Hyundai Kia asked to pay $28.9M in patent infringement case

After years of litigation, Hyundai and Kia have lost their hybrid technology patent infringement case against Paice LLC. The jury ordered the South Korean automakers to pay $28.9 million, but according to Bloomberg, because the violation was allegedly intentional, the judge could triple that amount. The automakers have announced plans to appeal the ruling. Paice's patent dates from 1994 on a piece of tech called the Hyperdrive, and it was a way to seamlessly switch between power from an electric motor and an internal combustion engine. This lawsuit was first filed in 2012 and covered the systems in the Hyundai Sonata Hybrid and Kia Optima Hybrid. According to Bloomberg, the companies tried to argue that the patent was no longer valid, but the strategy failed. "Hyundai strongly believes its position and will appeal any remaining adverse findings to the Federal Circuit," the company said in a statement to Autoblog. Paice is certainly no stranger to litigating over the Hyperdrive patent, though. It and Toyota had a similar court battle that lasted years. Eventually, there was a settlement, and the result was Paice getting royalties for each hybrid that the Japanese automaker sold. Similarly, there's a lawsuit pending against Ford over tech in the C-Max, Fusion, and Lincoln MKZ. Hyundai Statement: Hyundai believes that the verdict returned by the jury today in the matter of Paice v. Hyundai Motor Company et al., is not supported by the evidence. Accordingly, Hyundai has requested that the presiding judge enter a judgment in its favor notwithstanding the verdict. Hyundai strongly believes its position and will appeal any remaining adverse findings to the Federal Circuit.

NHTSA investigating 8 million airbags not made by Takata

In a shocking turn of events, we have a line of airbags under investigation that weren't made by Takata. Rather, Automotive News reports that 8,000,000 airbags made by ARC Automotive Inc. are under investigation by the National Highway Traffic Safety Administration (NHTSA). According to Automotive News, NHTSA is looking into ARC's airbags after two injuries and a recent death were attributed to the company's products. The two injuries occurred first and prompted the initial inquiry of 490,000 airbags, which then expanded after an airbag from a different line caused the death of a Canadian driver. The airbags in question are found in GM, FCA, Hyundai and Kia products, and all automakers are cooperating with the investigation, Automotive News reports. It is also important to note that these airbags have not been recalled, as NHTSA is trying to determine the issue and whether a recall is necessary. NHTSA also told the news outlet that the ARC inflators use a different design than those from Takata, instead using some pressurized gas and an ammonium nitrate charge. While the design may be different, the Takata inflators also used ammonium nitrate propellant, which other manufacturers have avoided. We will be watching this situation closely to see what develops. Here's hoping – for our collective safety and sanity – that we won't have to go through another airbag crisis like with the Takata recall. Hyundai readying Juke rival with 'edgy, dynamic styling' for 2017

Love it or hate it, the Nissan Juke has drawn attention to itself and to its maker. Little wonder, then, that Hyundai wants to follow a similar formula.
According to our compatriots over at Edmunds, Hyundai has a whole raft of new products in the works - as you'd expect from the world's fourth-largest automaker - including replacements for the current Tucson and Elantra sometime next year, but also a subcompact crossover to target the Juke, not to mention tiny softroading rivals like the forthcoming Chevrolet Trax. Details at this point are few and far between, but it appears Hyundai is committed to making it as zany as the Nissan it will target. The Korean automaker revealed the Curb concept (pictured above) along similar lines at the 2011 Detroit Auto Show.
Hyundai Motor America CEO Dave Zuchowski tells Edmunds not to expect a mini Tuscon, but to "Think of maybe something that looks like a Juke or something that has edgy, dynamic styling." Considering how off-the-map Hyundai went with the Veloster and its unconventional array of doors, we know the Korean automaker can think outside the box for this Gen-Y crossover. Whether the edge tiny CUV market has space for more than the Juke, however, is another matter. One way or another, look for the tiny Korean crossover to arrive sometime in 2017.
