Ford sued by Versata over alleged software trade secret theft

Automakers are routinely subject to intellectual property and patent disputes, whether over design similarities or pieces of tech. Ford is now facing a lawsuit for alleged IP theft over a piece of software from a company called Versata, and the business wants $1 billion from the Blue Oval for the violation. With such huge amount of money at stake, the legal situation is already getting complicated. According to The Detroit Free Press, Versata's software is designed to help automakers improve product development by making sure all of a car's countless components work together. The company and Ford had a contract for the system for many years, and they were negotiating an extension at the end of 2014. However, the deal fell through, and the Blue Oval ended the two business' arrangement. Making the legal situation especially tricky is that Ford developed and patented its own software for the same task. The automaker then filed a lawsuit in Michigan to have the court check whether the program violated Versata's IP, according to The Detroit Free Press. Later, the software company registered a lawsuit in Texas and alleged the Blue Oval stole proprietary code. Versata has asked for an injunction against Ford and restitution. "Ford's patented software does not use or infringe any Versata intellectual property and Versata has provided no basis for their claims against us," the automaker said in a statement to Autoblog. "We are confident that we will ultimately prevail in this case and we look forward to the opportunity to present our evidence at trial." With both sides in dispute, that leaves Ford pushing for a hearing in Michigan and Versata for Texas. According to The Detroit Free Press, it could be at least a year before a trial, if not longer. Of course in the meantime, the two sides could conceivably reach a settlement, and the whole issue would disappear.

Swedish car mag says Ford Mondeo is dangerously, illegally overweight [w/video]

Sweden's Teknikens Varld has a reputation for being very persnickety when it comes to auto safety testing, and its latest catch is the Mondeo Titanium Estate 2.0 TDCi 150 bhp S6 MPS (basically a station wagon variant of the Fusion). In addition to the model's mile-long name, it has another problem according to the Swedes, because its weight on the scales does not equal the official numbers for the vehicle. Teknikens Varld claims the wagon is dangerously overweight because it weighs in 4,145 pounds, while Ford officially lists its weight at 3,530 pounds. That 615-pound disparity means that if a family loads it to what they think is the model's gross vehicle weight, it will actually be too heavy, and therefore illegal to drive in Sweden. According to the magazine, when it tried doing this, the rear wheels scraped against the wells, and the estate failed the mag's legendary moose test. However, at 220 pounds over the limit, it passed the test. When reached for comment by Autoblog, Jay Ward, Senior Manager at Ford of Europe Product Communications, explained the reason for the deviation between the official numbers and the magazine's test: "We are aware of this, but this is not an issue that relates specifically to the safety of the Mondeo, but is in fact related to the way in which the cars are tested by the authorities. We provided an Ambiente model for the testing but the car that featured in the magazine test was a Titanium model which has a different weight. We are in discussion with the Swedish Transport Agency to change the framework so the real weight of the Titanium model is reported instead of the Ambiente model which will resolve the issue." Teknikens Varld is well-known for calling out automakers for perceived transgressions. Most recently it leveled criticisms against the all-wheel drive system in the Honda CR-V, and both the Jeep Grand Cherokee and Porsche Macan failed its moose test. Domestic manufacturers enjoyed a good year for heavy-duty pickup sales in 2012. PickupTrucks.com has taken a close look at exactly how those sales broke down between each manufacturer and between three-quarter and one-ton pickups. Ford sold some 67,786 F-250 Super Duty models last year with the Chevrolet Silverado 2500 HD falling just behind at 56,359 units. The Ram 2500 HD came in third at 41,918, while the GMC Sierra 2500 HD earned itself fourth place with 27,616 deliveries. While Ford held onto the top spot in the one-ton market, Ram easily nailed down second place by selling more 3500 HD models last year than General Motors sold Silverado 3500 HD and Sierra 3500 HD trucks combined.
So, did GM manage to sell more trucks than Ford with its two brands? Very nearly. Ford sold a total of 119,338 heavy-duty pickups to GM's 111,555. Ram, meanwhile, moved a distant 77,583.
