Georgia judge slashes verdict to $40M in Jeep fire case

A judge in Georgia has drastically reduced the damages that Fiat Chrysler Automobiles will have to pay to the family of Remington Walden, who a court said died as a result of the unsafe design of one of its vehicles. While the jury originally awarded the family $150 million at FCA's expense, Judge J. Kevin Chason cut that amount to $40 million, the Detroit News reported. The automaker may still appeal the verdict. The case dates to March 2012, when a 1999 Jeep Grand Cherokee in which four-year-old Walden was riding was rear-ended by another vehicle. Due to what the jury ruled was an unsafe fuel tank, a fire erupted, and Walden died in the fire. The family's lawyers successfully argued that the automaker knew there was a problem and didn't take sufficient action to address the issue, while FCA countered that its vehicles met the applicable safety standards when they were built. The jury found FCA 99 percent responsible for the fire and Walden's death, reserving the final one percent for the driver who caused the crash. The court awarded the Waldens $150 million in damages to be paid by the automaker: $120 million for wrongful death, and a further $30 million for pain and suffering. FCA, however, argued that the damages were disproportionate to the incident, noting that the $120 million was 11 times higher and the $30 million four times higher than any comparable awards upheld on appeal in the state. Chason agreed and cut the penalties extensively. The Walden family has reportedly accepted the reduced verdict. But according to the News, company spokesman Michael Palese said, "The reduction in the damage awards does not cure the many errors that tainted this verdict and denied FCA US a fair trial. Off-roader plows through a deep bog like it was nothing

The Facebook page Jeeps With Attitude runs a weekly series called Too Deep Tuesday wherein they post videos of off-roaders running their rigs through bogs and mud holes of surprising depth and coming out the other side soggy but relatively unscathed. This week's video, in which a driver extracts a buried vehicle from the muddiest bog in the land, is the perfect mix of nutso bravery and off-road know-how. The video starts with the vehicle already sunk to its hood and listing to starboard in a deep, sticky bog. Slowly but surely, the vehicle creeps forward through the mud, pushing a heavy bow wave of muck and debris in front of it. Unlike other recent videos where jeep drivers lost their rides in the water and destroyed their expensive toys, this driver keeps his cool and with a steady foot on the accelerator and the help of a winch and a convenient tree, eventually emerges triumphant. What did he do right? Well, using the vehicle's winch to help pull the rig out of the mud was the big thing. Also, he kept his cool and, once committed, never hesitated or deviated from his chosen path. Gunning it blindly or backing up in that mess would have meant almost certain death for that vehicle, a lesson that the aforementioned Jeep drivers learned the hard way. Updated 2014 Jeep Grand Cherokee ace same controversial moose test it failed in 2012 [w/video]

Some background: one of the more scandalous international incidents of he-said/he-said from 2012 was when Swedish magazine Teknikens Varld put the Jeep Grand Cherokee through its "moose (or elk) test" and reported that the SUV nearly rolled over. That lead to a whole lot of accusations and rebuttals: more than one website and Chrysler's own blog reported that the Jeep was overloaded; Chrysler said Teknikens printed the magazine then let Chrysler respond, Teknikens answered all of the charges in a lengthy post and said Chrysler was given a chance to comment before it went to print; when Chrysler sent investigators to oversee the test and the Jeep didn't go up on two wheels as it did in the first test, furthermore all four wheels stayed on the ground when Auto Motor und Sport tested a Grand Cherokee in the same way.
Teknikens then re-ran the test with a new vehicle and said it's been doing this test since the 1970s, uses the loading information that Chrysler provides to the Swedish motor authority and the previous Grand Cherokee passed with no problem. In the second test, the Jeep failed again, then it gave Chrysler engineers access to the car's electronics and ran the test again. In that second round the Grand Cherokee didn't repeat the lurid two-wheel action, but in eleven runs it blew out front left tire seven times. Chrysler still objects to the results of all of those tests and maintains that vehicle was safe.
The 2014 Grand Cherokee was given its shot at the gauntlet in the latest round of moose tests, and Teknikens Varld reports that it passed without any problem at all, its stability control working perfectly, controlling motion at low speeds and all the way up to 44.1 miles per hour.
