NHTSA questions FCA's reaction to recalls, will hold public hearing

The US Department of Transportation and National Highway Traffic Safety Administration are holding a public hearing on July 2 to investigate whether FCA US is failing to fix safety problems and issue necessary notices. The agencies also want detailed accounts of the handling of 20 recalls by June 1 as part of a special order. If the Feds determine that the automaker isn't living up to its legal requirements, the result could go as far as a "buy-back or replacement of affected vehicles." "Significant questions have been raised as to whether this company is meeting its obligations to protect the drivers from safety defects, and today we are launching a process to ensure that those obligations are met," NHTSA administrator Mark Rosekind said in the announcement of the hearing. The 20 recalls that the agencies are investigating date from between 2013 and 2015. Just some of these include the action to make the fuel tanks safer on the Jeep Grand Cherokee and Liberty; FCA US' Takata inflator repairs; inadvertently deploying airbags in the Liberty, Grand Cherokee and Dodge Viper; and the company's ignition switch fix for the Chrysler Town & Country, Grand Caravan and Journey. In a statement to Autoblog, FCA US said, "The average completion rate for FCA US LLC recalls exceeds the industry average and all FCA US campaigns are conducted in consultation with NHTSA. The Company will cooperate fully." The government agencies claim that they have received complaints from customers alleging that they weren't notified of recalls; parts not being available; difficulty getting an appointment, and misinformation from dealers. During the hearing witnesses from FCA US, NHTSA and the public have the opportunity to present evidence on each campaign. Bad news for fans of the obscene output of the Dodge Hellcat twins, as FCA has announced a voluntary recall of both 707-horsepower variants of the 2015-model-year Charger sedan and Challenger coupe. According to FCA, a total of 2,211 cars are being recalled after a dealer discovered a "possible fuel leak" during a pre-delivery inspection. Despite getting cleared by suppliers, FCA claims its engineers found "improperly installed" hose seals. Owners of affected vehicles will receive notification and be asked to report in for repairs. Of the vehicles affected, the overwhelming majority, 2,012, were sold in the US market. The remainder were sold in Canada (148), Mexico (30) and just 21 outside of North America. An FCA US dealer alerted the Company to a possible fuel leak following a pre-delivery vehicle inspection. These components had passed the supplier's leak-testing, but FCA US engineers launched an investigation and discovered certain hose seals may have been improperly installed. The Company is unaware of any related injuries, accidents or customer complaints. Affected are model-year 2015 Dodge Challenger SRT coupes and Dodge Charger SRT sedans equipped with 6.2-liter V-8 engines. There are an estimated 2,012 in the U.S.; 148 in Canada; 30 in Mexico and 21 outside the NAFTA region. Affected customers will be notified and advised when they may schedule service. NHTSA preparing to wallop FCA, automaker 'failed to do its job'

As embattled the National Highway Traffic Safety Administration may be, but that certainly doesn't mean it isn't willing or able to put the smack down on automakers that violate its recall procedures. Following a public hearing on Thursday, the government safety arm is preparing what will likely be some very serious punishments for Fiat Chrysler Automobiles. FCA stands accused of mishandling 23 individual recalls covering some 11 million vehicles since 2013, with NHTSA claiming the Italian-American automaker kept it "in the dark," failing to notify the government of safety defects. Uncle Sam also alleges that FCA failed to notify consumers of important safety notices and didn't provide a steady supply of replacement parts. For these charges, the automaker could be fined up to $35 million per recall, which could mean a maximum of $805 million in fines. FCA could also be forced to buy back the unrepaired vehicles. "We have serious concerns with Fiat Chrysler notifications to owners and to NHTSA about its recalls. In every one of the 23 recalls, we have identified ways in which Fiat Chrysler failed to do its job," Jennifer Timian, the head of the Office of Defects Investigation, said during the FCA hearing, The Detroit News reports. The company also "repeatedly failed to provide NHTSA with other critical information about its recalls, including changes to the vehicles impacted by the recalls and its plans for remedying those vehicles." Fiat Chrysler, for its part, didn't really fight back during its hearing, although Scott Kunselman (shown above during the hearing), the senior vice president of vehicle safety and regulatory affairs at FCA, did tell The News that, "We absolutely had no mis-intent." "The plan is to move forward," Kunselman said, adding that the company has "fallen short," and that "some of the things we've done were sloppy." NHTSA administrator Mark Rosekind told The News that the regulator would issue its sanctions by the end of July, adding that he saw no way that FCA could avoid punishment.
