FCA seeking new trial in Jeep fire case, calls $150M judgement 'grossly excessive'

Fiat Chrysler Automobiles is fighting back after a Decatur County, GA jury ordered the company to pay $150 million to the family of a four-year-old boy that was killed after a 1999 Jeep Grand Cherokee crashed and caught fire. The company is requesting the judge reduce the award, and should Walden's family not agree to the lower sum, that a new trial be held. The Detroit Free Press reports that FCA would be forced to pay $120 million over the death of young Remington Walden, with an extra $30 million being paid to the boy's family. Neither figure sits well with the automaker, though, which called the fine "grossly excessive," and claimed it was in violation of Georgia state law. The judgment stems from FCA's long-running problem with the fuel tanks of certain Jeep models built in the 1990s and 2000s. According to the newspaper, FCA argues that the jury was biased after the Waldens' attorneys played on the their passions and pushed for a big award, saying the wrongful death award was 11 times more than any appeals court has ever upheld. FCA said attorneys for the plaintiffs told the jury to base the settlement on Sergio Marchionne's total compensation, $68 million. FCA also claims in its motion that the young boy's suffering was brief. "A $30-million pain-and-suffering award for what plaintiffs acknowledge was at most one minute of suffering is irrational," the motion, which was obtained by The Detroit Free Press, read. "Where such plainly improper arguments are immediately followed by irrational and stunningly excessive damage awards, there can be no doubt that the jury acted from passion and prejudice." Jim Butler, the attorney for the Waldens, has called the motion "nonsense," although he said the family will accept whatever figure the judge sets.

NHTSA investigates FCA for SUVs that roll out of Park

The National Highway Traffic Safety Administration is opening a preliminary evaluation into the 2014 Dodge Durango and 2014-205 Jeep Grand Cherokee after 14 complaints of the SUVs rolling out of Park. An estimated 408,000 of them could be affected, if a recall is necessary. All of the current complaints submitted to NHTSA about the issue concern the Grand Cherokee, and the claims allege that the SUV can roll out of Park whether or not the engine is running. Some folks report that they check the indicator each time because the gear sometimes fails to engage. Among the 14 cases, there are five accounts of crashes and three injuries, including a situation with someone allegedly being rolled over. NHTSA's preliminary evaluations are meant to investigate "the scope, frequency, and safety-related consequence" of a reported problem. They don't necessarily lead to a recall. NHTSA investigating why Jeep recall fix is taking so long

Jeep's saga with the National Traffic Safety Administration and the voluntary campaign to repair 1.56 million vehicles for allegedly unsafe trailer hitches, is getting yet another chapter. The controversy appeared to finally be over in January when the automaker found a supplier for the replacement parts. Nothing is ever that easy, though, and the government regulator is now requesting documents from the company to clarify why the repairs are taking so long to begin.
Jeep parent company Chrysler has until July 16 to submit documents and answers to NHTSA explaining the situation. The regulator claims that despite its compromise to inspect and repair the models with improper hitches in June 2013, Chrysler didn't find a part supplier until December and didn't order the replacements until January. The government agency believes that the first components weren't manufactured until May of this year and vehicles may not actually be repaired until as late as August. According to the report, if the Chrysler doesn't supply what NHTSA is asking for, the agency could "take additional appropriate action as warranted."
Throughout this entire process, Chrysler has asserted that the vehicles met the applicable crash test standards of the time, and it has kept NHTSA abreast of the repair activity. In a recently released statement it said that the regulator analyzed eight rear impact reconstruction tests and found the replacement hitch to be safe. To keep up with the high demand for replacements, Chrysler is working with multiple suppliers, and they are running three shifts, six days a week to get the parts ready as soon as possible.
