GM isn't liable for punitive damages in ignition switch cases

NEW YORK — A federal appeals court said General Motors is not liable for punitive damages over accidents that occurred after its 2009 bankruptcy and involved vehicles it produced earlier, including vehicles with faulty ignition switches. The 2nd U.S. Circuit Court of Appeals in Manhattan said on Tuesday that the automaker did not agree to contractually assume liability for punitive damages as part of its federally-backed Chapter 11 reorganization. GM filed for bankruptcy in June 2009, and its best assets were transferred to a new Detroit-based company with the same name. The other assets and many liabilities stayed with "Old GM," which is also known as Motors Liquidation Co. Tuesday's 3-0 decision may help GM reduce its ultimate exposure in nationwide litigation over defective ignition switches in several Chevrolet, Pontiac and Saturn models. It is also a defeat for drivers involved in post-bankruptcy accidents, including those who collided with older GM vehicles driven by others, as well as their law firms. The ignition switch defect could cause engine stalls and keep airbags from deploying, and has been linked to 124 deaths. A lawyer for the drivers and their law firms did not immediately respond to requests for comment. GM had no comment. Circuit Judge Dennis Jacobs said GM's agreement to acquire assets "free and clear" of most liabilities excused it from punitive damages claims for Old GM's conduct. He also noted that the judge who oversaw the bankruptcy concluded that the new company could not be liable for claims that the "deeply insolvent" Old GM would never have paid. The decision upheld a May 2018 ruling by U.S. District Judge Jesse Furman in Manhattan, who oversees the ignition switch litigation. Drivers have sought a variety of damages in that litigation, including for declining resale values. GM has recalled more than 2.6 million vehicles since 2014 over ignition switch problems. It has also paid more than $2.6 billion in related penalties and settlements, including $900 million to settle a U.S. Department of Justice criminal case. Chevy Volt owners log half a billion electric miles, 2015 production starts

As General Motors gets ready to start 2015 Volt production Monday, Chevrolet is looking back at some of the numbers that got the car to where it is today. The headline number is that Volt owners have collectively put more than a half-billion electric miles on their cars. The unsurprising upshot is that, if you went out and bought a Volt, you're pretty keen on getting as many electric miles out of it as possible. 90 percent of all Volt trips are done purely on electric power. The typical Volt driver goes 970 miles between fill-ups, GM says, and that means that 63 percent of all miles are done on battery power. General Motors executive director Larry Nitz gave AutoblogGreen a few more details on the usage habits of Volt drivers, including that 81 percent of commuting miles are electric. Two-thirds of US Volt drivers charge their vehicle 1.4 times a day, a clear indicator of drivers trying to maximize electric miles through opportunity charging. In fact, Nitz said, 90 percent of all Volt trips are done purely on electric power. GM also says that the Volt's official 35 miles of electric range is still doable for many owners who have had their car for more than 30 months. Looking ahead, we know that one upgrade for the 2015 Volt will be 4G LTE connectivity that can turn the car, like others in the GM family, into a mobile wifi hotspot. We're of course much more interested in when GM is finally going to start production of the next-gen Volt, but GM officials would only tell us that they're very excited about the still-secret vehicle, promising we'll be learning more "soon." Nitz did confirm that today's Volt drivers are most interested in three things from the next-gen model: more range, a lower price and a fifth seat. He did not say whether or not GM will be able to deliver on those requests. Chevrolet Malibu gets across-the-board price cuts, hopes to dig out of slump

To say that things aren't going well for the newly redesigned 2013 Chevrolet Malibu is a pretty sizable understatement. Reports have been swirling about the Malibu getting an emergency design refresh, less than a year after its introduction, as well as having its production at the Fairfax Assembly Plant halted twice already this year for excessive inventory. Now, Motor Trend is reporting that the midsize sedan will be receiving price drops across the board ranging from $300 on a number of models up to $770 on the 1LT trim; offsetting some of MSRP drop, though, the destination charge has increased from $760 to $810.
Without destination, the entry-level Malibu LS now starts at $21,995, which is still about $300 more than a Honda Accord and about $300 less than the segment's top-selling Toyota Camry. This new pricing also drops the price of the Eco, 2LT and 3LT trims by $300. The LTZ trim has dropped by $415, meaning that the Malibu's top dog now starts at just under $30,000, excluding destination.
