FCA seeking new trial in Jeep fire case, calls $150M judgement 'grossly excessive'

Fiat Chrysler Automobiles is fighting back after a Decatur County, GA jury ordered the company to pay $150 million to the family of a four-year-old boy that was killed after a 1999 Jeep Grand Cherokee crashed and caught fire. The company is requesting the judge reduce the award, and should Walden's family not agree to the lower sum, that a new trial be held. The Detroit Free Press reports that FCA would be forced to pay $120 million over the death of young Remington Walden, with an extra $30 million being paid to the boy's family. Neither figure sits well with the automaker, though, which called the fine "grossly excessive," and claimed it was in violation of Georgia state law. The judgment stems from FCA's long-running problem with the fuel tanks of certain Jeep models built in the 1990s and 2000s. According to the newspaper, FCA argues that the jury was biased after the Waldens' attorneys played on the their passions and pushed for a big award, saying the wrongful death award was 11 times more than any appeals court has ever upheld. FCA said attorneys for the plaintiffs told the jury to base the settlement on Sergio Marchionne's total compensation, $68 million. FCA also claims in its motion that the young boy's suffering was brief. "A $30-million pain-and-suffering award for what plaintiffs acknowledge was at most one minute of suffering is irrational," the motion, which was obtained by The Detroit Free Press, read. "Where such plainly improper arguments are immediately followed by irrational and stunningly excessive damage awards, there can be no doubt that the jury acted from passion and prejudice." Jim Butler, the attorney for the Waldens, has called the motion "nonsense," although he said the family will accept whatever figure the judge sets.

FCA is expanding its airbag software update for the 2014 and 2015 Jeep Cherokee to cover 68,593 more of the vehicles worldwide. This brings the total to 316,774 Cherokees. Of those, there are now 230,240 in the US, 28,110 in Canada, 6,367 in Mexico, and 52,057 outside of NAFTA. According to the automaker, after reviewing the potentially affected population, it discovered these additional Cherokees in need of the upgrade. The original campaign to repair these vehicles was announced in early February. Engineers found a small number of cases where dramatic changes to the angle of the vehicle that upset its balance caused the side-curtain and seat-mounted side airbags to deploy because they anticipated a rollover. This especially occurred when driving off-road. According to FCA, there're no additional reports of this happening, and the company isn't aware of any injuries or accidents. The fix is simply a software upgrade that recalibrates the airbags' deployment. 2.1 million vehicles recalled again over faulty airbags

Fiat Chrysler Automobiles, Honda and Toyota will recall 2.1 million vehicles to fix faulty airbag modules "after the manufacturers' original attempts to fix the defects proved ineffective in some vehicles." These vehicles had all previously been recalled, but the National Highway Traffic Safety Administration found that the airbags could still potentially malfunction. This recall will cover Acura MDX, Dodge Viper, Jeep Grand Cherokee, Honda Odyssey, Pontiac Vibe, Toyota Corolla, Toyota Matrix and Toyota Avalon models made in the early 2000s. NHTSA has reportedly received about 40 reports of airbag deployment in such vehicles, even though the vehicle had not been involved in a crash. Roughly one million of these same vehicles, all from Honda and Toyota, are also subject to recalls due to faulty Takata airbag modules, though this particular recall is for "an electronic component manufactured by TRW" that is separate from the actual airbags from Takata. According to NHTSA Administrator Mark Rosekind: "This is unfortunately a complicated issue for consumers, who may have to return to their dealer more than once. But this is an urgent safety issue, and all consumers with vehicles covered by the previous recalls should have that remedy installed. Even though it's a temporary solution until the new remedy is available, they and their families will be safer if they take the time to learn if their vehicle is covered and follow their manufacturers' instructions.
