Nissan files civil suit against Ghosn, seeking $91 million in damages

TOKYO — Nissan filed a civil suit Wednesday seeking 10 billion yen ($91 million) in damages from the Japanese automaker's former Chairman Carlos Ghosn. Nissan filed the case in Yokohama District Court to recoup some of the monetary damages suffered, it said, “as a result of years of misconduct and fraudulent activity" by Ghosn. The claim was calculated by adding the costs from what Nissan called Ghosn's “corrupt practices,” such as rent for overseas property, use of corporate jets and payments to Ghosn's sister, as well as costs for the internal investigation into Ghosn's alleged wrongdoings. Representatives of Ghosn said in a statement they couldn't comment as they had yet to see the legal documents. “Nissan's maneuvers continue,” they said, while noting Nissan had claimed larger damages before. Ghosn, who led Nissan for two decades and saved it from near-bankruptcy, was arrested in Japan in November 2018, and charged with underreporting his future compensation and breach of trust in diverting Nissan money for personal gain. He was awaiting trial but skipped bail and showed up in Lebanon late last year. Japan has no extradition treaty with Lebanon, and he's unlikely to be arrested. A date had not been set for his trial, and Ghosn has said he was worried his ordeal would never end and he would not get a fair hearing. The bail conditions also barred him from seeing his wife. He has repeatedly lashed out at Japan's judicial system, where the conviction rate is higher than 99%. Japanese authorities recently issued an arrest warrant for Ghosn and three Americans, accused of helping his escape. Separately, they issued an arrest warrant for Ghosn's wife on suspicion of perjury. Ghosn has repeatedly said he is innocent, saying that the promised compensation had never been decided, and all the payments were for legitimate services. Wednesday's lawsuit by Nissan comes on top of the civil case Nissan filed against Ghosn in the British Virgin Islands in August last year. It alleged unauthorized payments, sought to regain a luxury yacht and pursued other damages, according to Nissan. Yokohama-based Nissan, which makes the Z sportscar, Leaf electric car and Infiniti luxury models, is also facing trial in Japan as a company in relation to Ghosn's scandal. It has indicated it will agree to any penalties. Nissan's reputation has been sorely tarnished over the Ghosn fiasco, and its sales have dropped. Nissan reports financial results Thursday.

Infiniti electric crossover will mark a milestone at Detroit Auto Show

In November, it was announced that both Nissan and Infiniti will display EV concepts at the 2019 North American International Auto Show in Detroit, taking place in January. Previously, it wasn't made clear what kind of vehicles they would be, but Infiniti stated today that its Detroit concept will be an electric crossover. Both the Nissan and Infiniti concepts will continue the design direction shown by Infiniti's Q Inspiration concept, and later next year, there will be stylistically similar cars shown at the Tokyo Motor Show in October. The luxury brand has released the above teaser photo of the crossover, depicting sharp headlights and a lit grille outline surrounding the badging. We can also see large wheels and tires and sizeable, defined wheel arches. Future Infinitis will be electrified from 2021 on, featuring either serial hybrid tech or full electric drivetrains. Serial hybrid refers to using Nissan's e-power technology, which relies on range extender engines instead of a large combustion engine (such as Infiniti's lauded VC-Turbo). The Detroit Auto Show is also a significant event for Infiniti, as the brand and its first car, the grille-less Q45 luxury sedan, was first displayed 30 years ago at the 1989 NAIAS. "Thirty years ago, as a 24-year-old designer in the audience, I saw the birth of Infiniti in person and am proud to be part of the journey of creating iconic luxury automobiles," said Nissan's senior vice president for global design, Alfonso Albaisa. Meanwhile, Infiniti's November 2018 sales were the best November numbers in the brand's history. "The concept car we will show in Detroit is the beginning of a new era for Infiniti, and an illustration of where we want to go with the brand," said Karim Habib, Infiniti's design director. Earlier, Albaisa echoed his statements, telling us how electrification can inspire the brand's future design thanks to the battery packs' size development, saying: "It's getting denser, it's getting thinner, the cars are able to get a little bit bigger, more space, we can really do much more." One crucial change to the 2016 Infiniti QX50 (formerly known as the EX35) may have just made the company's smallest crossover suddenly relevant. So how does one add appeal to an eight-year-old model, without any significant cosmetic or powertrain updates? By addressing its biggest flaw head-on: size. For the 2016 model year, Infiniti has stretched the QX50's wheelbase by 3.2 inches, and the crossover is now 4.5 inches longer overall. In addition to a roomier cabin – 8.3 cubic feet more to be exact – there's one number that sticks out above all else: four more inches of knee- and leg-room in the back seats. Like scoring an exit-row seat on your flight, the extra space may be just enough to change the experience. So how can the upmarket Japanese automaker justify costly changes to the platform when it's only moving 250 of these vehicles in the US per month? Americans can thank the Chinese for that. As in the US, sales of small crossovers are quickly rising in China – a country where being chauffeured is more common for those of means – and rear-seat passengers who can pay for a driver don't want to feel like they're sitting in the penalty box. The platform-sharing economics work, and in this case, everyone stands to benefit. Pricing is reduced by $500 from last year, with the rear-wheel-drive 2016 QX50 now starting at $35,445 after delivery. Infiniti says it considers the Acura RDX and Lexus NX as the QX50's direct competition, but it's worth noting that both of those competing models sell more in just one month than Infiniti's smallest crossover sold all of last year. The QX50 isn't likely to reach its competitor's levels anytime soon, but Infiniti hopes the roomier iteration will pique shopper interest. To help that cause, the 2016 model gets a few light cosmetic touches too. Up front it receives a new grille that's more in line with the brand's current design language, new LED fog and daytime running lights, new door mirrors with LED turn signals, revised side sills, and a new rear bumper. Beyond aesthetics, pricing is reduced by $500 from last year, with the rear-wheel-drive 2016 QX50 now starting at $35,445 after delivery. The all-wheel-drive version adds another $1,400 to that price. All models get more standard equipment, including a power moonroof, heated front seats, and the new LED accents. Inside the cabin, things look much as they did when the crossover first debuted as the EX35, back in 2007.
