiniti is the biggest loser this year by dropping 14 spots to 20th place. Other big losses come from Mercedes-Benz with an 11-place fall to 24th, and GMC, which declines 10 positions to 19th.
Perhaps unsurprisingly, it's not traditional mechanical bugs hauling down these automaker's reliability scores. Instead, pesky problems with infotainment systems are taking a series toll on the rankings. According to Consumer Reports, complaints about "in-car electronics" were the most grumbled about element in new cars. Problem areas included things like unresponsive touchscreens, issues pairing phones and multi-use controllers that refused to work right.
