Georgia judge slashes verdict to $40M in Jeep fire case

A judge in Georgia has drastically reduced the damages that Fiat Chrysler Automobiles will have to pay to the family of Remington Walden, who a court said died as a result of the unsafe design of one of its vehicles. While the jury originally awarded the family $150 million at FCA's expense, Judge J. Kevin Chason cut that amount to $40 million, the Detroit News reported. The automaker may still appeal the verdict. The case dates to March 2012, when a 1999 Jeep Grand Cherokee in which four-year-old Walden was riding was rear-ended by another vehicle. Due to what the jury ruled was an unsafe fuel tank, a fire erupted, and Walden died in the fire. The family's lawyers successfully argued that the automaker knew there was a problem and didn't take sufficient action to address the issue, while FCA countered that its vehicles met the applicable safety standards when they were built. The jury found FCA 99 percent responsible for the fire and Walden's death, reserving the final one percent for the driver who caused the crash. The court awarded the Waldens $150 million in damages to be paid by the automaker: $120 million for wrongful death, and a further $30 million for pain and suffering. FCA, however, argued that the damages were disproportionate to the incident, noting that the $120 million was 11 times higher and the $30 million four times higher than any comparable awards upheld on appeal in the state. Chason agreed and cut the penalties extensively. The Walden family has reportedly accepted the reduced verdict. But according to the News, company spokesman Michael Palese said, "The reduction in the damage awards does not cure the many errors that tainted this verdict and denied FCA US a fair trial. Updated 2014 Jeep Grand Cherokee ace same controversial moose test it failed in 2012 [w/video]

Some background: one of the more scandalous international incidents of he-said/he-said from 2012 was when Swedish magazine Teknikens Varld put the Jeep Grand Cherokee through its "moose (or elk) test" and reported that the SUV nearly rolled over. That lead to a whole lot of accusations and rebuttals: more than one website and Chrysler's own blog reported that the Jeep was overloaded; Chrysler said Teknikens printed the magazine then let Chrysler respond, Teknikens answered all of the charges in a lengthy post and said Chrysler was given a chance to comment before it went to print; when Chrysler sent investigators to oversee the test and the Jeep didn't go up on two wheels as it did in the first test, furthermore all four wheels stayed on the ground when Auto Motor und Sport tested a Grand Cherokee in the same way.
Teknikens then re-ran the test with a new vehicle and said it's been doing this test since the 1970s, uses the loading information that Chrysler provides to the Swedish motor authority and the previous Grand Cherokee passed with no problem. In the second test, the Jeep failed again, then it gave Chrysler engineers access to the car's electronics and ran the test again. In that second round the Grand Cherokee didn't repeat the lurid two-wheel action, but in eleven runs it blew out front left tire seven times. Chrysler still objects to the results of all of those tests and maintains that vehicle was safe.
The 2014 Grand Cherokee was given its shot at the gauntlet in the latest round of moose tests, and Teknikens Varld reports that it passed without any problem at all, its stability control working perfectly, controlling motion at low speeds and all the way up to 44.1 miles per hour. Jeep Liberty under investigation for door fires

The Jeep Liberty has already had plenty of attention for possible fires thanks to the first-gen model's fuel tank, but now the midsize Jeep is under the microscope of the National Highway Traffic Safety Administration for another fire-related concern. NHTSA has opened an investigation for the 2012 Liberty after receiving two reports of electrical fires in the driver's door.
According to the investigation summary, around 80,000 vehicles could potentially be affected by this problem. In both reported fires, the drivers noticed smoke and then flames from the master power window switch, and they had to pull to a stop and exit through the passenger side of the SUV. According to Autoguide, there was one injury to a motorist who suffered burned fingers while trying to open the driver's door.
Interestingly, the Dodge Nitro is not yet involved in this investigation, even though it was still around for the 2012 model year; the Nitro ended production in 2011 about a year before the final Liberty rolled off the line for the 2013 model year.
