Judge reduces damages in fatal Hyundai crash to $81M

Hyundai no longer has to pay $248 million as part of a court ruling from a fatal accident in Montana that killed two cousins in a 2005 Tiburon. The judge hearing the appeal revised the amount down to a total of about $81 million. She upheld the original $8.1 million in actual damages but reduced the punitive damages to $73 million from the previous $240 million.
According to Bloomberg, the judge refused Hyundai's desire to reduce the amount even further. She said in her court order that the company showed "an indifference to or reckless disregard of the health and safety of the motoring public."
In the original case, the families' attorneys alleged that the cracking of a faulty steering knuckle caused the fatal accident. Hyundai argued that fireworks had been let off inside the vehicle, which caused the driver to swerve and crash. In a statement released after the ruling, the automaker claimed that evidence supporting its defense was barred from the trial. According to Bloomberg, had the original amount of damages been upheld, it would have been the sixth-highest amount awarded by a jury in the US this year.

First hydrogen Hyundai Tucson Fuel Cell CUVs arrive in California

These crossovers are not available in showroom quite yet, but the first batch of Hyundai Tucson Fuel Cell vehicles has made it to California. Hyundai is promising retail availability, "within the next several weeks," which means early June or so for the $499/month CUVs. We previously heard in January that these hydrogen-powered Tucsons were supposed to be in US customers' hands by the end of March, so things are running behind schedule. Still, the delivery at a port near Los Angeles marks the "first delivery of a mass-produced fuel cell vehicle for the US market," Hyundai says, which could be a big deal when we look back at the evolution of hydrogen-powered vehicles in the US (though we're guessing at least one other manufacturer might object to the Korean automaker's claim). Mike O'Brien, vice president, corporate and product planning for Hyundai Motor America, is certainly upbeat, saying in a statement that Hyundai is "proud of our leadership role in this important segment of the alternative fuel vehicle market." So far, that's a segment that the company has almost all to itself. There are a very small number of hydrogen vehicles around today, including the Honda FCX Clarity and a few test vehicles from other automakers, but the numbers are set to grow next year when Toyota and Honda introduce new hydrogen sedans. For now, though, Hyundai can make a splash simply by bringing these vehicles to our shores. Porsche, Jaguar continue dominance in 2015 JD Power APEAL study

The top of JD Power's 2015 APEAL Study has not changed much in the last year. Porsche remains No. 1 with Jaguar nipping at its heels, although both premium brands saw their overall score fall compared to 2014. For those that need a refresher, the APEAL Study looks at how "gratifying" a vehicle is to own and drive, rating cars and brands on a 1,000-point scale. The industry average for 2015 has increased from 794 to 798, while the total number of automakers that finished above the curve increased from 16 to 20. While Porsche and Jaguar finished at the top, their scores dropped eight and seven points, respectively, to 874 and 855. The top "non-premium" brand was Mini, which scored an impressive 825, up from 795. If the BMW-owned British marque is still a bit too premium for your tastes, last year's non-premium winner, Hyundai, did climb five points and is this year's runner up. At the opposite end of the scale, Smart sits at the very bottom of the rankings, with a score of 683 (it didn't appear on the 2014 rankings). Fiat also dropped, from fourth worst in 2014 to second worst in 2015, despite the 500 being named most appealing city car. Subaru made an impressive climb, from third worst to seventh, falling just 10 points shy of the industry average and two points south of the non-premium average. In the individual vehicle segments, eight brands earned multiple awards, with Ford, Chevrolet, and Porsche earning three apiece. Surprise segment victories included the new Ford Expedition, which beat out Chevy's popular Suburban. The Infiniti QX80 bested the likes of the Cadillac Escalade and Range Rover for best large luxury SUV, and the Dodge Challenger beat its muscle car rivals from Ford and Chevy. Most of the victories, though, were quite predictable. The Mazda6 and CX-5 took wins for the midsize sedan and compact SUV categories respectively, while the Volkswagen Golf captured the compact car win. The Ford F-150 won the large pickup category, while the Porsche Cayman was named most appealing compact premium sporty car.
