Toyota settles first wrongful death suit related to unintended acceleration

Toyota's sales seem to have rebounded from the unintended acceleration issues from 2009 and 2010, but the automaker is far from done dealing with this situation. Following a settlement worth up to $1.4 billion for economic loss to affected vehicle owners, Toyota has settled rather than going to trial in a wrongful death lawsuit stemming from an accident in Utah in 2010 that left two passengers dead. This isn't the first case in which Toyota has settled, but it was the first among a consolidated group of cases being held in Santa Ana, CA.
According to The Detroit News, this case was scheduled to take place next month, and it was for a November 2010 incident in which Paul Van Alfen and Charlene James Lloyd were killed in a Camry when, based on findings by the Utah Highway Patrol, the accelerator got stuck causing the car to speed out of control and hit a wall; the terms of the settlement were not announced.
The article says that while Toyota will settle on some cases, it doesn't plan on settling on all of them as it still wants to be able to "defend [its] product at trial." This will probably be the case in suits claiming that software for the drive-by-wire accelerator was the cause of an accident in a Toyota or Lexus vehicle. The question of whether or not the electronic accelerator played any role in this problem has been a hot-button topic since the beginning. Toyota has issued recalls in the past to attempt to prevent unintended acceleration caused by trapped floor mats and faulty accelerator pedals, but it also says driver error was to blame in some instances.

2013 Lexus ES earns five stars from NHTSA

The 2013 Lexus ES has earned a five-star crash rating from the National Highway Traffic Safety Administration. The 2013 ES 350 and ES 300h hybrid earned the highest ratings in each of the government's crash evaluations, including overall driver safety, frontal crashes and overall side impacts, save one. The sedan only achieved a four-star rating in the NHTSA rollover protection test, but that fault wasn't enough to keep the vehicle from earning a five-star designation overall.
The announcement doesn't mention the recent Consumer Reports claim that the ES comes with a faulty emergency trunk release that can be easily broken in a panic situation.
As you may recall, the 2013 ES 350 carries an MSRP of $36,100, plus an $895 destination fee and offers buyers a 268-horsepower 3.5-liter V6 good for 248 pound-feet of torque, as well. The ES 300h, meanwhile, stickers at $38,850 plus the same destination charge.

There is no more important model line to Lexus than the RX. Year to date, with a replacement on the way, the RX accounts for 28 percent of the brand's sales. It's the undisputed champ of the midsize luxury SUVs, nearly outselling BMW's entire SUV lineup. The 2016 RX represents the very best that Lexus is capable of, specifically when its spindle-shaped grille is pointed at its core audience. But overall interior space remains exactly the same at 139.7 cubic feet. Rear-seat passengers get extra space – head, hip, and legroom all nudge up slightly for 2016 – but it comes at the expense of cargo area, at least on paper. Whereas the 2015 RX offered as much as 80.3 cubic feet of storage space with the rear seats folded, the 2016 model cuts that by a quarter to 56.3 cubes. Lexus representatives say that cargo space is up, and the numerical reduction is due to different measurement methods. The 450h's cargo area is smaller by a negligible half cubic foot due to the location of the car's battery pack. The new RX looks seriously chiseled. RX buyers and their friends enjoying the more spacious back seat are going to look considerably more stylish in 2016. The new RX looks seriously chiseled, with sides creased and cut to the point that there's hardly any flat surfaces. It's hard to pick favorite details, but we really like the upward-kick of the rocker panel. At the front lives Lexus' ubiquitous spindle grille, more exaggerated than ever before and rimmed by a strip of thick chrome. If the floating roof looks familiar, that's because you've seen it on the Nissan Murano. Somehow the massive proportions of the trademark Lexus grille is not the most controversial styling element of the new RX.
