Former Chrysler dealers could reopen under appeals court ruling

Years after the bankruptcies and subsequent bailouts of Chrysler (now FCA) and General Motors, the automotive industry is still seeing legal decisions about them come through the courts. The latest ruling from a US appeals court has given 4 of the 789 dealers that Chrysler closed in its Chapter 11 process one less hurdle towards reopening. Following the bankruptcy, 105 of the shuttered dealers went through an arbitration process in hopes of reopening, and 32 won their arguments. However, a victory in that undertaking didn't necessarily mean that the stores could reestablish themselves. For these three showrooms in Michigan and one in Las Vegas, state laws allowed nearby competitors from the same automaker to stand in the way of restarting, according to Automotive News. This problem brought yet another lawsuit, and a US district court found that the arbitration decisions did not overrule state laws. The latest appeals court ruling overturned that decision. However, as with many legal proceedings, the process for reopening for these dealers still isn't exactly easy. The latest decision only covers the nearby dealers' ability to protest; it doesn't mandate FCA actually to open the stores again. According to a statement from Michael Palese of FCA legal communications to Automotive News, the ruling, "did not provide for reinstatement of the dealers who prevailed in arbitration, but only gave them a right to a 'customary and usual' letter of intent." It means for these showrooms to start selling again, now they need to work things out with Chrysler's new owner.

Weekly Recap: Ferrari pens a provocative F1 car of the future

Scuderia Ferrari unveiled its vision of the future for Formula One this week, revealing sketches of a sleek, muscular racecar. Called the Concept F1, Ferrari is showcasing the design to start a conversation about the next generation of Formula One cars and spur interest in the sport, which has been maligned for its unattractive racecars in recent years. The Concept F1 was penned by the company's in-house studio, Centro Stile Ferrari, with input from its aerodynamics department. Though the sketches look futuristic, the company says the design could be executed without changing F1 regulations. From its beginning, Ferrari's racecars have had both form and function, winning on the track and turning heads with everything from the 250 Testa Rossa, 330 P3, Michael Schumacher's single-seaters from the early 2000s and many others. That lineage led the Scuderia's leaders to survey the paddock, wring their hands and come up with the Concept F1. As Ferrari said on its website: "Our challenge was to create something that was – to put it short – better looking." It's a philosophy that was implemented for this season's car, the SF15-T. While not groundbreaking in appearance, Ferrari cleaned up the design, particularly up front, and the racecar now has a more attractive nose that delivers better aerodynamics. It's more of the same in back, where a tighter design creates more downforce. "This year's car is certainly an awful lot better looking than last year's car," Ferrari technical director James Allison said in a video on the Scuderia's website. The updates come as Ferrari, and all F1 teams, get a better handle on the extensive 2014 rule changes that brought back turbocharged engines and altered the aerodynamic regulations for the series. Less dramatic changes also are going into effect this year. Ferrari, which is coming off a disappointing fourth-place finish in the World Championship, is obviously looking to the future. Appearances have always mattered for the red cars. We'll see if they bring the Scuderia success this season and beyond. Jeep Begins Fixing 1.56 Million Recalled Grand Cherokee, Liberty SUVs

Chrysler is just now beginning the big job of fixing 1.56 million older Jeep SUVs seven months after a recall was announced, according to The Detroit News. Jeep Grand Cherokees sold between 1992 and 1998 and Jeep Liberty models sold between 2002 and 2007 are being recalled because the gas tank can leak in the event of a rear-end collision, leading to a fire. The National Highway Traffic Safety Administration originally requested the recall of 2.7 million vehicles. Chrysler initially disputed NHTSA's findings and seemed willing to go through a court battle until an 11th-hour deal reduced the number of vehicles involved in the recall. The remaining vehicle owners left out of the recall will receive a "customer service action" notification and may not get fixed. Chrysler says the vehicles are safe and need no repairs. Fixing the 1.56 million Jeeps will cost Chrysler $151 million. NHTSA cited 51 deaths causes by such tank fires. Chrysler plans to install protective trailer hitches to protect the gas tanks, but even the automaker admits the hitches will only provide incremental protection in a low-to-moderate speed rear-end crash.
