Hyundai To Fight $248 Million Judgment Over Fatal Montana Crash

A Montana jury has levied a $248 million ruling against Hyundai in the case of a crash that killed two occupants in July 2011. The automaker plans to appeal the ruling. Cousins Trevor and Tanner Olson were driving a 2005 Hyundai Tiburon when they hit another vehicle head-on. According to lawyers representing their family, the steering knuckle on the car cracked and this allegedly caused it to lose control. Hyundai claimed that fireworks had been let off inside the vehicle, which caused the driver to swerve. The company alleges that evidence that could have proved its innocence was barred from the case. The jury found in favor of the family and awarded them about $8 million in damages after a two-week trial. It claimed that Hyundai had shown "actual malice," according to Reuters. The jurors also slammed Hyundai with a further $240 million in punitive damages. Hyundai told Reuters that it plans to appeal immediately and called the verdict "outrageous." Statement by Hyundai Motor America While a tragic accident, Hyundai firmly believes the jury's verdict in Olson vs. Hyundai is mistaken and award of damages at three times what was sought by the plaintiffs is outrageous and should be overturned as Hyundai is not at fault. Eyewitness testimony established – and experts for both sides agree – that fireworks exploded in the unbelted teenagers' vehicle immediately before the July 2, 2011 accident, which involved the driver losing control, crossing the median and crashing head-on into an oncoming Pontiac at a closing speed of approximately 140 miles per hour – a speed confirmed by experts for both sides. Hyundai believes the jury's view of the evidence was distorted by a series of erroneous rulings by the Court, the most egregious of which prevented the jury from reviewing performance testing conducted by renowned failure analysis experts that would have disproven the plaintiffs' theory of the case – a theory derived by a local resident with no previous automotive experience. Hyundai will seek an immediate appeal. A man has created a graph of Tesla Model S battery degradation over time. Merijn Coumans of Holland is tracking the owner data gathered on from Model S owners in a single file and graphing it visually. Coumans continually updates the graph of drivers' maximum ranges to give a look at battery degradation over the life of the car. US plug-in vehicle sales are expected to surpass 300,000 when the data is tallied at the end of this month. That is 30 percent of President Obama's goal of 1 million battery electric cars and plug-in hybrids by the end of 2015. Energy Secretary Ernest Moniz admitted the US won't reach the goal, saying, "We're going to be a few years after the president's aspirational goal of the end of 2015, but I think that we are within a few years of reaching that goal." Hyundai and Kia will give up unused patents to automotive startups focused on fuel cells at a recently launched innovation center in Gwangju. "Hyundai Motor will offer substantial assistance in the whole process of corporate growth ranging from the development of ideas to industrialization to making inroads into global markets," says South Korea's President Park Geun-hye. Set to be built along the Thames embankment, the system of cycling lanes could help encourage more people to ride their bikes, reducing automotive traffic congestion and relieving pressure on other transit networks. Kansas and Nebraska are joining the challenge against the EPA's new ethanol emissions rules. The EPA's Moves2014 regulations seek to reduce automotive sulfur emissions by 60 percent, but, says Kansas Attorney General Derek Schmidt, the ethanol emissions measurement model is faulty and was adopted without public comment or review.

Tesla is inviting owners on "Electric Road Trip" events on four continents. To celebrate the 2.5 billion electric miles Tesla owners have logged, the automaker is hosting a series of open house events at Destination Charger locations (think hotels and resorts) in various cities across North America, Australia, Asia, and Europe. Attendees will "have the opportunity to swap stories and share your favorite road trip experiences with fellow Tesla owners and like-minded fans," according to Tesla, as well as enjoy local food and drinks. Google has published its most recent autonomous vehicle testing results, this time with regard to sharing the road with cyclists. The system is programmed to predict when a cyclist will swerve around an open car door, leave room for cyclists during passing and other situations, recognize and remember cyclist had signals, and recognize a variety of bike styles – even unicycles. The report also lists two minor collisions with other vehicles in June, both occurring in Austin, Texas. In one instance, another car swerved into the Google car's lane. For the second phase of the fuel cell confirmation program, Hyundai will provide the DOE with a number of its Tucson Fuel Cell crossovers for daily use in Northern California, Washington, D.C., Denver, and Michigan.
