FCA seeking new trial in Jeep fire case, calls $150M judgement 'grossly excessive'

Fiat Chrysler Automobiles is fighting back after a Decatur County, GA jury ordered the company to pay $150 million to the family of a four-year-old boy that was killed after a 1999 Jeep Grand Cherokee crashed and caught fire. The company is requesting the judge reduce the award, and should Walden's family not agree to the lower sum, that a new trial be held. The Detroit Free Press reports that FCA would be forced to pay $120 million over the death of young Remington Walden, with an extra $30 million being paid to the boy's family. Neither figure sits well with the automaker, though, which called the fine "grossly excessive," and claimed it was in violation of Georgia state law. The judgment stems from FCA's long-running problem with the fuel tanks of certain Jeep models built in the 1990s and 2000s. According to the newspaper, FCA argues that the jury was biased after the Waldens' attorneys played on the their passions and pushed for a big award, saying the wrongful death award was 11 times more than any appeals court has ever upheld. FCA said attorneys for the plaintiffs told the jury to base the settlement on Sergio Marchionne's total compensation, $68 million. FCA also claims in its motion that the young boy's suffering was brief. "A $30-million pain-and-suffering award for what plaintiffs acknowledge was at most one minute of suffering is irrational," the motion, which was obtained by The Detroit Free Press, read. "Where such plainly improper arguments are immediately followed by irrational and stunningly excessive damage awards, there can be no doubt that the jury acted from passion and prejudice." Jim Butler, the attorney for the Waldens, has called the motion "nonsense," although he said the family will accept whatever figure the judge sets.

NHTSA investigating 2015 Jeep Cherokee after new owner's total-loss fire [w/video]

The National Highway Traffic Safety Administration has opened a Preliminary Evaluation into the 2015 model year Jeep Cherokee after a single example caught on fire in California. This investigation will decide the cause, scope and frequency of this possible problem and will decide whether a recall is necessary for 50,415 potentially affected examples. According to Automotive News, the Cherokee's owner only purchased the CUV about two days before the fire, and it had been driven less than 100 miles. The new buyer reported parking the Jeep, and noticed a smell like smoke. Shortly after, the vehicle was consumed in flames. There were no injuries, but much of the incident was captured on video. NHTSA is also trying to decide whether another report is related. In this case, a driver noticed smoke under the hood of a 2015 Cherokee with just 45 miles on it, while driving at 60 miles per hour. Updated 2014 Jeep Grand Cherokee ace same controversial moose test it failed in 2012 [w/video]

Some background: one of the more scandalous international incidents of he-said/he-said from 2012 was when Swedish magazine Teknikens Varld put the Jeep Grand Cherokee through its "moose (or elk) test" and reported that the SUV nearly rolled over. That lead to a whole lot of accusations and rebuttals: more than one website and Chrysler's own blog reported that the Jeep was overloaded; Chrysler said Teknikens printed the magazine then let Chrysler respond, Teknikens answered all of the charges in a lengthy post and said Chrysler was given a chance to comment before it went to print; when Chrysler sent investigators to oversee the test and the Jeep didn't go up on two wheels as it did in the first test, furthermore all four wheels stayed on the ground when Auto Motor und Sport tested a Grand Cherokee in the same way.
Teknikens then re-ran the test with a new vehicle and said it's been doing this test since the 1970s, uses the loading information that Chrysler provides to the Swedish motor authority and the previous Grand Cherokee passed with no problem. In the second test, the Jeep failed again, then it gave Chrysler engineers access to the car's electronics and ran the test again. In that second round the Grand Cherokee didn't repeat the lurid two-wheel action, but in eleven runs it blew out front left tire seven times. Chrysler still objects to the results of all of those tests and maintains that vehicle was safe.
The 2014 Grand Cherokee was given its shot at the gauntlet in the latest round of moose tests, and Teknikens Varld reports that it passed without any problem at all, its stability control working perfectly, controlling motion at low speeds and all the way up to 44.1 miles per hour.
