Court puts kibosh on apartheid lawsuit against Ford, Daimler

Ford and Daimler have scored a major victory in a long-running lawsuit filed in US federal court by unnamed South African nationals. The suit alleges that both manufacturers and their subsidiaries sold their vehicles to the South African military, despite knowing that they'd be involved in violently putting down anti-apartheid protesters.
According to Reuters, South African plaintiffs filed the case under the 223-year-old Alien Torts Statute, a law which allows foreign nationals to file charges in US courts for perceived breaches of what was originally international law, but now more closely relates to violations of human rights.
And while the case - which also involves computer manufacturer IBM - has been tied up in federal courts for years, a recent case from the Supreme Court struck down a similar suit against Royal Dutch Petroleum (Shell), arguing that the ATS doesn't apply to corporations or to conduct if it occurred outside the US. In short, the law applies to individuals, but not corporations like Ford or Daimler. A US appeals court ruled that the conditions apply in this case, potentially drawing this long-running saga to a close, as the defendants will now be allowed to request that the case be dismissed in district court.

Johnson Controls executive Brian Kesseler isn't likely to get any holiday presents this year from Nissan chief Carlos Ghosn or Tesla Motors head Elon Musk, but lots of other folks might be happy with what he has to say about automakers' efforts to reach stricter fleetwide fuel-economy standards. Speaking at the Automotive News World Congress, Kesseler said automakers wouldn't need to sell an extensive number of plug-in vehicles in order to meet the 54.5 mile per gallon Corporate Average Fuel Economy (CAFE) standard the US government set in 2012 for 2025 model-year vehicles. In fact, he said, components such as stop-start engine technology, turbochargers and direct injection may actually do the trick. Already, things like smaller engine sizes and lighter cars are already playing major roles in spurring fuel-efficiency gains. Of course, Johnson Controls sells batteries specially built for stop-start systems, so Kesseler does have a bit of skin in this game. The 54.5-mpg CAFE standard equates to about a 40-mpg "real world" fuel-efficiency level. To put that into perspective, the Environmental Protection Agency (EPA) said in a report late last year that model-year 2013 average fuel economy was an even 24 mpg. That was up from 23.6 mpg for the 2012 model year and 22.4 mpg for 2011. eBay Find of the Day: 1987 Ford Thunderbird Turbo Coupe is showroom fresh

There's an ultra-rare Ford Thunderbird for sale on eBay, although it's not quite the T-Bird you're probably thinking. This is a 1987 Thunderbird Turbo Coupe, complete with a five-speed manual transmission and just a shade over 13,000 miles on the clock. The condition is said to be mint, and judging by the interior and exterior pictures, we're inclined to believe the seller. The paint is glossy and the interior looks showroom new, while the underbody is stunningly clean for a 36-year-old car.
Underhood sits a 2.3-liter, intercooled and turbocharged four-cylinder (also found in the Mustang SVO) that was producing 190 horsepower when it left the factory. Inside, the five-speed manual transmission adds to the car's rarity. The vehicle's sole owner has been as immaculate with the paperwork as he has with the rest of the car - it's all there, including brochures and other product material.
The eBay auction ends tomorrow at midnight (9:00 PM if you're on America's west coast). Bidding has reached $10,200, and there's still plenty of time to get in on this future classic. The vehicle is located in Millstone Township, NJ.
