Hyundai To Fight $248 Million Judgment Over Fatal Montana Crash

A Montana jury has levied a $248 million ruling against Hyundai in the case of a crash that killed two occupants in July 2011. The automaker plans to appeal the ruling. Cousins Trevor and Tanner Olson were driving a 2005 Hyundai Tiburon when they hit another vehicle head-on. According to lawyers representing their family, the steering knuckle on the car cracked and this allegedly caused it to lose control. Hyundai claimed that fireworks had been let off inside the vehicle, which caused the driver to swerve. The company alleges that evidence that could have proved its innocence was barred from the case. The jury found in favor of the family and awarded them about $8 million in damages after a two-week trial. It claimed that Hyundai had shown "actual malice," according to Reuters. The jurors also slammed Hyundai with a further $240 million in punitive damages. Hyundai told Reuters that it plans to appeal immediately and called the verdict "outrageous." Statement by Hyundai Motor America While a tragic accident, Hyundai firmly believes the jury's verdict in Olson vs. Hyundai is mistaken and award of damages at three times what was sought by the plaintiffs is outrageous and should be overturned as Hyundai is not at fault. Eyewitness testimony established – and experts for both sides agree – that fireworks exploded in the unbelted teenagers' vehicle immediately before the July 2, 2011 accident, which involved the driver losing control, crossing the median and crashing head-on into an oncoming Pontiac at a closing speed of approximately 140 miles per hour – a speed confirmed by experts for both sides. Hyundai believes the jury's view of the evidence was distorted by a series of erroneous rulings by the Court, the most egregious of which prevented the jury from reviewing performance testing conducted by renowned failure analysis experts that would have disproven the plaintiffs' theory of the case – a theory derived by a local resident with no previous automotive experience. Next up on the hot-button list of things that can kill you behind the wheel: "highway hypnosis." That's the zombie-like, autopilot phase you get into on a long highway drive when there isn't much to distract you, like curves or traffic. Digging further into what it is and how to combat it, Hyundai-Kia engineers and the University of Michigan are commencing a study that will measure brainwave activity in order to track the body's slide into highway hypnosis.
We're not sure how much overlap this has with Mercedes-Benz's Attention Assist, which tracks more than 70 in-car parameters to determine when you're not focused on the road anymore. That system is billed as an alarm against fatigue, in our experience it does more than that - if you use your phone while driving, for instance, it will chirp.
They don't know what form a warning system will take yet, but Hyundai-Kia plans to develop a method for warning drivers when they being to zone out. According to the National Highway Traffic Safety Administration, there were more than three thousand deaths and nearly 400,000 injuries due to distracted driving in 2011.

Sonata, Elantra driving down Hyundai quality scores

Hyundai was the butt of many jokes in the auto industry when it first entered the US market, but since then, it has forged ahead and built cars that stand with the best in their respective segments. The 2011 Sonata and 2011 Elantra were seen as the apotheosis of the brand's forward progress when they were introduced, but falling J.D. Power and Associates Dependability Study results may actually cause them to hurt the company's hard-earned reputation.
J.D Power's study examines three-year-old vehicles for problems per 100 vehicles. Since the 2011 study for 2008 model year cars, Hyundai has fallen from 10th overall with 132 problems to 27th in the 2014 survey of 2011 model year vehicles with 169 problems. It was also Hyundai's second consecutive year of an increase in reported problems. According to Automotive News, many of these problems are due to faults with the Sonata and Elantra, but J.D. Power didn't identify specifically what issues caused Hyundai's dependability to tumble so far down the list. However, the study found that, on average, reliability fell throughout the industry for the first time since 1998.
Getting the Sonata and Elantra right are vital to Hyundai. In 2013, they were the company's best-selling cars. "We'll be closely going through the data to see where improvements need to be made. Hyundai's goal is nothing short of quality leadership, and the report shows we have work to do," Hyundai spokesperson Jim Trainor said in an email to Autoblog.
